II information, We are going to place an agreement on the record in the presence of the parties, The agreement as stated on the record will be considered the substantive agreement of the parties and will not be subject to any changes or modifications except correction of typographical errors which may be made in the transcription, The agreement, after it has been transcribed, will be sent to counsel to review for typographical errors which may have been made in the transcription, but counsel and the parties will not be permitted to make any changes in the substantive content of the agreement, After the agreement has been reviewed for correction of typographical errors, the parties and counsel will sign the agreement and return a fully signed copy to the Master, The Master will then prepare an order vacating his appointment and counsel can file a praecipe transmitting the record to the Court requesting that the Court enter a final decree, The agreement will remain as part of the record in the file, which is ultimately retained by the Prothonotary, The signing of the agreement is an affirmation of the agreement that is entered on the record today and will be the parties' affirmation of what we have agreed to as counsel state the agreement at this time, Ms, Male, MS, MALE: 1, The real estate located at 2243 Canterbury Drive, Mechanicsburg, Pennsylvania, is awarded to wife subject f ... .,'''' , ., ~ J......... ,. .. " to the Hellon Bank first mortgage and the Union National Hount Joy Bank second mortgage, Husband agrees to execute a deed transferring all his right, title, and interest in the property to wife today following the Haster's proceeding, Counsel for wife will hold the deed and record it after the parties have filed their affidavits of consent and have signed the stipulation affirming the settlement that will be placed on the record today, Wife will indemnify and hold husband harmless from any attempts by Hellon Bank or Union National Mount Joy Bank to collect and/or satisfy the mortgage balances currently due and owing and lodged against the real estate, 2, Wife is awarded the following items of personal property: a) All of the household furnishings currently located at the marital residence with the exception of husband's tools stored in the garage, which are awarded to husband, b) The cash surrender value of the Massachusetts Mutual whole life insurance policy which has a cash surrender value of $924,00, Wife will continue to make the premiums on the policy which is insuring the life of husband, Wife is the owner of the policy and we will provide confirmation of that to husband's counsel within ten (10) days of today's date, c) The First Federal account, PNC IRA, PNC checking account, PNC savings account, the 1987 Ford-Crown Victoria station wagon, wife's PSERS pension and retirement benefit, and wife's Massachusetts annuity, Additionally, wife will receive husband's True Temper 401(k) plan and husband will execute any and all documents necessary to effect the transfer of that, We have stipulated the value of the True Temper account as $9,837,00, Whatever is in that account as of today's date, if there is something different than that figure, goes to wife, with the understanding that if that amount as of today's date is rolled over into the Black and Decker plan, which husband is . , I I F I: (, I' i I, I, I' I, , ~ . . to receive, that the value of the account as of today's date goes to wife, Husband will execute whatever documents are necessary to effect the transfer of the funds to wife and any tax liability or early withdrawal penalities that wife would incur, if she decides to cash in the account, will be wife's responsibility. If a QDRO is necessary to transfer the account, then we will do so based on whatever directions we receive from True Temper or the plan administrator, 3, Husband is awarded the Black and Decker 401(k) account which we valued for today's purposes at $13,815,00 as the marital portion, He is entitled to whatever total funds are in that account as of today's date and beyond, 4. Wife agrees to allow husband to take the mortgage interest deduction on the primary residence mortgage for 1995, The mortgage interest deduction husband is entitled to take also includes the real estate taxes and only for 1995, 5, During the marriage husband acquired an interest in improved real estate situate at South Cherry Alley, Lancaster, Pennsylvania, and a corporation known as HMR Industrial, Inc, Husband will indemnify and hold wife harmless from any and all claims and creditors involving HMR or the real estate and in particular, any and all tax liabilities, If there are any assets relating to HMR or the South Cherry Alley real estate, these assets are awarded solely and exclusively to husband without claim or offset by wife, Husband agrees to indemnify and hold wife harmless from any errors, omissions, claims, deficiencies, tax liabilities, penalities, and interest arising out of the preparation of their joint tax returns during the marriage or as it relates to any income reported or otherwise as a result of his involvement in the corporation, 6, Husband has requested that wife provide him