stipulation resolving the economic issues on April 10, 1997, the
date set for a Master's hearing, the agreement and stipulation
having been transcribed and subsequently signed by the parties
and counsel, the appointment of the Master is vacated. The
parties were divorced by decree entered December 31, 1996.

THE MASTER: Today is Thursday, April 10, 1997, the
date set for a Master's hearing. Present in the hearing room
are the Plaintiff, Joanne M. McCartney and her counsel Keith B.
DeArmond, and the Defendant, Russell E. Mccartney, and his
counsel Samuel L. Andes.

A divorce complaint was filed on April 7, 1994,
raising grounds for divorce of irretrievable breakdown of the
marriage. A divorce decree was entered on December 31, 1996, by
Judge Bayley preserving economic issues raised in the divorce
action. The economic issues pending before the Master are
equitable distribution and alimony.
The Master has been advised that the parties and
counsel, after extensive negotiations in the Master's Office,
have reached an agreement with respect to the outstanding
economic issues. Counsel are going to place the agreement on
the record in the presence of the parties. The agreement as
placed on the the record will be considered the substantive
agreement of the parties and will not be subject to any changes
or modifications except for correction of typographical errors
which may be made during the transcription. That means that we

cannot make any substantive changes to the document that is
going to be drafted and that the agreement stated on the record
today will be the agreement of the parties. After any
typographical corrections have been made and the agreement has
been sent around to counsel for review for typographical
corrections, the parties and counsel will affix their
signatures. The signing of the document is simply an
affirmation of the agreement which is being entered on the
record at this time.
After the Master has received the signed agreement,
the Master will prepare an order vacating his appointment and
the matter will be concluded except for any outstanding
provisions in the agreement that need to be completed after the
signing with respect to the terms of the settlement. Mr. Andes.
MR. ANDES: The parties have agreed to resolve all
of the economic claims in the action on the following terms:
1. The residence at 353 Timber Road in Fairview Township,
which is husband's premarital property will remain the
separate property of husband free of any claim by wife.
Wife will execute and deliver to husband a quitclaim deed
releasing any claims she has in the property.
2. Both parties are employed by the Commonwealth of
Pennsylvania and have benefits in the State Employees'
Retirement system. Both parties have exchanged
information and had appraised the benefits each of them
have in the pension and are familiar with those assets.
Each of the parties hereby waives any claim to or
interest in the pension or pension benefits of the other.
3. Husband is a participant in a deferred compensation
plan operated for the employees of the Commonwealth of

Pennsylvania in which husband had benefits at the time of
separation worth approximately $18,000.00. The parties
have exchanged information about that benefit and, being
familiar with the benefit, wife hereby waives any further
claim to or any interest in husband's deferred
compensation plan benefits.
4. Husband is the owner of an insurance policy or similar
asset with the Woodmen of the World Fraternal Insurance
company which increased in value during the marriage by
approximately $17,000.00. Wife is aware of the value
of that and her claim against the increase in value
during the marriage and, being aware of such matters,
hereby waives and releases any claim to or interest in
such policy or the increase in its value.
5. Husband shall pay to wife within 90 days of the date of
this agreement or sooner, if he can arrange the
financing, the sum of $40,000.00 which sum will be deemed
in complete satisfaction of all equitable distribution
claims in the case by either party against the other.
6. Each of the parties will retain the motor vehicles which
were in their names or possession at the time of
separation.
7. With the exception of a list of items which the parties
have agreed shall be returned to wife today, each of the
parties will retain the items of personal property now in
their respective possessions and each of them waives
any further claim to the distribution or division of
those items. A copy of that list is attached to this
transcript and marked as Schedule A.
8. Husband will make the payment to wife by virtue of a new
mortgage against the residence in Fairview Township
and, as part of that transaction, will payoff the
existing mortgage against the property on which both
husband and wife are obligors.
9. Each of the parties hereby waives any further claim
against the other, including but not limited to any
further claim for equitable distribution, any claim for
spousal support, alimony pendente lite, or alimony, and
any claim for attorney fees or costs or expenses, it
being the intention of the parties to accept the terms of
this agreement as a full and complete satisfaction and
release of all claims against the other arising out of
their marriage or this divorce action.

