PETITION FOR SPECIAL RELIEF
AND NOW COMES, Clarence and Tracy Thompson (hereinafter referred to as
"Petitioners"), by and through their allorneys. MARTSON DEARDORFF WILLIAMS & OTIO,
and avers as follows:
I. Petitioners are the paternal grandparents of Andrew D, Thompson born Mareh 23,
1994 and they reside at 4452 Maplewood Meadows Avcnue. Grand Blank. MI 48439,
2, Nathan Akil Thompson and Alicia Anne Smith are Ihe natural parents of Andrew D,
Thompson and reside as follows:
a. Nathan Akil Thompson resides at 970 Sorrento Drive, Weston, FL 33326,
b, Alicia Anne Smith resides at 970 Sorrento Drive, Weston, FL 33326,
3, John and Maureen Bray are the maternal grandparents of Andrew D, Thompson and
reside at 1306 Camellia Circle, Weston FL 33326,
4, Custody of Andrew Thompson is governed pursuant to an Order of the Court of
Common Pleas of Cumberland County, Pennsylvania, Judge Edgar B, Bayley, dated January 23,
1997, A copy ofthis is allached hereto as Exhibit A,
5, All of the parties have been following the aforesaid Order until recently,
6, Pe1itioners had custody of Andrew this summer for two weeks pursuant to the Court's
Order,
7, The parties had been alternating major holidays pursuant to the Court's Order. This
year, 1999, Petitioners are scheduled to have custody of Andrew during the Christmas holidays.

8. Petitioners have now been told by the mother, Respondent Alicia Anne Smith, that
she will not pennit Petitioners to have eustody of Andrew during the Christmas holidays, apparently
eiling late notice, A copy of her recentlettcr dated November 20, 1999 is attached as Exhibit 8,
9, Andrew is 5 years old and started Kindergartcn, September 1999,
10. When the mother, Respondent Alicia Anne Smith, received custody of Andrew back
from Pelitioners following the two week summer visitation, it was discussed that specific
arrangements for Christmas would be mode at a later date,
II, Petitioners hove made numerous phone calls to Respondent Alicia Anne Smith, both
to discuss arrangements for the Christmas visitation, and also to generally speak with their grandson,
Andrew; however, with few exceptions, the calls have not been returned,
12, The only call that was returned so Ihat Petitioners could speak to Andrew occurred
on September 20, 1999 at 8:00 p,m, where Andrew was pernlitted to speak to Petitioners for five
minutes when the call was abruptly tenninated by Respondent Alicia Anne Smith who stated that
Andrew hod to go to bed,
13, Petilioners have installed a toll free telephone number at their residence forcalls from
Respondent Alicia Anne Smith and their grandson, Andrew; however, with the above exception and
one other exception, no calls were mode,
14, Petitioners made numerous call to the residence of Respondent, Alicia Anne Smith,
in unsuccessful allempts to (1) reach Andrew and (2) finalize arrangements for the Christmas
visitation,
15, On one ofthese calls, Petitioners were told that Andrew was not Ihere despite the fact
that they could hear him speaking in the background,
16, The only other phone call from Respondent, Alicia Anne Smith, was a very short,
several second phone call in which Respondent, Alicia Anne Smith, told Petitioners Ihat they would
not hove custody of Andrew this Christmas,
17, In the absence of any cooperation, or even response, from Respondent, Alicia Anne
Smith, regarding arrangements for Christmas visitation with Andrew, Petitioners made airline
arrangements which were necessitated due to the passage of time and Ihe shortness of time until
Christmas, A copy of Petitioners' printed itinerary is attached as Exhibit C, This has also been

furnished to Respondent, Alicia Anne Smith, as has always been the custom of Petitioners during
their periods of custody with Andrew,
18, No other Court has assumed jurisdiction over this matter and there is no Custody
Order in effect other than the Cumberland County Order of the Honorable Edgar B, Bayley dated
January 23, 1997 to this docket number,
WHEREFORE, Petitioners pray Your Honorable Court to enforce its Custody Order dated
January 23, 1997 and specifically Order the following:
a, Order and direct Respondent, Alicia Anne Smith, to honor the Court's Order and
provide custody of Andrew D, Thompson during the periods of time covered by the
itinerary attached hereto as Exhibit C;
b, Order and direct Respondent, Alicia Anne Smith, to accept all reasonable phone calls
from Petitioners regarding Andrew D, Thompson, answer questions that Petitioners
may reasonably have. and pennit Petitioners to have telephone access to Andrew D,
Thompson at all reasonable times;
c, Reimbursement to Petitioners of their attorney's fees and costs in enforcing this
Court's Order and;
d, Such other and further relief as the Court shall deem just and proper under the
circumstances,

