PLAINTIFF'S RESPONSE TO DEFENDANTS' MOTION
TO QUASH SUBPOENA AND MOTION FOR PROTECTIVE ORDER
COMES NOW, Plaintiff Earl R. Genzel, by way of his
counsel Matthew R. Battersby, and files the within response to
Defendants' Motion to Quash Subpoena and Motion for Protective
Order.
I. Plaintiff has served upon Defendants a Request
for Production of Documents pursuant to Pa. RUle of civil
Procedure 4009.
2. There is only one form of subpoena issued by
Cumberland County.
3. Plaintiff by way of letter has extended the time
period to June 10, 1994 for Defendants to comply
with
Plaintiff's request for production of documents both by
subpoena and by Rule 4009. A copy of said letter is attached
hereto and marked Exhibit "A" and incorporated herein by this
reference.
4. This time period is well in advance of the thirty
(30) days from the time the original subpoenas duces tacem were
served upon Defendants on April 21, 1994.

Specifically, Plaintiff needs

Defendants

defamation of character and libel action.
Although
Defendants
originally named might have republished certain statements that

about Plaintiff, Plaintiff would like to

the original authors of suspected libelous and
defamatory
statements.
Furthermore,
Plaintiff wishes

exact wording of the statements, and Plaintiff can only do this
by
obtaining the information

records ae they were used to adversely reflect on his
performance and employment as an employee of Messiah college.
Furthermore, these records have becn made part of the overall
personnel file and records kept about Plaintiff by his
employer, Messiah college. No matter what Defendants' claims
to confidentiality are, plaintiff has a paramount right to
discover libelous, slanderous, and defamatory statements made
by Defendants or persons known to Defendants.
Furthermore,
Plaintiff has an absolute and paramount right to inspect these
records since they are part of his personnel file kept by his
employer.
WHEREFORE, Plaintiff requests the Court set a hearing date

Dear Hr. Ruhl:
As you are aware, 1 am the attorney for the plaintiff in the
above-captioned case.
Please allow this letter to serve as officlal notice that I
am hereby Qrantina an extension to all defendants served ,on Acril
~1. 1994 with subpoenas duces tacem to produce certain documents
and letters in their possession on April 27, 1994. I am hereby
extending the time period in which to produce said doc~ments and
letter to June 10. 1994. You will note that this is w6ll in
excess of thirty (30) days from the date the parties received the
subpoenas duces tacem.
Also enclosed with this letter please find a Request for
production of Documents under Rule 4009. The subpoenas already
in your clients' possessions seeking production of documents as
outlined in paragraph two of the subpoenas already served on your
clients is being requested in connection with Rule 4009 of the
Pennsylvania Rules of civil Procedure. You will note that Rule
4009 states that any party may serve on any other party a request
to produce and permit the party making the request or someone
acting on his behalf to inspect copy any designated documents.
As you knoW, 1 have asked that the documents be brought to
my office for easy photocopying and inspection. 1I0wever, should
your clients wish the documents to remain at their business
address at Hessiah College, please contact me and I will make
arrangements for personnel from this office to appear at Messiah
college on June 10, 1994 to inspect and photocoPY the documents
there at the college.

In short, what I have outlined in this letter to you is
that the subpoenas duces tacem served on your clients are being
served in conjunction with a discoverr request pursuant to RUle
~009 of the Pennsylvania Rules of civ 1 Procedure. You should
note that Cumberland County has only one form of subpoena which
is intended for both subpoenas to appear at trial or pursuant
to a deposition and subpoena duces tacem which may be issued
pursuant to said Rule 4009. This being the case, I ask that
you dismiss your Hotion to Quash Subpoena and your Hotion for
Protective Order which has been filed with the Court of Common
Pleas of Cumberland County. The RUles of civil Procedure are
designed to assist and facilitate discover. By way of this
letter I have given your clients more than adequate time to
produce the documents requested. Clearly I need to find out the
information contained in these documents in order to know the
facts and particulars of allY liable, slander, or defamation
action contemplated by my client.
Finally, I direct your attention to Paragraph Thirteen of
your Hotion to Quash Wherein you state "Furthermore, Plaintiff
has requested that Defendants produce confidential records
contained in Plaintiff's personnel file." The Plaintiff is
entitled to inspect his personnel under ~3 P.S. Section 1322.
Furthermore, Section 1324 authorizes the Bureau of Labor to
enforce requests of inspection of personnel files and "nothing in
this act shall diminish any rights to discover under the Rules of
the Court of Pennsylvania. Naturally, things in the Plaintiff's
personnel file are confidential, but the Plaintiff has the right
to know what has been said about him and what has been'put.in his
personnel file or made a part of or reference to it.
Simply, let's not waste the Court's time with this matter.
Please communicate with me as to how we can best work out the
coordination of prOducing the documents requested by my client.
Frankly, you told me you were going to call me last Honday rela-
tive to my offer to extend the time period to comply with the
subpoenas by thirty days; instead I receive the Rule to File
Complaint, Hotion to Quash Subpoena and Hotion for Protective
Order. Now that you have a Notice for Production of Documents
served upon you in conjunction with the subpoenas duces tacem
already served upon your clients, I suggest that you ~__a aood
Wth effort to comply with these requests.

