COMPLAINT
NOW COMES the Plaintiff, by and through his attorney, David P. Perkins, Esquire,
and brings this Action to Quiet Title, pursuant to Pennsylvania Rules of Civil
Procedures Nos. 1061 through 1067 inclusive, upon a cause of action where the
following ia a statement:
1. Plaintiffs are Robert J. Jones and Atha G. Jones, husband and wife, currently
residing at 197 Gilbert Drive, Shippensburg, Cumberland County, Pennsylvania, 17257.
2. Defendants are Annie E. Chestnut, Asewith E. Chestnut, James M. Cheatnut, and
George J. Chestnut, their heirs, executors, administrators, and assigns.
3. There is no estate record for Annie E. Chestnut in Cumberland County,
Pennsylvania, and her heirs are unknown.
4. There is no estate record for Asewith S. Chestnut and his or her heirs are
5. There is no estate record for James M. Chestnut, and his heirs are unknown.
6. There is no estate record for George J. Chestnut, and his heirs are unknown.
7. Plaintiffs are the owners of the hereinafter-described real estate containing
one acre, more or less, situate in Southampton Township, Cumberland County,
Pennsylvania.
8. Plaintiffs acquired s fee simple interest, as Tenants by the Entirety, in the
hereinafter-described real estate, by virtue of a deed from Grace M. Gilbert,

Robert J. Jones, and Atha Jones, dated September 18, 1987, and recorded in Cumberland
County Deed Book "E", Volume 33, at Page 985:
TRACT NO.6:
Approximately one (1) acre. Chestnut, George Estate - Owner or reputed owner os
returned to said Bureau. Being the same real estate which the Tax Claim Bureau
of Cumberland County, Pennsylvania, au Trustee, by deed dated February 26, 1965,
and recorded in Cumberland County Deed Book M, Volume 21, Page 809, conveyed to
William H. Gilbert and Groce M. Gilbert.
BEING PART OF THE SAME which Grace M. Gilbert, Robert J. Jones and Atha Jones by
their deed dated September 18, 1987, and recorded in Cumberland County Deed Book
"E", Volume 33, at Page 985, conveyed to Robert J. Jones and Aths G. Jones.
9. Pursuant to a survcy prepared by Stephen P. Wolfe, Registered Surveyor, dated
December 12, 1991, s copy of which is attached hereto, marked "Exhibit A", and
incorporated herein by referencc, said real estate is more fully described as
follows:
BEGINNING at a railroad spike in Legislative Route 21006, known ss Whitmer Road.
at the corner of other lands of Robert J. Jones and Atha G. Jones, designated as
Tract No. 5 on the hereinafter-described survey; thence along said other lands
of Jones, South seven (07) degrees twenty-seven (27) minutes twenty-one (21)
seconds East, three hundred sixty-five and seventy-hundredths (365.70) feet to a
set iron pin at the corner of lends of Peul H. Karper; thence along said lande
of Karper, North eighty-nine (89) degrees seventeen (17) minutes thirty-five
(35) seconds West, one hundred eighty-eight and zcro-hundredths (188.00) feet to
a set iron pin; thence along said lands of Karper, North one (01) degree
forty-eight (48) minutes twenty-four (24) seconds East, three hundred twenty-one
and twenty-five hundredths (321. 25) feet, to an existing railroad spike in
Legislative Route 21006; thence in said roadwa)', North seventy-three (73)
degrees sixteen (16) minutes nine (09) seconds East, one hundred thirty-six and
seventeen-hundredths (136.17) feet to 0 railroad spike at the corner of other
lands of Robert J. Jones and Atha G. Jones, the place of BEGINNING. CONTAINING
1.257 acres, pursuant to a survey for Robert J. and Atha Jones, dated
December 12, 1991, prepared by Steven P. Wolfe, Registered Surveyor, and being
designated as Tract No.6 in a deed dated September 18, 1987, between Grace M.
Gilbert, Robert J. Jones, and Atha Jones, Grantors. and Robert J. Jones and
Atha G. Jones, said deed being recorded in Cumberland County Deed Book "E",
Volume 33, at Page 985.
10. Attached hereto. marked "Exhibit B", and incorporated herein by reference is an
Abstract of Title showing the chain of title under which the Plaintiffs, Robert J.
Jones and Atha G. Jones became the fee simple owners of the above-described premises.

