COMPLAINT IN CIVIL ACTION - REPLEVIN
COUNT I - REPLEVIN
AND NOW, comes the Plaintiff Green Tree Consumer Discount
Company by and through its attorney, Dennis H. Blackwell, Esquire
and avers as follows:
1. Plaintiff Green Tree Consumer Discount Company
(hereinafter referred to as "Green Tree") is a corporation
authorized to conduct business in the Commonwealth of Pennsylvania
and which does business and maintains offices at 300 Weyman Plaza,
Pittsburgh, Allegheny County, Pennsylvania 15236.
2. Defendant is Marlin George Vanasdalan, hereinafter
known as ("Vanasdalan"), adult whose last known address was
Shippensburg Mobile Estates Lot #4, Shippensburg, PA 17257.
3. On or about November 13, 1991, Defendant Vanasdalan
purchased from Royal Finance, Inc. a 1981 Zimmer Mobile Home, VIN
ZZP18891 pursuant to the terms and conditions as set forth in a
certain Manufactured Retail Installment Contract and Security

Agreement (hereinafter referred to as "Contract") a copy of which
is attached hereto, made a part hereof and designated Exhibit "A".
4. The 1981 Mobile Home purchased was placed at Shippensburg
Mobile Estates, Lot # 4, Shippensburg, PA 17257, and is currently
located at Shippensburg Mobile Estates, Lot # 4, Shippensburg, PA
17257.
5. Pursuant to said "Contract", Exhibit "A", Vanasdalan
assumed the unpaid balance of the obligation which included an
annual interest rate of 14.25\ per annum in 180 consecutive monthly
installments of $187.21 commencing on December 15, 1991.
6. Pursuant to said "Contract", Exhibit "A", Seller, Royal
Financial, Inc. retained a security interest in said Mobile Home.
7. The "Contract", Exhibit "A" was assigned by the
Seller, Royal Financial, Inc. to Green Tree. Said Assignment is
noted on the "Contract", Exhibit "A" attached hereto, made a part
hereof.
8. Green Tree further secured its lien on the mobile home by
noting same on the Certificate of Title. A copy of said
Certificate of Title is attached hereto, made a part hereof and
designated Exhibit "B".
9. Vanasdalan is currently in default of the provisions of
the "Contract'" Exhibit "A", having inter alia failed to make the
agreed upon monthly payments of $208.41 which currently includes
insurance placed and being paid for by the Plaintiff, and being
currently past due for payments for February and March, 1994.
10. Despite repeated requests by Green Tree, Vanasdalan has
failed and refused to make any payments except for $208.41 on
February 28, 1994, and further, continues to maintain wrongful
possession of the 1981 Mobile Home.
11. The total balance required to bring the "Contract",
Exhibit "A", current as of March 24, 1994, is the sum of $416.82
and the total balance due and owing as of said date pursuant to
said "Contract" is currently the sum of $13,745.50.
12. Pursuant to the terms and provisions of the "Contract",
Exhibit "A", Plaintiff is entitled to immediate possession of said
1981 Zimmer Mobile Home.
13. On or about February 19, 1994, pursuant to the mandates
of the Pennsylvania Motor Vehicle Sales Finance Act of 1947, 69
P.S. ~ 601 et. seq., Green Tree delivered to Vanasdalan a Notice of
Intention to Accelerate, Commence Legal Action or Repossess, said
Notice being sent to Defendant in advance of 30 days commencing
this action. Copies of said Notice is attached hereto, made a part
hereof, and designated Exhibit "C",
14. Green Tree is entitled to detention damages, special
damages, consisting of inter alia, detaching and transporting the
mobile home, shipping fees, and any cost for insurance placed on
the mobile home by Green Tree, late charges per the "Contract",
further costs for repossession and sale and attorney's fees and
costs of litigation necessary to obtain possession of the 1981
Zimmer Mobile Home.

WHEREFORE, Plaintiff, Green Tree Consumer Discount Company
requests judgment against Defendant to recover the 1981 Zimmer
Mobile Home, Shippensburg Mobile Estates, Lot # 4, Shippensburg, PA
17257, plus detention damages, and special damages consisting of

inter alia, detaching and transporting the mobile home, shipping
fees, and cost for insurance placed on the mobile home by Green
Tree, late charges per the "Contract", any further costs for
repossession and sale, attorney's fees and costs of litigation in
order to obtain possession of the 1981 Zimmer Mobile Home.
COUNT II - DAMAGES
15 . Paragraphs 1 through 14 above are hereby incorporated as
if fully set forth herein.
16. This Count is brought in the alternative to the relief
sought in Count I.
WHEREFORE, Green Tree Acceptance, requests judgment
against Defendant in the amount of $13.745.50 with interest and
late charges and special damages consisting of inter alia,
detaching and transporting the mobile home, shipping fees and any
costs for insurance placed on the mobile home by Green Tree, late
charges per the "Contract", and further costs of litigation in
order to obtain possession of the 1981 Zimmer Mobile Home.