C. Defendants, John and Maureen Bray of 1306 camellia circle,

G. The father ohall vhit thB child in the paternal
grandparents' home or at anothor location nearby, at the
option of the paternal grandparents when the child is with
the paternal grandparents upon 24 hours notice to the
paternal grandparento and to tho mother.
H. Any party ohall have reaoonable tolephone contact with the
child when another party hao cuotody or partial custody of
the child; to thio end, all parties shall provide each other
phone numbsr~ where the child can bo reached.
I. The mother agrees regularly to provide the maternal and paternal
grandparento photographo of the child and further agrees to keep
v
the paternal and maternal grandparents informed as to the child's
progress.
J. The father, the maternal and paternal grandparents may call the
mother at any time to obtain information regarding the child.
K. When tho paternal grandparents or the father are in the
vicinity of tho mother's reoidonco, upon at least 72 hours
advance notice to the mother, they may visit with the child
as such arrangements can bo agreed to by them and the mother
without the need to formally modify thio agreemont and

COMES NOW the Plaintiff, ALICIA ANNE SMITH, pro Sf!, and liIes this her
Motion to Dismiss for Lack of Subject Maller Jurisdiction/Lack of Insufficiency of
Process and Service of Process/Motion to Continue Hearing Based on Insufficient Notice
and states:
J. This case concerns my child. Andrew Thompson, date of birth March 23,
1994, currently age five.
2. The minor child was born out of wedlock while I was residing in the State
of Pennsylvania. After the birth of the child I wanted to finish my college education. I
agreed to let my son stay with the paternal grandparents. Clarence and Tracy Thompson,
who at that time lived in Tennessee. They now live in Michigan. This Court entered an
order agreeing to that arrangement.
3. After I was finished with college, I moved to Florida. An agreement was
signed between myself and the paternal grandparents to return custody of my son to me.
That agreement was effective on December 12, 1996 and at that time I came to Michigan
to pick up my son. I then immediately returned to Florida where 1 have lived ever sinee.
That agreement also provided for some visitation between my son and the paternal
grandparents.
4. This Court entered an order on January 23, 1997, which approved the
agreement between the parties. That order did not reserve jurisdiction over the subject
matter or of the parties.
S. On December II. 1999, when I returned home. I found on my doorstep
some legal papers. which includes a leller from Mr. Thomas J. Williams, and a copy of an
order entered by the Court on December 10. which schedules a hearing for six days later
on Thursday, December 16. The hearing seems to be on a Petition for Special Relief
filed by the paternal grandparents who continue to live in the State of Michigan.
6. This Court no longer has jurisdiction over the subject mailer of this
dispute in that I have lived in the State of Florida from August 1996 until the present time
and my son has lived with me in the State of Florida from December 12, 1996 to the
present time, Florida is now the home state of the child and the proper forum in which to
litigate any disputes that may arise over the child's care, custody, control and visitation.
Further the paternal grandparents who arc seeking the relief from this Court also do not
live in the State of Pennsylvania. The State of Pennsylvania no longer has any contact
whatsoever with the child, the Mother, the Father or the paternal grandparents who are
the ones seeking relief.
7. This Court should be aware that the Father of the child has never
complained about wanting to see his child, never appears to engage in any type of
visitation with the child and has paid almost no child support to me for the child.
8. At the present time I am engaged to be married, have plans with my son
over the holidays, which do not include sending my five year old son on an airplane to
Michigan to visit with the parents of his biological Father who has rejected him.
9. I believe service of the lawsuit was improper in that I was not personally
served, but rather and instead a package was left on my doorstep.
10. I believe initial process in this case is defective under Pennsylvania law, I
was not served with a summons.
II. There has been insufficient notice given to me in that I received all of
these papers on Saturday, December II, and I am supposed to be at a hearing on
Thursday, December 16, which pennits me only three working days to prepare for the
hearing.
12. I have not had sufficient time in which to retain Pennsylvania counsel to
put these papers in proper fonn.
13. By the filing of this paper I do not agree to submit myself to the
jurisdiction of the Pcnnsylvania court, but instead respcctfully assert that this Court has
no jurisdiction over me or my son and further has no jurisdiction ovcr the subject maller,

