1, The Commonwealth proved that petitioner was convicted on November 21,
1993 of violating the Crimes Code at 18 Pa.C.S. Section 6308. That conviction
required that the Department suspend petitioner's driver privilege for a period of two
years. A supersedes was in effect since April 6, 1994. A hearing on the merits of the
appeal was continued by an order of court on May 11, 1994, by agreement of the
parties, whereby either party would request a hearing if one became necessary.

LICENSE SUSPENSION APPEAL
AND NOW, comes Petitioner, Elisabeth D. Gibbons, by and through her
attorneys, Mancke, Wagner, Hershey & Tully, who respectfully aver the following:
1. Your Petitioner, Elisabeth D. Gibbons, is an adult individual with a
residence address of 6376 Stephens Crossing, Mechanlcsburg, Cumberland County,
Pennsylvania 17066.
2. Respondent, Pennsylvania Department of Transportation, Bureau of
Driver Licensing, has a mailing address of Transportation & Safety Building,
Harrisburg, Dauphin County, Pennsylvania 17120.
3. Petitioner was charged with Underage Drinking on December 6, 1993
for an incident allegedly occurring on November 21, 1993.
4. Petitioner was convicted of Summary Underage Drinking on February
17, 1994.
6. A De Novo Appeal was timely made to the Union County Court of
Common Pleas, and no trial date has yet been set. A copy of said appeal is
attached hereto as Exhibit "A".
6. Your Petitioner received a notice of license suspension with a mail
date of March 3, 1994, alleging that her privileges are to be suspended for a
period of one year, as a result of refusing the chemical testing. See Exhibit "B"
attached hereto and incorporated herein by reference.

7. Said proposed suspension, with an effective date of April 7, 1994, is
improper, illegal and invalid because of the De Novo Appeai.
WHEREFORE, Petitioner prays Your Honorable Court to issue a supersedeas
on the suspension, 88 proposed in Exhibit "8", until such time 88 there is a final
order following a hearing in the Cumberland County Court of Common Pleas.