Notwithstanding the above, the parties will divide
equally the costs of the appraisals of the residence, the
personal property, and the pension benefits.
MR. ANDES: Mr. Mccartney, we've been here for four
hours today, you and I met earlier, are you satisfied that
you're aware of the assets and that you've had an opportunity to
consider this settlement before agreeing to it?
MR. McCARTNEY: Yes.
MR. ANDES: Did you hear what I dictated and do you
understand it?
MR. McCARTNEY: Yes.
MR. ANDES: Do you have any questions about it?
MR. McCARTNEY: No.
MR. ANDES: Is this what you're willing to do to
get this case resolved?
MR. McCARTNEY: Yes.
MR. ANDES: And this is your voluntary choice, I'm
not forcing you to do this.
MR. McCARTNEY: Voluntary, yes.
THE MASTER: And you understand that the agreement
as we've stated on the record is the agreement and it cannot be
changed?
MR. McCARTNEY: I understand that.
MR. DeARMOND: Ms. McCartney, have you heard the
agreement that was dictated on the record by Mr. Andes?

I acknowledge that I have read the above
stipulation and agreement, that I understand the terms of
settlement as set forth herein, and that by siqning below I
ratify and affirm the agreement previously made and intend to
bind myself to the settlement as a contract obligating myself to
the terms of settlement and subjecting myself to the methods and
procedures of enforcement which may be imposed by law and in
particular Section 3105 of the Domestic Relations Code.

dated August 9, 1996, the full-time Master has been appointed in
the above referenced divorce proceedings.
A divorce complaint was filed on April 7, 1994, raising
grounds for divorce of irretrievable breakdown of t~e marriage.
An amended complaint in divorce was filed on July 16, 1996,
raising the economic claims of equitable distribution and
alimony.
I assume that grounds for divorce are not an issue.
Therefore, I am going to proceed with a directive to file
pre-trial statements. In accordance with P.R.C.P. 1920.33(b) I
am directing each counsel to file a pre-trial statement on or
before Tuesday, September 10, 1996. Upon receipt of the
pre-trial statements I will immediately schedule a pre-hearing
conference with counsel to discuss the issues and, if necessary
schedule a hearing.

Present for the Plaintiff, Joanne M. McCartney, is
attorney Keith B. DeArmond, and present for the Defendant,
Russell E. McCartney, is attorney Samuel L. Andes.
A divorce complaint was filed on April 7, 1994,
raising grounds for divorce of irretrievable breakdown of the
marriage. Economic claims were subsequently raised by an
amended complaint filed on July 16, 1996. Those economic claims
are equitable distribution and alimony. Previously, on
September 13, 1994, a petition was filed raising the economic
claims of counsel fees, costs and expenses and alimony pendente
lite. By order of court dated October 13, 1994, Judge Hess
deemed that the claim for counsel fees, costs, and expenses are
withdrawn and denied the claim for alimony pendente lite. We
are, therefore, left with the issues of equitable distribution
and alimony.
With respect to the alimony claim, counsel have
indicated that there may be some testimony on the factor of
marital misconduct which involves specifically wife's alleged
relationship with another person while the parties were still
living together. Counsel have advised that the parties have
signed stipulations agreeing to bifurcate the divorce
proceedings so that a divorce decree should be entered prior to
the end of 1996.
The parties were married on August 17, 1985, and
separated on February 3, 1994. There are no children born of
the marriage. Neither party has any minor children. This is
first marriage for wife and the second marriage for husband.
Wife is 32 years of age and resides at 4714 Brian
Road, Mechanicsburg, Pennsylvania, in an apartment where she
lives alone. She is a high school graduate and works as a
secretary with the Department of corrections. Her biweekly net
income as reported on her income statement is $785.59. She has

