STIPULATION AGAINST LIENS
WHEREAS, Brijeshwar S. Maini and Cherry S. Maini, of %e~,~.t~ County,
Pennsylvania, is about to execute contemporaneously herewith, a contract with l~alph J. Iacono,
t/d/b/a/Iacono Company of Cumberland County, Pennsylvania, for the erection of a dwelling
upon a lot of land situate as follows:
ALL THAT CERTAIN parcel of land situate in the Borough of Lemoyne,
Cumberland County, Pennsylvania, known and numbered as Lot No. 3 on a Plan of Lots known
as "White Oaks" as prepared by Robert G. Hartman, Jr., Registered Surveyor, and recorded in
the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book
58, Page 26, which Lot is more particularly bounded and described as follows, to wit:
BEGINNING at a point on the right-of-way line West Wind Drive, said point
being on the dividing line of Lot No. 2 and Lot No. 3 on the hereinbefore mentioned Plan of Lots;
thence along said right-of-way in a northerly direction North 02 degrees 27 minutes 30 seconds
East, a distance of 159.45 feet to a point; thence continuing along said right-of-way line along
a curve with an arc radius of 210.00 feet an arc distance of 25.02 feet to a point on the dividing
line of Lot No. 3 and Lot No. 4 on the hereinbefore mentioned Plan of Lots; thence along said
dividing line North (erroneously stated as South in prior deed) 85 degrees 38 minutes 00 seconds
East, a distance of 228.01 feet to a point; thence South 24 degrees 12 minutes 30 seconds East,
a distance of 161.53 feet to a point; thence North 82 degrees 14 minutes 05 seconds West, a
distance of 132.97 feet to an iron pin thence South 02 degrees 27 minutes 30 seconds West, a
distance of 79.45 feet to a point on the dividing line of Lot No. 2 and Lot No. 3 on the
hereinbefore mentioned Plan of Lots; thence along said dividing line North 87 degrees 32
minutes 30 seconds West, a distance of 165.00 feet to a point on the right-of-way line of West
Wind Drive, the Place of BEGINNING.
CONTAINING 1.0319 acres, more or less.
SUBJECT to certain waivers contained in an approval of architectural review
committee dated July 17, 1990 and attached to Deed Book "R", Volume 34, Page 596.
ALSO SUBJECT TO permission to construct a twelve foot wide paved driveway
as set forth in Deed Book "R", Volume 34, Page 479 and approval of architectural review
committee dated July 17, 1990 and attached to Deed Book "R", Volume 34, Page 479.
NOW, the q~-~,*'J~ day of June, 2002, at the time of and immediately before
the execution of the principal contract, and before any authority has been given by the said
Brijeshwar S. Maini and Cherry S. Maini, to the said Ralph J. Iacono, t/d/b/a Iacono Company
to commence work on the said building, or purchase materials for the same in consideration of
the making of the said contract with Ralph J. Iacono, ffd/b/a Iacono Company and the further
consideration of One Dollar, to Ralph J. Iacono, t/d/b/a Iacono Company paid by Brijeshwar S.
Maini and Cherry S. Maini, it is agreed that no lien shall be filed against the building by the
contractor, or any sub-contractor, nor by any of the material men or workmen or any other person
for any labor, or materials purchased, or extra labor or materials purchased for the erection of
said building, the right to file such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
