STIPULATION AND AGREEMENT
THIS AGREEMENT AND STIPULATION entered into the day and
year hereinafter set forth, by and between Patricia M. Reed,
(hereinafter referred to as "Mother") and Kevin L. Reed,
(hereinafter referred to as "Father").
WHEREAS, the parties are the natural parents of Amber Reed,
born December 15, 1989, and Kevin P. Reed, born May 28, 1991,
(hereinafter the "Children"); and
WHEREAS, the parties are presently separated and living in
separate residences; and
WHEREAS, the parties wish to enter into an agreement
relative to custody and partial custody of the child; and
NOW, THEREFORE, in consideration of the mutual covenants,
promises and agreements as hereinafter set forth, the parties
agree as follows:
1. The parties will have shared legal custody of the
children.
2. Mother will retain primary physical custody of the
children.

3. Father will have temporary or partial custody of the
children on the following basis:
a. Every other weekend from Friday evening at 6: 00
p.m. until Sunday evening at 7:00 p.m.; and
b. At other times as the parties may agree.
4. In addition, the parties will alternate the following
holidays: New Year's Day, Memorial Day, Fourth of July, Labor
Day and Veterans' Day. On each such holiday the parent who has
the children for that holiday will have them from 9:00 a.m. until
7:00 p.m.
5. During the Christmas holiday season, the parties shall
alternate the following two periods of physical custody:
a. From 5:00 p.m. on Christmas Eve until 2:00 p.m. on
Christmas day; and
b. From 2:00 p.m. on Christmas day until 6:00 p.m. on
December 26, with Father having the first period of time during
Christmas, 1993.
6. During the Thanksgiving holiday season, the parties will
alternate physical custody of the children between the following
two periods:
a. From 5:00 p.m. on the Wednesday before Thanksgiving
until 5:00 p.m. on the Friday after Thanksgiving; and
b. From 5:00 p.m. on the Friday after Thanksgiving until 5:00
p.m. on the Monday following Thanksgiving, with Father having the
first period of time for Thanksgiving, 1994.
7. During the Easter holiday season the parties shall
alternate the following two periods of time:
a. From 5:00 p.m. Friday evening on the Friday before
Easter until 5:00 p.m. on Saturday evening on the Saturday before
Easter; and
b. From 5: 00 p.m. Saturday evening on the Saturday
before Easter until 7:00 p.m. on Easter Sunday, with Father
having the first period of time for Easter, 1994.
8. The children shall always be with the Mother on Mother's
Day and with the Father on Father's Day. In the event that
Mother's Day occurs during Father's weekend, then the children
shall be returned to Mother at 9:00 a.m. on that Sunday. In the
event that Father's Day occurs occurs on Mother's weekend, Father
shall have the children from 9:00 a.m. until 7:00 p.m. on that
Sunday.
9. The parties shall at all times keep each other advised
of their current residence and current telephone number.
10. Whoever is securing physical custody of the children
shall be responsible for transporting the children to initiate
that parties' period of physical custody.
11. The within Agreement is entered in recognition of the
Father's present schedule of rotating shifts and working seven
day work weeks, at least on an alternating week basis.
12. The parties will keep each other advised immediately in
the event of serious illness or medical emergency concerning the
children and shall further take any necessary steps to ensure
that the health and well being of the children is protected.
During such illness or medical emergency, both parties shall have
the right to visit the children as often as he or she desires
consistent with the proper medical care of the children.
13. Neither parent shall do anything which may estrange the
children from the other party, or injure the opinion of the
children as to the other party, or which may hamper the free and
natural development of the children's love or affection for the
other party.
14. Any modification or waiver of any of the provisions of
this Agreement shall be effective only if made in writing and
only if executed with the same formality as this stipulation and
Agreement.
15. The parties desire that this stipulation and Agreement
be made an Order of Court to the Court of Common Pleas of
CUmberland County, and further acknowledge that the Court of
Common Pleas of Cumberland County does, in fact, have
jurisdiction over the issue of custody of the parties' minor
children and shall retain such jurisdiction should circumstances
change and either party desire or require modification of said
Order.
16. The parties agree that in making this Agreement, there
has been no fraud, concealment, overreaching, coercion, or other
unfair dealing on the part of the other.

17. The parties acknowledge that they have read and
understand the provisions of this Agreement.
Each party
acknowledges that the Agreement is fair and equitable and that it
is not the result of any duress or undue influence.
IN WITNESS WHEREOF, the parties hereto intending to be
legally bound by the terms hereof, set forth their hands and
seals the day and year herein mentioned.