11. There is no evidence of record in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania, of a conveyance of the premises by Annie E, Chestnut
and/or Asewith S. Chestnut and/or James M. Cheatnut.
12. P1aintiffa are preaent1y in constructive possession in thst they have asserted
ownership rights over the subject real eatate, have mown and maintained the land, and
hsve paid the real estate taxes assessed on the premises.
13. Defendants are not in possession of the subject premises.
14 . Defendants sre the only persons known to Plaintiffs who have sny interest in the
premises.
WHEREFORE P1sintiffs request that this court (a) enter an Order decreeing that
Robert J. Jones and Atha G. Jones are the legal ownera of the premiaes herein
described, and (b) order Defendants to being an action in ejectment within thirty (30)
days from entry of the Order pursuant to Pa. R.C.P. No. 1066{b) (l) or be forever
barred from asserting any claim, right, lien, title, or interest in the
herein-described parcel of real estate.

1. By deed dated November 9, ~', and recorded in Cumberland '::ounty Deed Book "I",
Volume 5, at Page 534, J. E. Bonitz and N. H. Bonitz, his wife, of Carlisle,
Pennsylvanis, conveyed to Annie E. Chestnut, Asewith S. Chestnut, Jsmes H. Chestnut,
and George J. Chestnut, a tract of land situate in Southampton Township, Cumberland
County, Pennsylvania, containing one acre more or less.
2. By deed dated February 26, 1965, and recorded in Cumberland County Deed Book
''M'', Volume 21, ot Page 809, the Tax Claim Bureau of the County of Cumberland,
Pennsylvania, as Trustee, conveyed to William H. Gilbert and Grace N. Gilbert, his
wife, a tract of land situate in Southampton Township, Cumberland County,
Pennsylvania, containing one acre, more or less. The Estate of George Chestnut being
the owner or reputed owner of said tract of land.
3. The said William H. Gilbert died October 6, 1978, with no record of an estate
existing in the Office of the Cumberland County Register of Wills.
4. By deed dated Hay 18, 1979, and recorded in Cumberland County Deed Book "N",
Volume 28, at Page 466, Grace N. Gilbert, widow, conveyed to Grace N. Gilbert,
Robert J. Jones, and Atha Jones, his wife, a tract of land situate in Southampton
Township, Cumberland County, Pennsylvania, containing one acre more or less.
5. By deed dated September 18, 1987, and recorded in Cumberland County Deed Book
"E", Volume 33, at Poge 985, Grace N. Gilbert, Robert J. Jones and Atha Jones, his
wife, conveyed to Robert J. Jones and Atha G. Jones, husband and wife, a tract of
land situate in Southsmpton Township, Cumberland County, Pennsylvania, containing one
acre more or less.

MOTION FOR DEFAULT JUDGMENT TO QUIET TITLE
AND NOW come the Plaintiffs, by and through their attorneys, Mark, Weigle and
Perkins, and David P. Perkins, Esquire, and file this Motion for Default Judgment against
Defendants, and in support thereofavcr the following:
l. This is an Action to Quiet Title in which Plaintiffs request that Defendants, their heirs,
executors, administrators, and assigns, and any person claiming under them be forever barred
from asserting any claim, right, lien, title, or interest in or to the real property described in
Plaintitl's Complaint.
2. By Order of Court dated May 10, 1994, this Honorable Court directed service of the
Complaint upon the Defendants by publication pursuant to Pa. R.C.P. No. 430.
3. Attached as Exhibit "A" is an Affidavit and Proof of Publication of Notice in the Cumberland
~ Journal, evidencing service by publication on May 27,1994, of the Notice of Complaint in
accordance with Pa. R.C.P. 430 and C.C.R.P. 1009-1,
4. Attached as Exhibit "B" is an Affidavit and Proof of Publication of Notice in the ~
Chronicle. evidencing service by publication on May 23, 1994, of the Notice of Complaint in
accordance with Pa. R.C.P. 430 and C.C.R.P. 1009-1.
S. Pa. R.C.P. NO. 1066 (a) allows the court to grant appropriate relief upon Affidavit that a

Complaint containing Notice to Defend has been served and that Defendant has not filed an
answer.
6. Service by publication was completed on May 27, 1994, more than twenty days have elapsed
since completion of service, and Defendants have not filed an Answer or other pleading.
WHEREFORE, Plaintiffs request this Court to enter an Order of Default Judgment against
Defendants, Annie E. Chestnut, Asewith S. Chestnut, James M. Chestnut and George J.
Chestnut, their heirs, executors, administrators, and assigns, and any person claiming under them
pursuant to Pa, RoC,p, No. 1066(a).