in view of the fact that my son and I live in Florida and have for over three years. If this
Court believes it has jurisdiction, it should defer that jurisdiction to the Florida Court, and

14, In support ofthc above I assert the following:
a, I have been domiciled in the State of Florida since August of 1996,
and have lived in the State of Florida from August 1996 to the present time;
b. On December 12, 1996, I went to Michigan to pick up my son,
immediately returned to Florida and have lived with my son in Florida since that time to
the present;
c. My driver's license is from the State of Florida;
d. I am registered to vote in the State of Florida;
e. I have filed my income tax returns using Florida as my address for
the tax years ending December 1996, December 1997, December 1998. In January I
intend to file my taxes for 1999 using my Florida address;
f. I am currently engaged to be married and after married intend to
continue to reside in the State of Florida with my Husband on a penn anent basis;
g. I am employed full time in Broward County, Florida;
h. My child's pediatrician is located in the State of Florida;
i. My child's dentist is located in the State of Florida;
j. My child began Kindergarten in August 1999, and the school is
located in the State of Florida;
k. My son is enrolled in extracurricular activities and all of his friends
associated with those activities as well as all of his schoolmates, playmates and neighbors
are located in the State of Florida;
I. I do not own any property located in the State of Pennsylvania, nor
do I have any contact with the State of Pennsylvania.

Your Honor, it is not and never has been our intention to Petition your Court about
this action. We found it both shocking and unusual that we are listed as petitioners
against our adult daughter Alicia.
We are the step-grandfather and matcrnal grandmother to Andrew Dominic
Thompson, age S. A1; grandparents we feel that his mother best decides the interests of
the child. She has always decided what is best for Andrew and we respect and support
her. Andrew is her child and we have always trusted in her judgment. For the past three
years that she and Andrew have lived close to us here in South Florida, she has
demonstrated responsibility, maturity. and admirable maternal skills. We are vel}' proud
of her. Additionally, it is our belief that she has fulfilled her obligations 10 the paternal
grandparents, Clarence and Tracy Thompson.
Alicia's father, Colonel Gregory E. Smith, has also supported and trusted in her
judgment. However, we caMot speak for the Thompsons. But we do trust and pray that
they would also respect Alicia's role as mother and main provider for Andrew. We
would also hope that thc Thompsons understand their role as grandparents and not as
"parents" with regard to this precious child,

PleRse understand that we will not be able to appear for this hearing on Thursday for
several reasons. We did not receive notice until late on Monday, December 13Ih, and this
short notice places a burden on us, Since retiring from active duty with the Army from
Carlisle Barracks over four years ago, I. John, have been chairing the Department of
Mathematics at Broward Community College. The college students are taking final
exams this week. My presence on campus is necessary. Maureen is presently enrolled as
a student and is also taking some final examinations. In addition. we have an under aged
son who depends upon us for transportation to school and other extracumcular activities.
Your Honor we have been supporting Alicia and Andrew financially in order to make
up for Nathan's lack of financial support in such areas as child support, and medical and
life insurance. The amount of time, energies, and monies that this situation has generated
would be belter served in continuing that support for Andrew. We as grandparents __
namely John and Maureen Bray as well as Colonel Smith -- feel that our financial
assistance should continue to help Alicia and Andrew since Andrew's father has not been
providing support with respect to the original court order.
Thank you for taking the time to review this malter, and we trust that you will
understand our inability to appear in Carlisle on Thursday.

