Garman, Civil Action - Law Defendant COMPLAINT 1, Plaintiff Troy A, Piazza is an adult individual residing at 65 South High Street, Newville, Pennsylvania, 2, Defendant Earl P. Garman is the owner of an automobile repair shop located at 670 Longsgap Road, Carlisle, Pennsylvania. 3, On July 27, 1993 defendant Garman repaired plaintiff's automobile by replacing the "left front axel shaft" (the part) . 4. Defendant Garman charged plaintiff $289.06 for the part and $56.00 for labor, 5, Defendant Garman purchased the part from WLS Chrysler Plymouth (WLS) for a price of approximately $230.00. 6. Approximately two (2) months after defendant made the repairs, the car shook mildly when the accelerator was depressed, 7, In November, 1993, while in New York, plaintiff's car shook violently whenever the accelerator was depressed. 8. A mechanic in New York had to replace the part and expressed his belief that the part was defective since left front axels do no break in such a short period of time, 9. The part was returned to defendant Garman, who gave it to WLS for determination of defectiveness. 10. WLS determined that the part was defective and thus refunded defendant Garman the full amount defendant Garman was charged by WLS, 11. Defendant Garman refused to refund to plaintiff the full amount plaintiff was charged for the part and instead offered the amount he paid WLS for the part. 12, Plaintiff seeks a refund of the full amount charged for the part, $289.06, plus costs, /~~:;r.
