MERLE E, FRAKER, is an adult individual residing at Lot 98, Spring Garden Estates, Carlisle, PA 17013. 3, The Defendant, BEVERLY A, FRAKER, is an adult individual residing at Lot 98, Spring Garden Estates, Carlisle, PA 17013. C9UN'l'...ORE 4, The averments in Paragraph One and Two and Three are restated and incorporated herein by reference, 5, On or about January 17. 1992, the Defendants executed an Application for a Visa/MasterCard issued by the Plaintiff, A copy of said Application is attached hereto and made part hereof. as Exhibit "A", 6, The Plaintiff accepted the Defendants' Application and sent them a Visa/MasterCard and an Agreement of Customer Payments Schedule, A copy of said Agreement is attached hereto as Exhibit "B" and made part hereof, . ..~"~"''''r'.''._'' . ',: '. 7, Pursuant to the terms and conditions of the Application and Agreement as aforesaid, the Defendants agreed to pay Pl ainH ff monthly installments equal to the greater of Fifteen Dollars ($15.00), or not less than Five percent (5\) of the outstanding balance on the account, plus interest, and attorney's fees, 8, The Defendants' Application was approved and their card issued from, and their account administered by, the Plaintiff in its business offices in Dauphin County, Pennsylvania, 9, The Defendants have defaulted on the terms and conditions of the Application and Agreement by failing to make sufficient and timely payments as agreed, and the account is substantially delinquent. 10, The balance due and owing as of March 16, 1994, is Five Hundred Eighty-four Dollars and Seventy-five Cents ($584,75), plus interest, attorney's fees and costs of suit, 11, Plaintiff has demanded payment from the Defendants, MERLE E, FRAKER and BEVERLY A, FRAKER, who have refused and neglected, and still refuse and neglect to pay same, WHEREFORE, Plaintiff demands judgment against the Defendants, MERLE E, FRAKER and BEVERLY A, FRAKER, in the amount of Five Hundred Eighty-four Dollars and Seventy-five Cents ($584,75), plus interest, at the contract rate from March 16, 1994, attorney's fees and costs of suit, -2- t'"?"".....-,',.,.-,'.-., GP~NT__THQ 12, The averments in Paragraph One and Two and Three are restated and incorporated herein by reference, 13, On or about November 21, 1991, the Plaintiff advanced the sum of Twelve Thousand Five Hundred Seventy-two Dollars and Five Cents ($12,572,05) to the Defendants at an interest rate of Seventeen and Ninety-five one hundredths (17,95) percent per annum resulting in a finance charge of Five Thousand One Hundred Thirty-eight Dollars and Fifty-one Cents ($5,138,51) for a total repayment amount of Seventeen Thousand Seven Hundred Ten Dollars and Fifty-six Cents ($17,710,56), hereinafter called the "Loan", 14, As evidence of the Loan, Defendants, executed and delivered to the Plaintiff a Pennsylvania Motor Vehicle Installment Sale Contract dated November 21, 1991 by which Defendants promised to pay to Plaintiff the sum of Seventeen Thousand Seven Hundred Ten Dollars and Fifty-six Cents ($17,710,56), hereinafter called the "Contract", A copy of the Contract is attached hereto as Exhibit "C" and made part hereof, 15, As security for the Loan, the Defendants, MERLE E, FRAKER, and BEVERLY A, FRAKER, granted to Plaintiff a security interest in a 1988 Ford Bronco, Vehicle Identification Number IFMEU15N4JLA54174, 16, Under the terms of the Contract, Defendants agreed to pay to Plaintiff the sum of Three Hundred Sixty-eight Dollars and Ninety- seven Cents ($368,97) per month, beginning December 21, 1991, and monthly thereafter for a period of forty-eight (48) months, -3- 17, Pursuant to the terms of the Contract, fai lure to make any payment on or before the date it is due constitutes a default. 18, The Defendants defaulted under the Contract by failing to make the payments due and owing on September 21, 1993 and all monthly payments thereafter, 19. By virtue of Defendants' default, Plaintiff took possession of the Vehicle which was then held in storage in Dauphin County, Pennsylvania 17108, 20. On or about November 29, 1993, Plaintiff sent a Notice of Repossession of the Vehicle, to the Defendants, A copy of said Notice of Repossession to the Defendant. MERLE E. FRAKER, is attached hereto as Exhibit "0" and made part hereof, A copy of said Notice of Repossession to the Defendant, BEVERLY A. FRAKER, is attached hereto as Exhibit "E" and made part hereof, 21, Defendants failed to take any timely action in accordance with said Notice of Repossession, 22. The Vehicle was sold at public sale on January 8, 1994, in Dauphin County, Pennsylvania 17108, 23, After sale of the Vehicle and application by Plaintiff of the proceeds of the sale of the Vehicle to the Loan, a deficiency balance in the amuunt of Two Thousand Two Hundred Ninety-eight Dollars and Forty-four Cents ($2,298,44), plus interest as stated in the Contract, remained due and owing on the Loan, 24, On or about January 14. 1994, Plaintiff notified the Defendants of the deficiency balance on the Loan and requested -4- "'.."r............;,';.......
