AND NOW comes the Plaintiff by and through its attorney
Arthur A. Kusic, Esquire and respectfully represents the following:
1. Plaintiff, Chrylser Credit Corporation is a
corporation having offices throughout the United states and having
an office within this area at P.O. Box 2019, Mechanicsburg,
Cumberland County, Pennsylvania.
2. Defendant, HARRY RINEHART, is an adult individual
residing at 3 Timber Lane, Mount Holly Spring, Cumberland County,
Pennsylvania.
3. Defendant, JOANN RINEHART, is an adult individual
residing at 3 Timber Lane, Mount Holly Springs, Cumberland County,
Pennsylvania.
4. On or about April 24, 1991, Defendants entered into
a Retail Installment Sale Contract (hereinafter "Contract") with
. Cumberland Valley Motors located at 6720 Carlisle Pike,
Mechanicsburg, Cumberland County, Pennsylvania, for the purchase
of a 1991 Dodge Caravan bearing Manufacturer's Serial No.
2B4GK4534MR238851 (hereinafter "vehicle") for a net purchase price
and finance charges in the amount of Twenty Two Thousand Five
Hundred and Twenty-Four and 00/100 ($22,524.00) Dollars. A copy
of the Contract is marked as Exhibit "A", is attached hereto and
its contents are incorporated herein by reference.
4. Pursuant to the express terms of the Contract, Defendants
agreed to pay the monthly amount due under the Contract, to wit:
Three Hundred and Seventy-Five and 40/100 ($375.40) Dollars in
sixty (60) monthly installments, commencing June 8, 1991, payable
on the same day of each successive month thereafter until the total
purchase amount of $22,524.00 became paid in full in 1996.
5. Defendants have defaulted in their legal obligation
to Chrylser Credit Corporation pursuant to the Contract, by failing
to make the agreed upon payments.
6. Pursuant to the provisions of the Contract, Chrysler
Credit corporation recovered the vehicle on or before December 3,
1991, and gave Defendants notice of the right to cure in accordance
with law. Copies of said notices sent to the Defendants I
residences via certified mail are attached hereto, made a part
hereof and marked Exhibit "B".
7. Because Defendants failed to avail themselves of
their right to cure, Plaintiff sold the vehicle at a private
auction.
8. After applying the net proceeds from the sale to
Defendants' account there remained a deficiency balance in the
amount of Four Thousand Five Hundred and Fifty-Eight and 06/100
($4,558.06) Dollars. As evidence whereof, a copy of the statement
evidencing the deficiency balance is attached hereto, made a part
hereof and marked Exhibit "C".
9. Any and all monies received have been credited to the
Defendant's account.
10. plaintiff has made demands upon Defendants for the
balance due, which demands remain unheeded.
11. Pursuant to the terms of the contract, Defendants
agreed to pay reasonable attorney fees of 20\ and court costs in
the event that Plaintiff forwarded the matter an attorney for
collection.
WHEREFORE, Plaintiff prays your Honorable Court to enter
Judqment in its favor and against Defendant in the amount of
$3,273.03 along with interest at the rate of 12.50\ per annum,
reasonable attorney's fees of 20\ and the costs of this proceeding.