raised no health issues. Wife has medical insurance coverage
through her employment.
Husband is 55 years of age and resides at 353
Timber Road, New Cumberland, Pennsylvania, where he lives alone.
He is a high school graduate and works at the correctional
institution in Camp Hill as an instructor in the auto shop. His
net pay every two weeks is $1,146.04. Husband has not raised
any health issues.
The real estate at 353 Timber Road, New Cumberland,
York County, Pennsylvania, is titled in husband's name alone.
Husband prior to the marriage bought the lot where the house was
subsequently erected, and before the marriage also claims he
purchased materials to begin construction on the property.
Counsel, based on an appraisal, agree that the house presently,
as standing, is worth $123,000.00; however, counsel need to
determine what the value of the property was at the time of
marriage. This will involve looking at the contributions thar.
husband made to the purchase of the lot and toward materials as
one approach. Another approach will be that the appraiser can
develop, through meeting with the parties, the status of the
construction at the time of marriage to help him determine a
value as of that date. The property is subject to a mortgage
with PSECU with a mortgage payment in the amount of $664.84.
The mortgage on the property is the only marital debt. Wife is
a party to the mortgage document.
Both parties are participants in pensions with the
SERS. Counsel have indicated that they are going to have the
pensions appraised and will need to determine what portions are
marital as part of that evaluation.
Husband also participates in a deferred
compensation plan with the Commonwealth of Pennsylvania. On
December 31, 1993, the value of that plan was $18,423.87. We
need to have the value updated to the date of hearing excluding
husband's contributions to the present time; also we need to
determine what portion of that plan may be nonmarital.
The household tangible personal property will be
appraised and counsel will try to agree to one person to do the
appraisal. Both parties have certain items of the tangible
personal property so the appraiser will need to look at the
property in possession of each of the parties.
Counsel are hopeful that they will be able to
stipulate to the values of the vehicles which are a 1987
Plymouth Sundance in wife's possession and a 1984 Nissan pickup

truck in husband's possession.
Husband is the owner of a life insurance policy
with Woodmen of the World. On July 1, 1985, the cash value of
the policy was $12,277.25; on January 1, 1995, the value was
$30,187.07. As with other assets, counsel need to determine
what the marital portion consists of in arriving at a value for
distribution.
Mr. Andes has a hearing scheduled in this office on
Thursday, January 16, 1997, which he indicates has settled.
Therefore, we are going to use that date for this case,
including any testimony which the parties may want to offer on
the issue of marital misconduct rather than having a separate
hearing on that issue. The Master is aware that this leaves
counsel about a month, more or less, considering the holidays,
to get the case prepared for hearing; however, we are going to
make an effort to get the case ready to try on that date.
otherwise, we would be looking at a date in March and the Master
feels that this case does not involve complex issues, and
therefore, hopefully we can bring the case to a hearing without
having to wait until the spring. Notices will be sent to
counsel and the parties.

THE MASTER: Today is Thursday, April 10, 1997, the
date set for a Master's hearing. Present in the hearing room
are the Plaintiff, Joanne M. McCartney and her counsel Keith B.
DeArmond, and the Defendant, Russell E. McCartney, and his
counsel Samuel L. Andes.
A divorce complaint was filed on April 7, 1994,
raising grounds for divorce of irretrievable breakdown of the
marriage. A divorce decree was entered on December 31, 1996, by
Judge Bayley preserving economic issues raised in the divorce
action. The economic issues pending before the Master are
equitable distribution and alimony.
The Master has been advised that the parties and
counsel, after extensive negotiations in the Master's Office,
have reached an agreement with respect to the outstanding
economic issues. Counsel are going to place the agreement on
the record in the presence of the parties. The agreement as
placed on the the record will be considered the substantive
agreement of the parties and will not be subject to any changes
or modifications except for correction of typographical errors
which may be made during the transcription. That means that we