with 70pies of all joint tax returns currently in her possess~on, which wife has agreed to do, He has also requested the ~ ~ I return of any and all personal papers currently located at the residence which wife will provide to husband, All of those documents will be given to husband within thirty (30) days of today's date, The parties have acknowledged that wife has in her possession canceled checks relating to a joint checking account which the parties utilized during the marriage prior to separation, Wife agrees to make available to husband at his request, in the event of an audit by the IRS or any other taxing agency, the originals of any of those canceled checks or other papers or documents that would ussist him in an audit or other investigation by said agency, If wife fails to provide the documents, which he may be questioned about by the IRS and which she has indicated she has in her possession for the past five years, then the indemnification agreement which husband has given to wife with respect to taxes, shall be deemed waived for that particular tax year, 7. Husband shall pay to wife as alimony for her support and maintenance the sum of $728,00 per month for the period of 60 months commencing December 1, 1995, with the first payment to begin that date, If the divorce decree has not been entered prior to that date then the payments will be designated as alimony pendente lite and shall be credited against the 60 month alimony term, The payments shall be income to wife and deductible to husband for federal income tax purposes, The payments are nonmodifiable and shall terminate only upon wife's death but shall continue on her remarriage or cohabitation, 8, In consideration of the alimony payments and other distribution as set forth earlier, wife is withdrawing her claim for counsel fees and expenses to be paid by husband, 9, With the exception of the alimony pendente lite payments to be made prior to the entry of the divorce decree, which will start December 1, 1995, wife also withdraws any other claims for alimony pendente lite raised of record in this proceeding, 10, Wife previously had filed a claim for spousal and for child support in the Court's Domestic Relations section, Wife withdraws with prejudice any claims for spousal support, and effective December 1, 1995, husband will pay , ~ I to wite the amount of $848,00 per month child support, 11. As part ot their settlement the parties have acknowledged they both recognize the importance of postsecondary education for their son, Philip, They agree at the time Philip would be attending a postsecondary educational program to contribute to the educational costs pursuant to their abilities to contribute at the time the postsecondary education is commenced, The contribution would be for room, board, tuition, books, and student fees, 12. Except as herein otherwise provided, each party may dispose of his or her property in any way and each party hereby waives and relinquishes any and all rights he or she may now have or hereafter acquire under the present or future laws of any jurisdiction to share in the property or the estate of the other as a result of the marital relationship including without limitation, statutory allowance, widow's allowance, right of intestacy, right to take against the will of the other, and right to act as administrator or executor in the other's estate. Each will at the request of the other execute, acknowledge, and deliver any and all instruments which may be necessary or advisable to carry into effect this mutual waiver and relinquishment of all such interests, rights, and claims, MS, MALE: Ms, Mistretta, were you here during the presentation of the stipulated settlement? Husband is awarded the Black and Decker 401(k) account which we valued for today's purposes at $13,815,00 as the marital portion, He is entitled to whatever total funds are in that account as of today's date and beyond, 4, Wife agrees to allow husband to take the mortgage interest deduction on the primary residence mortgage for 1995, The mortgage interest deduction husband is entitled to take also includes the real estate taxes and only for 1995, 5, During the marriage husband acquired an interest in improved real estate situate at south Cherry Alley, Lancaster, Pennsylvania, and a corporation known as HMR Industrial, Inc, Husband will indemnify and hold wife harmless from any and all claims and creditors involving HMR or the real estate and in particular, any and all tax liabilities, If there are any assets relating to HMR or the south Cherry Alley real estate, these assets are awarded solely and exclusively to husband without claim or offset by wife, Husband agrees to indemnify and hold wife harmless from any errors, omissions, claims, deficiencies, tax liabilities, penalities, and interest arising out of the preparation of their joint tax returns during the marriage or as it relates to any income reported or otherwise as a result of his involvement in the corporation, 6, Husband has requested that wife provide him with copies of all joint tax returns currently in her possession, which wife has agreed to do, He has also requested the return of any and