WHEREAS, Glenn D. Livelsberger, Inc. t/d/b/a Heritage B~llders are about
to execute contemporaneously herewith, a contract with Gary D. Weller
and Susan Ann Weller, of 131 Briarwood Court, Camp Hill, Pennsylvania,
for the erection of a dwelltug home upon a lot of land situate described as
follows:
ALL TH. AT CERTAIN tract or parcel of ground situate in the Borough of
Lemoyne, Cumberland County, Pennsylvania,. known and numbered as Lot
No. 22 on a Plan of Lots known as "White Oaks" as prepared by Robert C.
Hartman, Jr., Registered Surveyor, and recorded in the Office of the
Recorder of Deeds in and for C,~r~berland County in Plan BOok 58, Page 26,
which lot is more particularly bounded and described as follows, to wit:
BEGINNING at a point on the right-of-way line of West Wind Drive, said
point being on the dividing line of Lot No. 22 and Lot No. 23 on tl~e
hereinbefore mentioned Plan of Lots;
thence along the right-of-way line of West Wind Drive, North 42 degrees 32
r~tuutes S0 seconds West, a distance of 173.88 feet to a point;
thence along a curve to the right an arc radius of 25.00 feet, an arc
distance of 59.27 feet to a point;
thence continuing along the right-of-way line of West Wind Drive, North 47
degrees 27 mtuutes S0 seconds East, a distance of 86.17 feet to a point;
thence continuing along said line along a curve to the lei'c, an arc radius of
425.00 feet,-~u arc distance of 76.70 feet to a point on the dividing line of
Lot No. 21 and Lot No. 22 on the hereinbefore mentioned Plan of Lots;
thence South 52 degrees 52 r~uutes 55 seconds East, a distance of 209.18
feet to a point on the dlvl~lug line of Lot No. 24, and Lot No. 22 on the
hereinbefore mentioned Plan of Lots;
thence South 47 degrees 27 mtuutes 30 seconds West, a distance of 225.00
feet along the divl~tug line of Lot No. 24 and Lot No. 23 to a point on the
right-of-way line of West Wind Drive, the Place of BEGINNING.
CONTAINING 0.9455 acre.
SIJI3JECT to restrictions of record as found on the Plan of Lots of White
Oaks and further subject to a Declaration of Protective Covenants and
Restrictions for White Oaks, as found in the Recorder of Deeds 02flce of
Cumberland County, indexed at Misc. Book 364, Page 396, amended in
Misc. Book 366, Page 860.
BEING THE SA1VIE PREMISES which George H. Wonders and Doris A.
Wonders, by deed dated August 30, 1994, and recorded in Cumberland
County l~ecord Book lll, Page 573, granted and conveyed unto Gary D.
Weller and Susan Ann WeBer, his wife.
NOW, ~~ , 2002, at the time of and immediately
before ~{e execution of the principal contract, and before any authority has
been given by the said Owner $o the said Contractor to commence work on
the said b~llding, or purchase materials for the same in consideration of
the making of the said contract with Owner, and the further consideration
of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that no Hen
shall be filed against the bufl_d~ug by the contractor, or any subc0nt~actor,
nor by any of the material men or workmen 'or any other person for any
labor, or materials purchased, or extra labor or ~naterials purchased for the
erection of saidbui]~ug, the right to file such Hens being expressly waived.
