I
I. The plaintiff, Elaine M. Martin, is an individual residing
at 350 North 19th St., Camp Hill, Cumberland County, Penna.
2. The defendant, James Keirney, is an individual residing at
1927 Arlington Street, Camp Hill, Cumberland County, Penna.
3. On January 16, 1994, the plaintiff was the owner of a 1994
Saturn sedan.

4. At or about noon on the aforesaid date, the plaintiff was
operating her said Saturn in a western direction on Arlington
Street, in Camp Hill, Cumberland County, Penna.
5. At the same time and place the defendant backed his car
out of his driveway, and onto Arlington Street, causing a
collision.
6. The collision was due to the negligence of the defendant
in the following respects:
a. In backing out of a driveway into a public street,
when the plaintiff was approaching on the said public street.
b. In failing to observe the plaintiff's said Saturn.
7. As a result of the negligence of the defendant, the
plaintiff sustained $1,557.21 in damages to the said Saturn as is
more fully set forth in the attached Exhibit A.
WHEREFORE, the plaintiff claims of the defendant, $1,557.21,
an amount requiring compulsory referral to arbitration under the
local rules of court.
