DIVORCE COMPLAINT UNDER

1. Plaintiff is Troy Micheal Myers who is currently incarcerated
at Camp Hill Prison, Post Office Box 200, Camp Hill, Cumberland
County, Pennsylvania, since December 6, 1993.
2. Defendant is Diane Lynn Myers who currently resides at 400
7th Street, Apartment No.8, New Cumberland, Cumberland County,
Pennsylvania, since November 1991.
3. Plaintiff and Defendant have been a bona fide residents in
the Commonwealth for at least six months immediately previous to the
filing of this Complaint.
4. The Plaintiff and Defendant were married on August 2, 1993
in Camp Hill, Pennsylvania.
5. There have been no prior actions of divorce or for annulment
between the parties.
6. The marriage is irretrievably broken; and/or Defendant has
offered such indignities to Plaintiff, as the innocent and injured
spouse, so as to render his condition intolerable and his life
burdensome.
7. Plaintiff has been advised of the availability of counseling
and understands that he has a right to request that the court require
it.

PETITION TO PROCEED IN FORMA PAUPERIS
TO THE HONORABLE JUDGES OF SAID COURT:
The Petition of Troy M. Myers, respectfully represents the
following:
1. He is the plaintiff in the above-captioned matter who is
currently incarcerated at Camp Hill Prison.
2. On March 30, 1994, plaintiff filed with this respectable
court a Divorce Complaint.
3. Said Complaint was filed without prepayment of cost or fees.
4. Plaintiff avers that he has good and sufficient grounds for
a divorce from defendant, Diane L. Myers, pursuant to 23 Pa. C.S.A.
fig 3301 (c), or 3301 (a) (6) .
5. Plaintiff is a poor person and owns no assets other than
personal clothing and a few household or personal items and has no
real property of any kind.
6. The only income plaintiff has presently is employment from
the state Correctional Institution at Camp Hill in which he makes
approximately eighteen (18) cents an hour.
7. By reason of the conduct of the defendant, plaintiff will be
put to considerable expense in the preparation of his case unless
allowed to proceed in forma pauperis.

8. That the plaintiff is without funds to meet the cost and
expenses of this litigation.
9. That defendant is presently on Workmen's Compensation and
earning approximately $1 ,000.00 dollars per month to the best of
plaintiff's knowledge.
10. If plaintiff is denied the right to prosecute his cause of
action because of the inability to pay the costs therefore, plaintiff
will suffer serious hardship and injustice.
WHEREFORE, in light of the foregoing reasons, plaintiff
respectfully asks that this Honorable Court allow him to proceed
with his divorce action in forma pauperis in accordance with the
Pennsylvania Rules of Civil Procedure, Rule 1920.62, and to the
termination thereof without the necessity of paying any cost thereof.
Alternatively, plaintiff respectfully asks that this Honorable Court
grant a Rule on the above named defendant to show cause why an Order
should not be made upon defendant to pay plaintiff's counsel fees and
expenses.

1. A complaint in divorce under Section 3301 (c) of the Uivorce
Code was filed on April 4, 1994.
2. The marriage of Plaintiff and Defendant is ir.retrievably
broken and ninety days have elapsed from the date of filling the
Complaint.
3. I consent to the entry of a final decree of divorce.
4. I understand that I may lose rights concerning alimony,
division of property, lawyer's fees or expenses if I do not claim
them before a divorce is granted.
I verify that the statements made in this affidavit are true and
correct. I understand that false statements herein are made subject
to the penalties of 18 Pa. C.S. ~ 4904 relating to unsworn falsification
to authorities.

in violation of Pa. R.C.P. 400 et seq., a divorce decree will not
be entered at this time.

Praecipe To Transmit Record may be filed if Defendant Diane Lynn
Hyers files an Acceptance of Service pursuant to Pa. R.C.P. 402(b),
indicating for the record that she did receive a copy of the