Thia Agreement and stipulation entered into the day and year hereinafter
eet forth, ia by and between Alicia Anne Smith, natural mother, by her
attorney, Ruby D. Weeks, Esquire, and Nathan Akil Thompson natural father, the
paternal grandparente Clarence & Tracy Thompaon, and the maternal grandmother,
Maureen Bray and etep-grandfather, John Bray, who aver as followel
I. Recognizing that all parties have love and affection for the child and
intending to pre.erve all family connectione repreaented here, the
partie. agree to the following custody terme regarding cuetody of Andrew
Dominic Thompeon, and request the terms be entered as an Order of Court I
A. Plaintiff ie Alicia Anne Smith, natural mother and an adult eui
jurie, who residee at l306 Camellia Circle, Weeton, Broward
County, FL 33326.
B. Plaintiff is Nathan Akil Thompeon, natural father, 7151 Glenn
Terrace, Apt. 12, San Antonio, Bexar County, TX 78239.
C. Defendante, John and Maureon Bray of l306 Camellia Circle,
Weeton, Ft. Lauderdale, Broward County, rL 33326 are the
maternal step-grandfather and grandmother of the child,
D. Defendante, Clarence and Tracy Thompson, 5232 Country Wood
Lane, Brand Blanc, HI 48439 are the paternal grandfather and
grandmother of the child,
intend to exerciee for the year. The
I. It ie agreed that effective December 12, 1996, the
care and full legal and phyeical cuetody of the child
ehall be returned to the natural mother, who ie free
to relocate with the child to her place of roaidence
and the partiee agree to modification of the prior
Court Order dated March 31, 1994.

partial custody up to three weeke per
year, thie partial custody need not be
taken in coneecutive weeks.
(bl The paternal grandparent a may have partial
cuetody of the child during such additional
periods ae the parties ehall from time to time
aljree, without the need to modify the Order of
Court entered as a result of this stipulation.

p.m. These ehall be the arrangemente until such
time as the child etarte school. It is intended
that the father, who preeently livee with the
paternal grandparente ehall also spend thie time
with the child when the child ie at the paternal
grandparents.
3. The paternal ljrandparente ehall confirm periods of
partial custody two weeks in advance of each period of
partial custody they deeire to exerciee.
4. The paternal grandparents shall provide a prepaid
round trip ticket by the most direct connecting flight
available two weeke in advance of any period of
partial custody they intend to exercise, other than in
the immediate vicinity of the mother's home, or the
grandparente shall pereonally provide any
transportation neceesary for them to exerciee their
periode of partial custody I they shall aleo bear all
expenses for themselves and the child with regard to
transportation or their exercise of partial custody.
s. All partiee shall promptly advise the other parties of
any changee of addrese or phone numbers.

G. The father ehall vieit the child in the paternal
grandparente' home or at another location nearby, at the
option of the paternal grandparent. when the child i. with
the paternal grandparente upon 24 hour. notice to the
paternal grandpa rente and to the mother.
H. Any party ehall have reaeonable telephone contact with the
child when another party hae cuetody or partial cuetody of
the child, to this end, all parties ehall provide each other
phone numbers where the child can be reached.
I. The mother agreee reljularly to provide the maternal and paternal
ljrandparente photographs of the child and further agreee to keep
the paternal and maternal grandparents informed as to the child'e
progrese,
J. The father, the maternal and paternal grandparente may call the
mother at any time to obtain information regarding the child.
K. When the paternal grandpa rente or the father are in the
vicinity of the mother'e reeidence, upon at least 72 houre
advance notice to the mother, they may vieit with the child
ae such arrangemente can be agreed to by them and the mother
without the need to formally modify this agreement and
eubeequent Order of Court,
L.
Either the father'e or the paternal grandparent's
medical insurance coverage ehall be obtained for the
child'e medical insurance coverage if possible, until
such time as the mother is able to obtain euch
coverage through her employment, The father shall
sxscute any Affidavit of Paternity necessary to
accomplish this.

