line and h.d .truck the re.r of William strouso who w.. .topped in
the right-h.nd lane. It i. admitted that Plaintift w.e operating a

time and pl.ce, Defendant, cuc Thu Ngo, f.iled to bring her vehicle
to a .top and collided with the rear of Pl.intiff.'s vehicle,
cau.ing the Pl.intiff'. vehicle to be pushed forward into a 1987
Dodge Shadow being operated by William strouse, III. To the
contrary, Plaintift'. vehicle had collided with the Willi.m
strou.e'. vehicle. The remaining averment. of paragraph S are
conclu.ion. ot law to which no relponsive pleading i. required. To
the extent. re.ponse ie deemed required, it is specific.lly denied
that the eUbject accident resulted from any .ct or omis.ion on the

or allowed her vehicle to strike and collide with the rear of
the vehicle operated by the Plaintiff. Any implicit averment

emergency.

through her attorneys, LAW or'FICES OF TIMOTHY A.
SHOLLENBERGER, and does respectfully represent the
following I
1. Plaintiff, PATRICIA A. POPE, is an adult
individual wh~ currently resides at 1513'South 12th Street,
Harrisburg, Dauphin County, Pennsylvania.
2. Defendant, CUC THU NGO, is an adult individual
whose last known address is 2142 North 6th Street,
Harrisburg, Dauphin County, Pennsylvania.
3. The facts and circumstances hereinafter set forth
took place on October 7, 1993 at or about 5155 p.m. in the
2700 block of the Camp Hill Bypass, camp Hill, cumberland
County, Pennsylvania.

4. At the aforesaid time and place, Plaintiff,
PATRICIA A. POPE, was operating a 1984 Oldsmobile stopped in
traffic in the right, westbound lane of the Camp Hill
Bypass.

5. At th~ aforesaid time and place, Defendant, CUC
THU NOO, was operating a 1991 ~l~nQuth Van in the right,
westbound lane of the Camp Hill Bypass.
6. At the aforesaid time and place, Defendant, CUC
THU NGO, failed to bring her vehicle to a stop and collided
with the rear of Plaintiff's vehicle, causing the
Plaintiff's vehicle to be pushed forward into a 1987 Dodge
Shadow being operated by william Strcuse, III.
7. The aforesaid coll~sion was the direct and
proximate result of the negligence of Defendant, CUC THt1
NOO, in operating her vehicle in a careless, reckless and
negligent manner as followsl
a. In failing to have her vehicle under proper
and adequate control,
b. In failing to operate her vehicle at such a
speed and in a manner so as to be able to
stop within the assured clear distance ahead
in violation of 53361 of the Pennsylvania
Motor Vehicle Code,
c. In failing to apply her brakes in time to
avoid a collision,
d.
In permitting or allowing her vehicle to
strike and collide wl.th the rear of the
vehicle operated by the Plaintiff,

manner that would allow her to stop within
the assured clear distance ahead,

In otherwise operating said vehicle in a
careless, reckless and negligent manner and
in a manner violating the Motor Vehicle Code
of the commonwealth of Pennsylvania.
8. As a direct and proximate result of this
collision, Plaintiff, PATRICIA POPE, has suffered serious
and permanent injuries including but not limited to,
a. Severe strain and spraJ.n of the nluscloes,
tendons, ligaments and other soft tissues at
or about the lumbar ~pinQ;
b, Severe' strain- and sprain of the muscles,
tendons, ligaments and ot~er soft tissues at
or about the cervical spinel
c. Left sacx'oiliac syndrome;
d, Left knee bruise;
e. Chest bruise;
f. Severe strain of the nerves and nervous
system;
g, Extreme mental and physical anguish,
9. As a direct and proximate result of the aforesaid
injuries, Plaintiff, PATRICIA POPE, has undergone and in tho
future will undergo great pain and suffering for which

pushed her vehicle into that driven by the Plaintiff, William J,

caused in whole or in part by the negligence of Additional
Defendant Cue Thu Ngo which consisted of the followingl

1. On March 24, 1994, a Complaint in the
above'-captioned action was filed with the Cumberland County
Court, filed as number 1440 Civil 1994. A true and correct
copy of tbe Plaintiff's Complaint ir. attached hereto,
incorporated by reference herein and marked as Exhibit "A".
2. On or about February 18, 1994, William J. Strouse,
III filed a Complaint against the above-captioned Plaintiff
in Cumberland County Court. That action was filed as Number
434 Civil 1994. A true and correct copy of said Complaint
is attached hereto, incorporated by reference herein and
marked as Exhibit "B".

At the aforesaid timo and place, Defendant, eue
THU NGO, was operating a J.991 Plymouth Van in tho right,
westbound lane of the Camp Hill Bypaos.
6. At the aforesaid time and place, Defendant, CUC
'rflU NGO, failed to bring her vehicle to a stop and colJ.!ided
with the rear of Plaintiff's vehicle, causing the
Plaintiff's vehicle to be pushed forward into a 1987 Dodge
Shadow being operated by William Strouse, III.
7. The aforesaid coll!sion was the direct and
proximate result of the negligence of Defendant, eue THU
NGO, in operating her vehicle in a careless, reckless and
negligent manner as followsl
a. In failing to have her vehicle under proper
and adequate control,
b, In failing to operate her vehicle at such a
speed and in a manner so as to be able to
stop within the assured clear distance ahead
in violation of 53361 of the Pennsylvania
Motor Vehicle Code,
c. In failing to apply her brakes in time to
avoid a collision,
d, In permitting or allowing her vehicle to
strike and collide with the rear of the
vehicle operated by the Plaintiff,
e. In failing to drive at a speed and in a
manner that would allow her to stop within
the assured clear distance ahead,
f.
In failing to keep a proper lookout and to
notice within a reasonable time the
Plaintiff's vehicle stopped in front of her,

