COMPLAINT
COMES NOW the Plaintiff, Richard W. Rodgers, by and through
his attorney, Gregory R, Reed, Esquire and for his causes of action
allege:
1. Plaintiff, Richard W, Rodgers, is an adult individual
residing at 6019 William Drive, Mechanicsburg, Pennsylvania
(hereinafter referred to as "Plaintiff"),
2. Defendant, Margaretten & Company, Inc., is a corporation
doing business wi thin Cumberland County, Pennsylvania, with offices
at 2810 North Parham Road, Richmond, Virginia 23294-4400
(hereinafter referred to as "Defendant"),
3, On or about August 31, 1990 Sovran Mortgage corp~ration
took a mortgage on property located at 6019 william Drive, Hampden
Township, Cumberland County, Pennsylvania in the amount of
$66,500,00,
4, Plaintiff on the aforesaid date, owned said real estate.
Thereafter, Sovran Mortgage corporation assigned said mortgage to
Defendant,
5, On or about October 15, 1994 Plaintiff delivered a check

to Defendant in the amount of $65,185.90 as payment in full of said
indebtedness (a copy of the cover letter and cancelled check are
attached hereto, marked Exhibit "A" and incorporated herein by
reference).
6. On December 13, 1993 the mortgage had not been satisfied
of record so Plaintiff's counsel wrote to Defendant, by first class
mail, asking Defendant to immediately satisfy the mortgage (a copy
of said letter is attached hereto, marked Exhibit "B" and
incorporated herein by reference),
7, On January 18, 1994, the mortgage remains unsatisfied,
Plaintiff's counsel corresponded with Defendant by certified mail
requesting that the mortgage be satisfied immediately (a copy of
said letter and the return receipt are attached hereto, marked
Exhibit "C" and incorporated herein by reference),
8. Defendant has for a period of more than five (5) months,
and continues to refuse to satiSfy said mortgage.
9, Defendant refused to satisfy the mortgage is capricious,
spiteful and vexatious,

WHEREFORE, Plaintiff respectfully request that judgment be
entered for plaintiff and against Defendant in the amount of

(30) days, If this mortgage is not satisfied within the next
thirty (30) days I will file an action against you which will carry
