BAREFOOT CUSTOM HOMES, Contractor : IN THE COURT OF COMMON PLEAS : CUMBERLAND COUNTY, PENNSYLVANIA : : NO. ; WHEREAS, CRAIG A. LISBINSKI and ELIZABETH A. LISBINSKI of 717 Colonial Court, Mechanicsburg, Pennsylvania, is about to execute contemporaneously herewith, a contract, with KEITH A. BAREFOOT CUSTOM HOMES of P.O. Box 246, Camp Hill, Pennsylvania, for the erection of a building upon premises commonly known as 1831 SIGNAL HILL DRIVE, Township HAMPDEN, CUMBERLAND County, Pennsylvania, as set forth in the deed dated April 12, 2002, recorded at Deed Book 251, Page 1273, in the Reoorder's Office for CUMBERLAND County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW, June 24, 2002, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. LISBINSKI Schedule "A" ALL THAT CERTAIN tract or parcel of land being situate in Hampden Township, Cumberland County, Pennsylvania, more particularly bounded and described as follows, to wit: BEGINNING at a point on the western fight-of-way line of Signal Hill Drive, a 50 foot wide street, said point also being the southeastern corner of Lot No. 34; thence along said right-of-way line along a curve to the right having a radius of 275.00 and an arc length of 94.50 feet, said arc being subtended by a chord of South 27 degrees 35 minutes 23 seconds West a distance of 94.03 feet to a point; thence continuing along said right-of-way line along a curve to the right having a radius of 200.00 and an arc length of 180.82 feet, said arc being subtended by a chord of South 63 degrees 20 minutes 03 seconds West a distance of 174.72 feet to a point, said point also being the southeastern corner of Lot No. 36; thence along the eastern line of said lot North 00 degrees 40 minutes 31 seconds West a distance of 226.53 feet to a point, said point also being the southeastern corner of Lot No. 33; thence along the southern line of Lot No. 34 South 72 degrees 15 minutes 16 seconds East a distance of 212.47 feet to a point, the place of BEGINNING. BEING Lot 35 on the Plan of Signal Hill Residential Development, Final Subdivision Plan for Phase III, prepared by Melham Associates, PC and recorded in Plan Book 74, Page 48.