cannot make any substantive changes to the document that is
going to be drafted and that the agreement stated on the record
today will be the agreement of the parties. After any
typographical corrections have been made and the agreement has
been sent around to counsel for review for typographical
corrections, the parties and counsel will affix their
signatures, The signing of the document is simply an
affirmation of the agreement which is being entered on the
record at this time.
After the Master has received the signed agreement,
the Master will prepare an order vacating his appointment and
the matter will be concluded except for any outstanding
provisions in the agreement that need to be completed after the
signing with respect to the terms of the settlement. Mr. Andes.
MR. ANDES: The parties have agreed to resolve all
of the economic claims in the action on the following terms:
1. The residence at 353 Timber Road in Fairview Township,
which is husband's premarital property will remain the
separate property of husband free of any claim by wife.
Wife will execute and deliver to husband a quitclaim deed
releasing any claims she has in the property.
2. Both parties are employed by the Commonwealth of
Pennsylvania and have benefits in the State Employees'
Retirement System. Both parties have exchanged
information and had appraised the benefits each of them
have in the pension and are familiar with those assets.
Each of the parties hereby waives any claim to or
interest in the pension or pension benefits of the other.
3. Husband is a participant in a deferred compensation
plan operated for the employees of the Commonwealth of

Pennsylvania in which husband had benefits at the time of
separation worth approximately $18,000.00. The parties
have exchanged information about that benefit and, being
familiar with the benefit, wife hereby waives any further
claim to or any interest in husband's deferred
compensation plan benefits.
4. Husband is the owner of an insurance policy or similar
asset with the Woodmen of the World Fraternal Insurance
Company which increased in value during the marriage by
approximately $17,000.00. Wife is aware of the value
of that and her claim against the increase in value
during the marriage and, being aware of such matters,
hereby waives and releases any claim to or interest in
such policy or the increase in its value.
5. Husband shall pay to wife within 90 days of the date of
this agreement or sooner, if he can arrange the
financing, the sum of $40,000.00 which sum will be deemed
in complete satisfaction of all equitable distribution
claims in the case by either party against the other.
6. Each of the parties will retain the motor vehicles which
were in their names or possession at the time of
separation.
7. With the exception of a list of items which the parties
have agreed shall be returned to wife today, each of the
parties will retain the items of personal property now in
their respective possessions and each of them waives
any further claim to the distribution or division of
those items, A copy of that list is attached to this
transcript and marked as Schedule A.
8. Husband will make the payment to wife by virtue of a new
mortgage against the residence in Fairview Township
and, as part of that transaction, will payoff the
existing mortgage against the property on which both
husband and wife are obligors.
9. Each of the parties hereby waives any further claim
against the other, including but not limited to any
further claim for equitable distribution, any claim for
spousal support, alimony pendente lite, or alimony, and
any claim for attorney fees or costs or expenses, it
being the intention of the parties to accept the terms of
this agreement as a full and complete satisfaction and
release of all claims against the other arising out of
their marriage or this divorce action.

Notwithstanding the above, the parties will divide
equally the costs of the appraisals of the residence, the
personal property, and the pension benefits.