DEFENDANTS' MOTION TO QUASH SUBPOENA AND
MOTION FOR A PROTECTIVE ORDER
NOW COMB Defendants, D. Ray Hostetter, Dorothy Gish, Jeff Krirnmel, Galen
Oakes and Henry Rhoads, by their counsel, Rhoads & Sinon, and file the within Motion to
Quash Subpoena and Motion for Protective Order as follows:
1, Plaintiff commenced the above-referenced matter by Writ of Summons
filed on April S, 1994.
2, As of the date of this Motion, Plaintiff has not filed a Complaint in this
case.
3. Plaintiff is currently a professor at Messiah College.
4. Simultaneously with filing this Motion, Defendants have flied a Rule upon
Plaintiff to file a Complaint within twenty (20) days or suffer a judgment of non pros.
S. On April 21, 1994, Plaintiff caused to be served upon two of the five
Defendants, Jeff Krimmel and D. Ray Hostetter, a subpoena attempting to compel the
Defendants to produce on April 27, 1994 various documents, letters, memorandum, flies, etc.,
received by Defendants concerning complaints directed to or about Plaintiff, A tnJe and correct
copy of the subpoenas are attached hereto.
6. Plaintiffs subpoenas are void lib inili2 and otherwise illegal insofar as the
subpoenas fail to comply with Pa.R.Civ.P. 234.1(b).
7. Rule 234. 1 (b) provides:
A subpoena may be used to command a person to attend and to
produce documents or things only at
(I) a trial or hearing in an action or proceeding pending
in the Court, or
(2) the taking of a deposition in an action or proceeding
pending in the court,
(Emphasis added).
8. Plaintiffs subpoenas were not issued in connection with the occurrence of
a trial, hearing or deposition.

Plaintiff's subpoenas are therefore void lib in11ig.
10, Further, although Plaintiff served the subpoenas on April 21, 1994, the
subpoena required the Defendants to respond on April 27, 1994, only six (6) days after service.
11. Plaintiffs subpoenas were not served reasonably In advance of the required
attendance date to pennit the Defendants to meet with their counsel and review the documents
requested.
12. A mere six (6) day advance notice has placed an unreasonable burden upon
counsel to the Defendants to meet the time constraints arbitrarily imposed upon Defendants to
produce the documents requested.
13. Furthennore, Plaintiff has requested that the Defendants produce
confidential records contained in Plalntifrs personnel file.
14, A portion of the records maintained by Defendants was provided to and
maintained by Defendants under the express condition that the documents would at all times
remain confidential,
IS. Production of these confidential personnel records will require Defendants
to violate the tenns of the confidentiality agreement and will otherwise subject Defendants to an
unreasonable annoyance, embarrassment, oppression, burden or expense,

16. In addition, since Plaintiff has not med his Complaint, Defendants are
unaware of his legal theories to be asserted against Defendants, and counsel to Defendants Is
unable to advise Defendants adequately and properly concerning the production of documents
sought by Plaintiff.
17. Defendants therefore request that the Court enter a Protective Order
pursuant to Pa.R.Clv.P. 4012 prohibiting Plaintiff from proceeding with discovery unill after
his Complaint is med.
18. Alternatively, Defendants request that the Court enter an Order scheduling
a hearing at which Plaintiff will be provided opportunity to demonstrate his need for pre-
Complaint discovery.
19. At such hearing, the issue of confidentiality raised herein by Defendants
can aiso be addressed and resolved by an appropriate order of court.