2. The tather ehall continue to name the child a. irrevocable
beneficiary of any life ineurance policy covering the
father'. life, ae long ae he hae a duty of eupport, and
.hall provide proof of same to the mother.

filed of record with the appropriate Court in Broward county,
Florida, Grand Blanc, Kichigan, where the paternal grandparente
reeide and in Bexar County, Texae where the father reeide. at the
expenee of the party filing the document of record. Proof of euch
filing ehall, however, be provided all other parties.

A.
The paternal grandparente Clarence and Tracy Thompson have
had temporary cuetody of the child since the entry of the
Order of Court on March 31, 1994, (attached hereto and made
a part hereof as thoughtfully eet forth herein), they since
have relocated from Clark.ville, Tennessee to Flint,
Michigan.
B. At the present time, the father has relocated to
Texas, and he remains unable to provide a home for the
child.
C. However, the mother who has relocated to Weston,
rlorida, is presently able and willing to resume
cuetody of the child.
D. It is agreed that effective December 5, 1996, the care
and full legal and physical cuetody of the child shall
be returned to the natural mother, who is free to
relocate with the child to her residence.
V. The mother, Alicia Anne Smith seeks to have full legal and physical
custody of the child returned to her and to modify the Order of Court dated
Karch 31, 1994 (attached hereto and made a part hereof ae though fully set
forth herein) as followsl

The paternal grandparents shall have periods of
partial cuetody of up to three weeks per yearl these
periods of partial cuetody need not be taken
consecutively.

May 31 each year the mother a schedule of the periode
of partial custody they intend to exerciee for the

partial custody two weeks in advance of each period.
4. The paternal 9randparente ehall provide a prepaid
round trip ticket by the most direct connectinlj fliljht
available two weeks in advance of any period of
partial cuetody they intend to exerciee other than in
the immediate vicinity of the mother's home or the
grandparente Bhall personally provide any
traneportation neceesary for them to exercise their
periods of partial custody I they ehall also bear Bll
expenses for themselves and the child with regard to
transportation or their exercise of partial custody.
5. All parties shall promptly advise the other pBrties of
any changee of address or phone numberB.
B. The father shall visit the child in the paternal
grandparents' home or at another location nearby, at the
option of the paternal grandparents when the child is with
the paternal grandparents upon 24 hours notice to the
paternal grandparente and to the mother.

child when another party has custody or partial custody of

accomplish this.

Plaintiff is Alicia Anne Smith, natural mother and an adult sui
juris, who resides at III B Forbes Avenue, CarliBle, Cumberland
county, Pennsylvania,
B. Plaintiff is Nathan Akil Thompson, natural father Nathan Akil
A.
Thompson, Air Department V-2, U,S.S. Nimitz, CVN68, SPO AP 96697-
2820. The father is in the United States Navy,
II. Defendants are Clarence and Tracy Thompson, the paternal grandparsnts and
adults sui juris, who reside at 300 Keleey Drive, Clarksvil1e, Montgomery
County, Tennessee, 37042.
III. Kother and father are the parents of Andrew Dominic Thompeon, born March
23, 1994 in Carlisle Hospital, Carlisle, Pennsylvania.
IV. The parties agree to the following custody terms regarding custody of
Andrew Dominic Thompson, and request the terms be entered as an Order of
Court I
A. The paternal grandparents Clarence and Tracy Thompson ehall have
temporary custody of the child, who shall be allowed to return with
the grandparents to their reeidence in Clarkevil1e, Tenneeeee.
B. Both parente, at the present time, are unable to provide a home for
the child,

c. The paternal grandparents shall have all rights to give medical and
other necessary consente on behalf of the child.
D. The father agreee to reimburse the mother for all legal and medical
and lying-in costs ehe has incurred ae a result of her pregnancy and
this agreement,
E. The father further agreee that hie military dependency allotment for
the child shall be sent directly to the paternal grandparents for
the eupport of the child.
r. 1. It is agreed that either the father's or the paternal
grandparent's Champus coverage ehall be obtained for the
child's medical insurance coverage. The father shall execute
any Affidavit of Paternity necessary to accomplish this.
2. The father agrees to name the child as irrevocable beneficiary
of any life insurance covering the father's life.
G. It is agreed that either parent may visit the child in the paternal
grandparents' home or at another location nearby, at the option of
the parent upon 24 hours notice to the paternal grandparents,
H. The paternal grandparents agree to provide the parents a current
photograph of the child at least once a month and further aljree to
keep the parents informed as to any medical or developmental
problems the child experiences.
I. The parents may call the paternal grandparents at any time to obtain
information regarding the child.
J. This Stipulation and Order shall also be filed of record with the
appropriate Court in Kontgomery county, Tennessee.
K. Further jurisdiction in this matter shall remain with this Court and
cuetody shall be determined according to Pennsylvania Law.