8, As a direct and proximate result of this

a. Severe strain and sprain of the muscles,
tendons, ligaments and other soft tissues at
or about the lumbar spinel
b. Severe' strain- and sprain of the muscles,
tendons, ligaments and otoer soft tissues at
or abo~t the cervical spine,
c, Left sacroiliac syndrome I
d, Left knee bruise,
e. chest bruisel
f. Severe strain of the nerv~s and nervous
system,
g. Extreme mental and physical anguish,
9. As a direct and proximate result of the aforesaid
injuries, plaintiff, PATRICIA POPE, has undergone and ion the
future will undergo great pain and SUffering for which
damages are claimed.
10, As a further result of this collision, Pla.intiff,

AND NOW, comes the Plaintiff, PATRICIA A. POPE, by and
through her attorneys, LAW OFFICES OF TIMOTHY A.
SHOLLENBERGEf", and does respectfully represent the
following I
1. Plaintiff, PATRICIA A. POPE, is an adult
individual who currently resides at 1513 South 12th Street,
Harr.isburg, Dauphin County, Pennsylvania.
2. Defendant, CUC THU NGO, is an adult individual
whose last known address is 2142 North 6th Street,
Harrisburg, Dauphin county, Pennsylvania.
3. The facts and circumstances hereinafter Bet forth
took place on October 7, 1993 at or about 5155 p.m. in the
2700 block of the Camp Hill Bypass, Camp Hill, Cumberland
County, Pennsylvania.
4. At the aforesaid time and place, Plaintiff,
PATRICIA A. POPE, was operating a 1984 Oldsmobile stopped in
traffic in the right, westbound lane of the Camp Hill
Bypass.

5. At the aforesaid time i!nd place, Defendant, CUC
THU NGO, was operating a 1991 Plymouth Van in the right,
westbound lane of the Camp Hill Bypass.
6. At the aforesaid time and place, Defendant, cue
THU NGO, failed to bring her vehicle to a stop and collided
with the rear of Plaintiff's vehicle, causing the
Plaintiff's vehicle to be pushed forward into a 1987 Dodge
Shadow being operated by William strouse, III.
7, The aforesaid collision was the direct and
proximate result of the negligence of Defendant, CUC THU
NGO, in operating her vehicle in a careless, reckless and
negligent manner as followsl
a, In failing to have her vehicle under proper
and adequate control I
b. In failing to operate her vehicle at such a
speed and in a manner so as to be able to
stop within the assured clear di~tance ahead
in violation of ~3361 of the Pennsylvania
Motor Vehicle Codel
c. In failing to apply her brakes in time to
avoid a collision,
d. In permitting or allowing her vehicle to
strike and collide with the rear of the
vehicle operated by the Plaintiff,
e, In failing to drive at a speed and in a
manner that would allow her to stop within
the assured clear diotance ahead,
f, In failing to keep a proper lookout and to
notice within a reasonable time the
Plaintiff's vehicle stopped in front of her,
and,

In otherwise operating said vehicle in a
careless, reckless and negligent manner and
in a manner violating the Motor Vehicle Code
of the Commonwealth of Pennsylvania.
e, As a direct and proximate result of this
collision, Plaintiff, PATRICIA POPE, has suffered serious
and permanent injuries including but not limited tOI
a. Severe strain and sprain of the muscles,
tendons, ligaments and other soft tissues at
or about the lumbar spinel
b. Severe strain and sprain of the muscles,
tendons, ligaments and other soft tissues at
or about the cervical spine,
c, Left sacroiliac syndrome I
d, Left knee bruisel
e. Chest bruissl
f. Severe strain of the nerves and nervous
system,
g. Extreme mental and physical anguish,
9, As a direct and proximate result of the aforesaid
injuries, Plaintiff, PATRICIA POPE, has undergon~ and in the
future will undergo great pain and suffering for which
damages are claimed.
10. As a further result of this collision, Plaintiff,
PATRICIA A. POPE, may incur reasonable and necessary medical
and rehabilitative costs and expenses in excess of the

Pennsylvania Motor Vehicle Financial Responsibility Law,
worker's compenlllation or any program, grollp cJOntract or
other arrangement for payment of benefits as defined in 75
Pa. C. S. A., Section 1719.
11. As a fUrther result of the aforesaid injuries,
Plaintiff, PATRICIA A. POPE, has suffered and may continue
to suffer a loss of earnings for which damages are claimed.
12. As a further result of the aforesaid injuries,
Plaintiff, PATRICIA A. POPE, has suffered a permanent
diminution in her earning capacity and power for which
damages are claimed.
13. As a further result of the aforesaid injuries,
Plaintiff, PATRICIA A. POPE, has sustained a permanent
diminution in his ability to enjoy life and life's pleasur.!s
for which damages are claimed.
14. As a further result of the aforesaid injuries,
Plaintif.f, PATRICIA A. POPE, has incurred or may hereinafter
incur financial expenses and losses which exceed sums
recoverable under the limitations and exclusions of the
Pennsylvania Motor Vehicle FinanciaL Responsibility Law for
which damages are claimed.