MOTION FOR SPECIAL ORDER DIRECTING THE SERVICE OF COMPLAINT UPON DEFENDANTS BY
PUBLICATION, PURSUANT TO Pa. R.C.P. No. 430
AND NOW come the Plaintiffs, by and through their Attorneys, Mark, Weigle and
Perkins, and David P. Perkins, Esquire, and move this Honorable Court for a special
Order directing the service of the Complaint filed in the above-captioned action to
quiet title upon the Defendants by publication pursuant to Pa. R.C.P. No. 430, and,
in support thereof, aver the following:
1. Plaintiffs have filed an Action to Quiet Title to the above-captioned action
against the Defendants, Annie E. Chestnut, Asewith S. Chestnut, Jamea M. Chestnut
and George J. Chestnut, their heirs, executors, adminiatrators, and assigns;
2. Defendants Annie E. Cheatnut, Asewith S. Chestnut, Jamea M. Chestnut, and George
J. Chestnut acquired title to the subject premises by deed dated November 9, 1891,
and recorded in Cumberland County Deed Book "I", Volume 5, at Page 534.
3. There ia no record in the Office of the Recorder of Deeds in and for Cumberland
County, Pennsylvania, of a conveyance of the premises by Annie E. Chestnut and/or
Aaewith S. Chestnut and/or James M. Chestnut and/or George J. Chestnut.
4. There is no estate record for Annie E. Chestnut in Cumberland County,
Pennaylvania, and her heirs are unknown.
5. There ia no estate record for Asewith S. Chestnut in Cumberland County,
Pennsylvania, and his or her heirs are unknown.

their heirs are unknown.
9. Service by publication pursuant to Pa. R.C.P. No. 430 upon the Defendants, their
heira, and aasigna, is proper.
WHEREFORE, Plaintiffs request this Honorable Court to enter a Special Order of
Court to permit service of the Complaint in the above-captioned Action to Quiet Title

ACTION TO QUIET TITLE
AFFIDAVIT IN SUPPORT OF PLAINTIFFS' MOTION FOR SPECIAL ORDER
David P. Perkins, being duly sworn according to law, deposes and says the
following:
1. I am a duly licensed attorney at law practicing with the firm of Mark, Weigle
and Perkins, Plaintiffs' attorneys in the above-captioned action.
2. At my direction, an investigation was conducted into the whereabouta of the
Defendants, Annie E. Cheatnut, Asewith S. Cheatnut, Jamea M. Chestnut and George J.
Chestnut. The efforts to locate the Defendants include the following:
A. A search of the eatate records in the Office of the Register of Wills in
and for Cumberland County, Pennsylvania. Said investigation revealed no
estate recorda for Annie E. Chestnut, Asewith S. Chestnut, James M.
Chestnut, or George J. Chestnut.
B. Examination of the local TeleSprint/United Telephone Cumberland County wide
telephone directory revealed no listing for Annie E. Chestnut, or Asewith S.
Chestnut. The directory reveala a liating for one James E. Chastnut of R.
D. 1, Newburg, Pennsylvania. A telephone conversation with Jamea E.
Cheatnut at telephone number 423-5901 revealed that James E. Chestnut was
not related to Jamea M. Chestnut, and further that James E. Chestnut did
not know sn individual by the name of Jamea M. Chestnut. Examination of

said telephone directory further revealed a listing for one Gaorge F. Chestnut of 12
East Big Spring Avenue, Newville, Pennsylvania. A telephone call to George F.
Cheatnut at telephone number 776-5435 revealed that George F. Chestnut is not related
to George J. Chestnut, and further that George F. Chestnut did not know an individual
named George J. Chestnut.
C. A search of the Cumberland County Occupation Tax Office by Carolyn Diehl,
data entry clerk, revealed only two names similar to those of the
Defendants: James E. Chestnut of Box 166B, R. D. 1, Newburg, Pennsylvania,
being the aame James E. Chestnut as described in the aforementioned
paragraph; and George R. Chestnut of Apartment 3, 9 East Big Spring Avenue,
Newville, Pennsylvania. There was no listing for a George J. Chestnut.
D. A aearch of the Cumberland County Election Board/Voter Regiatration Records
by JoAnn Boaler, Clerk, revealed no voter regiatration records for any of
the four named Defendants.
3. Since the deed into the Defendants recorded in Cumberland County Deed Book "r",
Volume 5, at Psge 534, is dated November 9, 1891, Affiant reasonably believes that
all four of the Defendants, to wit, Annie E. Chestnut, Asewith S. Chestnut, James M.
Chestnut and George J. Chestnut, are deceased. Despite the efforts of the Affiant as
outlined in this Affidavit the whereabouts of the Defendants, their heirs, executora,
administrators and aasigns are unknown.