Dear Sir:
We are in receipt of the above ORDER signed by you advising us of a Petition for
Special Relief hearing that is scheduled for Thursday, December 16,1999 at 3:00 o'clock
PM.
Your Honor, it is not and never has been our intention to Petition your Court about
this action. We found it both shocking and unusual that we are listed as petitioners
against our adult daughter Alicia.
We are the step-grandfather and maternal grandmother to Andrew Dominic
Thompson, age 5. As grandparents we feel that his mother best decides the interests of
the child. She has always decided what is best for Andrew and we respect Bnd support
her. Andrew is her child and we have always trusted in her judgment. For the past three
years that she and Andrew have lived close to us here in South Florida, she has
demonstrated responsibility, maturity, and admirable maternal skills. We are very proud
of her. Additionally, it is our belief that she has fulfilled her obligations to the paternal
grandparents, Clarence and Tracy Thompson.
Alicia's father, Colonel Gregory E. Smith, has also supported and trusted in her
judgment. However, we cannot speak for the Thompsons. But we do trust Bnd pray that
they would also respect Alicia's role as mother and main provider for Andrew. We
would also hope that the Thompsons understand their role as grandparents and not as
"parents" with regard to this precious child.
Please understand that we will not be able to appear for this hearing on Thursday for
several reasons. We did not receive notice untillste on Monday, December \Jib, and this
short notice places a burden on us. Since retiring from active duty with the Army from
Carlisle Barracks over four years ago, I, John, have been chairing the Department of
Mathematics at Broward Community College. The college students are tsking final
exams this week. My presence on campus is necessary. Maureen is presently enrolled as
a student and is also taking some final examinations. In addition, we have an under aged
son who depends upon us for transportation to school and other extracurricular activities.
Your Honor we have been supporting Alicia and Andrew financially in order to make
up for Nathan's lack of financial support in such areas as child support, and medical and
life insurance. The amount of time, energies, and monies that this situation has generated
would be better served in continuing that support for Andrew. We as grandparents --
namely John and Maureen Bray as well as Colonel Smith -- feel that our financial
assistance should continue to help Alicia and Andrew since Andrew's father has not been
providing support with respect to the original court order.
Thank you for taking the time to review this matter, snd we trust that you will
understand our inability to appear in Carlisle on Thursday.

AND NOW, this 16th day of December, 1999, on a
petition of Clarence Thompson and Tracy Thompson, the paternal
grandparents of Andrew D, Thompson, born March 23, 1994, and
following a hearing, and pursuant to the current custody order
entered by this Court on January 23, 1997, which order provides
in paragraph 2(c) for periods of temporary physical custody in
the paternal grandparents over the Christmas holidays in odd
numbered years, it is ordered that the paternal grandparents
shall have temporary physical custody of Andrew from December
20, 1999, until December 30, 1999, on the following schedule:
1. The paternal grandmother will be arriving in Fort
Lauderdale, Florida, on December 20 on Northwest Airline at
3:10 p.m, She will be staying at the Sheraton Plantation
Suites in Plantation, Florida. The mother, Alicia Anne Smith,
shall bring Andrew to the grandmother at the Sheraton
Plantation Suites at 7:00 p,m. that evening, December 20, The
paternal grandmother shall take Andrew to her home in Grand
Blank, Michigan, on December 21, via Northwest Airlines flight
243 out of Fort Lauderdale, Florida, or such other flight as
she may choose that day.
2. The paternal grandmother shall return Andrew to
Fort Lauderdale on December 30, 1999, via Northwest Airlines
flight 236 arriving at 1:34 p.m, or on such other flight that
