ORDER OF COURT AND NOW this day of , 1994, upon stipulation of the parties attached hereto, it is hereby ORDERED that: 1. Legal custody of Kaylena Marie Herdman shall be with the mother, Jennifer L. Leach, Plaintiff. 2. The father, Jeffrey M. Herdman, Defendant, shall have partial custody for purposes of visitation as follows: a. Every Sunday at a time mutually agreed to by the parties. Such time period shall not exceed six (6) hours and all such visitation shall be supervised by the mother, Jennifer L. Leach or her designee; b. The parties agree to alternate visitation on the following holidays: New Year's Day, Easter Sunday, Memorial Day, Fourth of July, Labor Day, Thanksgiving, Christmas Eve and Christmas Day. Such time period shall not exceed six (6) hours for each holiday and all such visitation shall be supervised by the mother, Jennifer L. Leach or her designee; c. The parties agree that Father's Day visitation shall be with the father, Jeffrey M. Herdman, elects not to exercise such rights, then he must provide adequate notjce to the mother, Jennifer L. Leach; f. There shall be such additional visitation with Kaylena Marie as shall be determined by mutual agreement of the parties; g. In case of an emergency and/or Kaylena Marie becoming ill during the father, Jeffrey M. Herdman's visitation, then he shall provide immediate notice via telephone or whatever shall be practical to the mother, Jennifer L. Leach. 3. Neither party shall move out of the Commonwealth of Pennsylvania without prior notification to the other party, including new address. Upon this occurring either party may petition this Court to modify, amend or revoke this Order. HERDMAN, Defendant CIVIL ACTION - CUSTODY CUSTODY AGREEMENT WHEREAS, Jennifer L. Leach, hereinafter referred to as MOTHER and Jeffrey M. Herdman, hereinafter referred to as FATHER, are the natural parents of Kaylena Marie Herdman, born January 23, 1993; and, WHEREAS, Mother and Father desire to make arrangements for the custody and visitation of said child; and, WHEREAS, both parties have been advised by counselor have had the opportunity to so be advised by counsel; and, WHEREAS, the parties intend to submit this CUSTODY AGREEMENT to the Court of appropriate jurisdiction for merger into a Court Order approving said Agreement; NOW THEREFORE, it is hereby stipulated and agreed as follows: 1. The MOTHER shall have primary custody of Kaylena Marie Herdman and the FATHER Shall have partial custody for purposes of visitation as set forth in THIS AGREEMENT. 2. FATHER shall have partial custody for purposes of visitation as follows: a. Every Sunday at a time mutually agreed to by the parties. Such time period shall not exceed six (6) hours and all such visitation shall be supervised by Jennifer L. Leach or her designee; b. As Kaylena Marie becomes older, the parties agree to modify this Agreement and to provide additional visitation to Jeffrey M. Herdman: h.