MR. ANDES: Do you have any questions about it?
MR. McCARTNEY: No.
MR. ANDES: Is this what you're willing to do to
get this case resolved?
MR. McCARTNEY: Yes.
MR. ANDES: And this is your voluntary choice, I'm
not forcing you to do this.
MR. McCARTNEY: Voluntary, yes.
THE MASTER: And you understand that the agreement
as we've stated on the record is the agreement and it cannot be
changed?
MR. McCARTNEY: I understand that.
MR. DeARMOND: Ms. McCartney, have you heard the
agreement that was dictated on the record by Mr. Andes?
MS. McCARTNEY: Yes.
MR. DeARMOND: And is that your understanding of
the agreement as it was negotiated today?
MS. McCARTNEY: Yes.
MR. DeARMOND: Are you in agreement with the terms
of this settlement?
MS. McCARTNEY: Yes.
MR. DeARMOND: And you understand that we cannot,
in any way after today, other than correcting typographical
errors, that once this is transcribed, that we cannot change
this agreement?
MS. McCARTNEY: Yes, I do.
I acknowledge that I have read the above
stipulation and agreement, that I understand the terms of
settlement as set forth herein, and that by signing below I
ratify and affirm the agreement previously made and intend to
bind myself to the settlement as a contract obligating myself to
the terms of settlement and subjecting myself to the methods and
procedures of enforcement which may be imposed by law and in
particular section 3105 of the Domestic Relations Code.

The Milliron divorce hearing was originally scheduled before you on 16 January
1997, As you have been informed by John Connelly, Esquire, and I, that matter has
been concluded and the hearing will not be necessary.
You had scheduled the McCartney case, for Keith DeArmond, for that day
because, at the pre-trial conference in the McCartney case, you had been advised the
Milliron matter had settled. At that time Keith DeArmond and I were not certain we
could complete all of the work we had to do prior to the hearing but agreed we would
try,
1 write to request that the matter be postponed and that you reschedule it for
another time thirty days or so away, Unfortunately, Keith DeArmond and I have not yet
completed all of the work we must do to prepare for the hearing and it is clear we will
not have the appraisals and other information we need sufficiently prior to the time of
the hearing to adequately prepare, either for settlement or for litigation. It is just not
possible that we will have all of that information in time to adequately prepare,

DEFENDANT'S PRE-TRIAL STATEMENT
Defendant, by his attorney, Samuel L, Andes, files this Pre-Trial Statement in accordance with Pa,
R.C.P. 1920.33(b):
I. ASSETS. Attached hereto and marked as Schedule A and Schedule B are lists of the marital
assets and non-marital assets involved in this case.
2, EXPERT WITNESSES. At this time Defendant expects that the parties will be able to agree
upon the value of the residence, the pensions. and the other assets without the use of expert witnesses, If
that is not the case, he reserves the right to call expert appraisers to value those assets.
3. FACT WITNESSES. Defendant intends to call himself as a fact witness, Depending upon the
evidence and claims submitted by the Plaintiff, he reserves the right to call such other witnesses as may be
necessary to respond to those matters,
4, EXHIBITS, Defendant will offer into evidence the following Exhibits:
(a) Copies ofappraisals and reports of experts to establish the values of some assets,
(b) Documents showing the value at the time of marriage and at the time of
separation of the non-marital assets, including his Woodman of the World insurance policy,
his deferred compensation plan, and the like,
(c) Copies of documents showing the funds the Defendant received from the
liquidation of pre-marital assets.
(d) Copies of documents showing the investment of pre-marital funds into marital
assets including the residence,

7. PENSION INFORMATION, Defendant expects that the parties will have their respective
retirement benefits, at least the portion earned during marriage, valued by an actuary and that the parties will
submit that information by stipulation,
8. COUNSEL FEES, Defendant has made no claim for counsel fees at this time,
9, PERSONAL PROPERTY, Defendant believes there may be a dispute about the division of
personal property and the identity of those assets as marital or non-marital property, If that is the case. he
proposes to have all the items of personal property appraised and, if the parties are not then able to agree, to
offer testimony about which of those assets are marital property and which of those assets he would like
distributed to him. Defendant is hopeful, however, that the parties can agree upon the division of those
assets,

11, PROPOSED RESOLUTION OF ECONOMIC ISSUES, Defendant proposes that he

they would have reasonably appreciated during the marriage, and that the balance of the marital assets be
divided equally between the parties, Defendant would like to retain the residence if possible, Defendant
proposes that there be no payment of alimony or counsel fees,
