CIVIL ACTION
1. The Plaintiff is New York State Higher Education Services
Corporation, with a place of business at 99 Washington Avenue,
Albany, NY 12255.
2. The Defendant is Tamara M. Rainwater f/k/a Tamara M.
Schneider, an individual currently residing at 748 Market Street,
Lemoyne, PA 17043.
3. On or about August 25, 1981 through November 30, 1982, the
Defendant entered into various promissory notes as set forth below
pursuant to the Guaranteed Student Loan Program, whereby the Hudson
City Savings Institute advanced to the Defendant a total of
$5,000.00 in student loans guaranteed by Plaintiff. True and
correct copies of the promissory notes executed by the Defendant or
applications approved by the original lender are attached hereto,
made a part hereof, and marked collectively as Exhibit "A".

4. Pursuant to the terms and conditions of the promissory Notes
set forth as Exhibit "A" to this Complaint, Defendant defaulted
and breached the said promissory notes and, at the time of said
default and breaches, had an outstanding balance of principle in
the amount of $3,918.38. Attached as Exhibit "B" to this Complaint
is an affidavit of debt executed by Plaintiff, which evidences the
amount of indebtedness owed by Defendant.
5. At some point after the breaches of Defendant as set forth
above, pursuant to the terms of the Promissory Notes executed by
Defendant, the said notes were purchased by plaintiff from The
Hudson City Savings Institution for the amount of indebtedness owed
by Defendant. Plaintiff is now the holder of the said notes.
6. Pursuant to the terms of the Promissory Notes attached to
this Complaint as Exhibit "A", the plaintiff is entitled to
interest charges and late payment fee assessments, which as of
October 31, 1993, equalled the sum of $427.00, such interest
accruing at a rate of 9% per year.
7. Although demand has been made upon the Defendant, the
Defendant has failed and refused and still fails to make payments
to Plaintiff.

WHEREFORE, Plaintiff demands judgment against the Defendant
in the sum of $4,345.38, plus interest from October 31, 1993 at the
contract rate of 9% and costs of this action.

AFFIDAVIT OF FACTS
CONSTITUTING CLAIH
The undersigned being duly sworn, deposes and says:
1. I am a representative for the New York State Higher Education Services Corporation,
(NYSHESC), plaintiff herein.
2. NYSHESC as part of Its statutory authority guarantees the repayment of educational
loans made by commercial lenders to students and their parents. In the regular course
of NYSHESC'S business It maintains records of such guarantees, and of the repayment
status of such loans. In the event the principal debtor does not repay the loan
as agreed In the written promissory notes given as 'evidence of the debt, the loans
are held In default, NYSHESC pays the lender, and establishes un Its books and
records an account due for the particular debtor Involved. Such books and records
are maintained In the ordinary course of business In a computer format from which
any and all Information relative to a particular account may be extracted and printed.
3. Such books and records reflect that the above named defendant obtained under
Social Security Number 076-62-8437 , one or more NYSHESC guaranteed educational
loans, that such loans were not paid when due and NYSHESC was thereby compelled to
honor Its guaranty to the lender, and the defendant currently owes to this Corporation
on such account $ 3,918.38 in principal plus $ 427.00 in Interest through 10/31/93
plus addItional Interest at the rate of 9.00% due from such date, plus an amount of
$ 0'.00 for the cost of supplemental preclalms assistance performed by NYSHESC
which Is.a permissible charge to the defendant pursuant to Section 428(c) (16) (C) of
the Higher Educat I on Act of 1965, as amended (28 USC 1078 (c) (6) (C)). payment of
which has been duly demanded but not made.

4. The defendent has not applied for or received cancellation of this guaranteed
student loan on the basis of death, permanent and total disability, or
bankruptcy, which are the ~nly grounds established in law for the cancellation
of such loans.
