Count 1 - Divorce
1. Plaintiff is MERRI LOU SCHAUMANN, who resides at 249 W. Pomfret St.
Cumberland County, Carlisle, PA 17013, since June 1993.
2. Defendant is DAVID B. SCHAUMANN, who resides at 3221 Brookside
Avenue, York County, Dover, PA 17315, since 1979.
3. Plaintiff has been a bona fide resident in the Commonwealth for at least six
months immediately previous to the filing of this Complaint.
4. The Plaintiff and Defendant were married December 7, 1967.
5. There has been no other action of divorce between the parties.
6. The marriage is irretrievably broken.
7. Plaintiff has been advised that counseling is available and that she msy
have the right to request that the Court require the parties to participate in counseling.
8. Plaintiff requests the Court to enter a decree of divorce.

Plaintirrs costs and expenses and counsel fees in this matter.

16. During the course of her twenty-seven year marriage, the Plaintiff has been
financially dependent upon the Defendant.
17. The Plaintiff has some self-employment income as a genealogist but does
not earn enough to support herself.
18. The Plaintiff is in need of alimony pendente lite to maintain herself during
the course of this action and to pennanent alimony thereafter if she is to maintain her
present lifestyle.

19. The Defendant is financially able to support his wife.
WHEREFORE, the Plaintiff requests this Court to:
a. Enter a final Decree of Divorce divorcing the Plaintiff from the
Defendant;
b. Grant equitable distribution of the marital property of the parties;
c. Award Plaintiff reasonable counsel fees. expenses and costs of suit in
this matter;
d. Award Plaintiff reasonable alimony and alimony pendente lite; and
e. Grant such further relief as it shall deem proper and just.

to the agreement and stipulation of the parties, the
following Order is entered in this matter.
1.
The term "Participant" means Defendant, David B.
Schaumann, whose address is 3221 Brookside Avenue, Dover,
Pennsylvania 17315, and who is a participant under the
Blakey, Yost, Bupp and Schaumann Retirement Plan. His
Social Security Number is 208-38-1858.
2.
The term "Alternate Payee" means Plaintiff, Herri Lou
Schaumann, whose address is 249 West Pomfret Street,
Carlisle, Pennsylvania 17013. Her Social Security Number is
298-38-4739.

The Plaintiff and Defendant's date of marriage is
December 7, 1967, and a divorce action is presently pending
in this Court in the above referenced number.

The term "Plan" means the Blakey, Yost, Bupp and
Schaumann Retirement Plan.
5.
That portion of the aforementioned Plan that is
allocated to Plaintiff is marital property of Plaintiff and
Defendant.
The Alternate Payee shall be entitled to receive from
the Plan one-half (1/2) of the value of same, including all
earnings, as of December 31, 1994. The Alternate Payee shall
not be entitled to any contributions credited but not
actually received as of December 31, 1994. The remaining
interest in the Plan, including any contributions credited
but not actually received until after December 31, 1994,
shall be confirmed absolutely with the Participant.
6.
As soon as practicable, the Plan Administrator will
sever the parties' respective interests in the Plan into two
separate accounts being one for each party.
7.
The Court reserves jurisdiction to make such further
orders relating to these benefits that are necessary to
carry out this Qualified Domestic Relations Order.

interest in the plans, over which the Participant shall have
no control,
b. To withdraw her interest in the Plan at the
earliest time the participant would be eligible to withdraw

c. To direct the Plan Administrator of each Plan
to transfer or rollover her interest in said Plan to an
individual retirement account for her benefit,
d. To designate the beneficiary of her interest
in said plan in the event of her death without regard to any
beneficiary designation made by the Participant with respect
to Participant's interest in said plan.

This QDRO is drawn pursuant to the laws of the

10.
Nothing in this QDRO shall be construed to require any
Plan or Plan Administrator:
a. To provide to the Alternate Payee any type or
form of benefit or any option not otherwise available to the

b. To provide to the Alternate Payee increased
benefits not avftilable to the Participant, or,
c. To pay any benefits to Alternate Payee which
are required to be paid to another Alternate Payee under
another Order determined by the Plan Administrator to be a
QDRO before this document is determined by Plan
Administrator to be a QDRO.
Copies of this QDRO shall be served by the attorney for
Participant on Plan Administrator, who shall:
a. Promptly notify the Participant and the
Alternate Payee of:
i. The receipt of a copy of this QDRO by
Plan Administrator; and
ii. The Plan's procedure for determining
qualified status of this QDRO.
b. Within a reasonable period of time after a
receipt of a copy of this Order, determine whether this
document is a QDRO, and notify the Participant, the
Alternate Payee, and their respective counsel of such
determination; and
c. Upon the determination of this document as a
QDRO, segregate in a separate account in the Plan or in an
escrow account, the amounts which are payable to the

Alternate Payee during the periods that this documents has
been determined to be a QDRO.
d. If necessary, allow this QDRO to be amended
so that it complies with the intent of the parties pursuant
to the property settlement agreement and divorce decree and
the requirements of the Plan Administrator.
12.
The provisions contained herein are to be a QDRO made
pursuant to the Internal Revenue Code of 1986, as amended,
and its provisions shall be administered and interpreted in
conformity with that Act.
13.
The Court retains jurisdiction over this QDRO to amend
it, in order to establish or maintain its qualification as a
QDRO.
