AND NOW, comes Farmers Trust Company, through its attorney,
William A, Duncan, Esquire, and files this Complaint in
Mortgage Foreclosure, of which the following is a statement I
1, Plaintiff is Farmers Trust company, a corporation
organized and existing under the laws of the Commonwealth ot
Pennsylvania with its main office and principal place of
business located at 1 West High street, Carlisle, Cumberland
County, Pennsylvania 17013.
2, Defendant, Carl R, stone, an adult individual, who
resides at 157 ", East st" Carlisle, Cumberland county,
Pennsylvania 17013.
3, On or about August 6, 1987, Defendants made, executed
and delivered to Plaintiff a note and security agreement and a
real e.tate mortgage financing Eighteen Thousand Dollars and no
Cents ($18,000.00) a copy of said note and security agreement
and said real estate mortgage being attached hereto as Exhibits
"A" and "8", respectively, and are incorporated herein by
reterence as though tully Bet forth.
4. Said note and security agreement and said real estate
mortgage have not been assigned,
~, Carl R. stone is the sole record owner in fee simple of
said premises subject to said mortgage, by virtue of a Deed
dated and reoorded on August 6, 1987, and reoorded in the
Cumberland County Reoorder's Offioe in Deed Book "V", Volume
32,page 916, more speoifioally set forth in Exhibit "C",
attached hereto and made a part hereof by reference.
6. Said note and security agreement and said real estate
mortgage are in default because Defendants herein have failed
to pay the payments that were due and owing for the months of
February 6, 1994 and March 6, 1994,
7. The Plaintiff has given to the Defendants written
notice of intention to foreclose on said mortgage as required
by law under Act 6, dated February 8, 1994, a copy of which is
marked Exhibits "0", and attached herlilto and made a part hereof
by reference.
8, The Plaintiff has given written notice of default as
required by the Homeowner's Emergenoy Assistance Act of 1983,
dated February 8, 1994, a copy of which is marked Exhibits "E",
and attaohed hereto and made a part hereof by reference,

9, By realon of t~e aforesaid default, t~e entire
prinoipal balance of Nine T~ousand Eig~t Hundred Fourty~Six and
81/100 ($9,846,81) Dollars, with interest t~ereon at t~e rate
of eleven (11') percent per annum computed from February 6,
1994, accruing insurance premiums, attorney's fees in the
amount of Five Hundred Eig~teen and B9/100 Dollars ($518.89)
are now due and payable,
10. The Defendants are liable to the Plaintiff for t~e

favor of Plaintiff and to order the foreclosure and sale of the
morgaqed property and for the amount of Ten Thousand Nine
Hundred Fifty and 91/100 Dollars ($10,950.91) Dollars together
with interest thereon, costs and all other amounts advanced by
Plaintiff,