all personal papers currently located at the residence which wife will provide to husband. All of those documents will be given to husband within thirty (30) days of today's date, The parties have acknowledged that wife has in her possession canceled checks relating to a joint checking account which the parties utilized during the marriage prior to separation, Wife agrees to make available to husband at his request, in the event of an audit by the IRS or any other taxing agency, the originals of any of those canceled checks or other papers or documents that would assist him in an audit or other investigation by said agency, If wife fails to provide the documents, which he may be questioned about by the IRS and which she has indicated she has in her possession for the past five years, then the indemnification agreement which husband has given to wife with respect to taxes, shall be deemed waived for that particular tax year, 7, Husband shall pay to wife as alimony for her support and maintenance the sum of $728,00 per month for the period of 60 months commencing December 1, 1995, with the first payment to begin that date, If the divorce decree has not been entered prior to that date then the payments will be designated as alimony pendente lite and shall be credited against the 60 month alimony term, The payments shall be income to wife and deductible to husband for federal income tax purposes, The payments are nonmodifiable and shall terminate only upon wife's death but shall continue on her remarriage or cohabitation, 8, In consideration of the alimony payments and other distribution as set forth earlier, wife is withdrawing her claim for counsel fees and expenses to be paid by husband, 9, With the exception of the alimony pendente lite payments to be made prior to the entry of the divorce decree, which will start December 1, 1995, wife also withdraws any other claims for alimony pendente lite raised of record in this proceeding, 10. Wife previously had filed a claim for spousal and for child support in the Court's Domestic Relations section, Wife withdraws with prejudice any claims for spousal support, and effective December 1, 1995, husband will pay to wife the amount of $848,00 per month child support. 11, As part of their settlement the parties have acknowledged they both recognize the importance of postsecondary education for their son, Philip, They agree at the time Philip would be attending a postsecondary educational program to contribute to the ~ducational costs pursuant to their abilities to contribute at the time the postsecondary education is commenced, The contribution would be for room, board, tuition, books, and student fees, 12, Except as herein otherwise provided, each party may dispose of his or her property in any way and each party hereby waives and relinquishes any and all rights he or she may now have or hereafter acquire under the present or future laws of any jurisdiction to share in the property or the estate of the other as a result of the marital relationship including without limitation, statutory allowance, widow's allowance, right of intestacy, right to take against the will of the other, and right to act as administrator or executor in the other's estate, Each will at the request of the other execute, acknowledge, and deliver any and all instruments which may be necessary or advisable to carry into effect this mutual waiver and relinquishment of all such interests, rights, and claims, MS, MALE: Ms, Mistretta, were you here during the presentation of the stipulated settlement? Father shall have partial physical custody of Philip on the third weekend of every month from Friday at 5:00 p.m. through Sunday mornings at 8:00 a.m. In the event that Philip does not have school on Monday, at Father's option, Father may return Philip at either some point in time on Sunday or at 8:00 a.m. on Monday morning. In the event that Father would be unavailable to have custody during the third weekend of the month, he shall advise Mother, at least three days in advance wherever possible, of that fact and would be entitled to have a make-up weekend either the second or fourth weekend of the month. Likewise, it is anticipated that there may be times when the third weekend of the month may not be convenient for Philip or for Mother and, upon mutual agreement, during those circumstances, at the request of Mother or Philip, Father would be entitled to a make-up weekend. C, Thanksgiving: The Thanksgiving holiday shall be defined as running from Wednesday after school through Sunday evening after Thanksgiving. This holiday shall be alternated with Mother having Thanksgiving in odd- numbered years, and Father having the holiday in even-numbered years. D. Christmas: Christmas vacation shall be divided equally between Mother and Father. In even-numbered years, Mother shall have the first half of the holiday (the segment including Christmas Eve and Christmas Day) and Father shall have the second half of the holiday (the segment Including New Year's Eve and New Year's Day). Airline Travel: Given the distance Involved between the parties, there may be occasions when Philip shall fly to Rochester for visits.
