above captioned Petition for Rule for Judicial Sale, and upon Motion of the Petitioner,
It Is Ordered and Decreed as follows (See 72 P.S. ~5860,612):
1) Petitioner having advised that the taxes had been paid in full for the
portion of the Petition which applies to property of Pennsylvania Harvestore, Inc,
(Parcel No. 22-12-0350-026), the Petition is dismissed in so far as that real estate
parcel and taxpayer Is concerned,
2) Service of the Rule not having been made concerning the property of
Ronald L. Sadler, Jr. (Parcel No. 21-04-0371-046-TR04461), and upon motion of the
Petitioner indicating that the property has been removed from the assessment roles as
uninhabitable, the Petition Is dismissed in so far as that real estate parcel and

40-32-2338-012), the Hearing on the portions of the above captioned Petition
applicable to those properties Is continued generally and Petitioner Is given leave to
file a Petition for Service by Publication pursuant to Pa,R,C,P 430, or for a new
Hearing date If personal service can be made,
4) The property of Richard Cope and Mary Houseman (Parcel No, 10-20-
1842-082-TR09883) and the property of Barbara Rodgers (Parcel No. 29-15-1251-
014-TR06521) shall be sold immediately following the next regular sale of the Tax
Claim Bureau, on September 29,1994, at 7:00 p,m, at the Cumberland County
Courthouse, at Carlisle, Pennsylvania, freed and cleared of all tax and municipal
claims, mortgages, liens, charges and estates, except separately taxed ground rents,
to the highest bidder, and the purchaser(s) at such sale shall take and thereafter have
an absolute title to said properties sold free and clear of all tax and municipal claims,
mortgages, liens, charges and estates of whatsoever kind, except ground rents,
separately taxed, provided however, that no sale shall be made except to the County
unless a bid equal to the costs of the prior sale and this sale Is received,
5) Readvertlsement of the sale of the property of Richard Cope and Mary
Houseman (Parcel No, 10-20-1842-082- TR09883) and the property of Barbara
Rodgers (Parcel No, 29-15-1251-014-TR06521) need not be published three (3)
consecutive weeks, nor Include a list and description of the lands to be sold, but need

1. Subsequent to the Hearing on the above captioned malter, which was
held on June 30, 1994, the Tax Claim Bureau learned that the property of Ronald L,
Sadler, Jr, (Parcel No, 21-04-0371-046-TR04461) had been stricken from the
assessment records as uninhabitable,

through and Including 1992-93 Carlisle Area school real estate
taxes. Total amount of claim, including penalty and interest as of

MOTION TO AI\1END RULE
AND NOW, comes the Cumberland County Tax Claim Bureau, by Its Attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and flies this
Motion for Amended Rule, of which the following Is a statement.
1. On April a, 1994 your Petitioner flied a Petition for Rule for Judicial Sale to
the above captioned term and number. Said Petition was In the form of seven
separate Petllions for seven separate parcels.
2. Your Honor entered a Rule to Show Cause on April a, 1994 setting May
11,1994 at 9:00 A.M. as the date and time at which the Rule would be returnable and
a hearing held.
3. Section 611 of the Real Estate Tax Sale Law (72 P.S. ~5a60.611) may be
read to require service of the Rule at least 15 days prior to the return day of the Rule
and In any event reputed owners of the property and lien creditors should be given
reasonable notice of the said date and time.
4. Your Petitioner Is Informed by the Cumberland County Sheriff's
Department that It will be impossible to serve the Rules on all of the parties at least 15
days prior to the May 11, 1994 hearing. In particular, It Is noted that some lien
creditors are outside of the juriSdiction of the Cumberland County Sheriff's
Department.
5. The Cumberland County Sheriff's Department believes that service can be
reasonably effected on all such parties at least 15 days prior to a hearing, if the
hearing Is scheduled on or after June 20, 1994.
6. Upon examination of the Petition for Rule for Judicial Sale for property of
Pennsylvania Harvestore, Inc. it was discovered that the Exhibit "A" to that Petition,
mentioned at paragraph three of that Petition, was Inadvertently omitted therefrom.
Attached hereto as Exhibit "A" is the exhibit which was Intended to be attached to that
Petition.

7. Your Petitioner desires to avoid any confusion on the part of reputed
owners or lienholders.
WHEREFORE, your Petitioner prays your Honorable Court as follows:
a. For a new Rule returnable date on or after June 20, 1994
and for the removal of the prior Rule to Show Cause and the
attachment of new Rules to Show Cause to each of the seven said
Petitions, setting forth the new Rule returnable date.
b. For leave to the Petitioner to attach a copy of the attached
Exhibit "A" to the Petition for Rule for Judicial Sale for property of
Pennsylvania Harvestore, Inc.

PETITION FOR RULE FOR JUDICIAL SALE
AND NOW, comes the Cumberland County Tax Claim Bureau, by Its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and flies this
Petition for Rule for Judicial Sale, of which the following Is a statement:
1. Your Petitioner Is the Cumberland County Tax Claim Bureau, a Bureau
created by the Real Estate Tax Sale Law. 72 P.S. ~5860.1 01, et sic.

follows:
Pursuant to 72 P.S. ~5860.610, your Petitioner respectfully represents as
a.
Tax claim upon which the property was exposed for sale: 1988
through and Including 1992 Cumberland County, Cumberland
County Library, and South Middleton Township real estate taxes.
1988-89 through and including 1992-93 South Middleton school
real estate taxes. Total amount of claim, including penalty and
Interest as of date of tax sale: $950.98.
b.
Neither the owner, his, her, their, or Its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or Its heirs, successors or legal representatives, or any other
person Interested, has caused stay of sale, discharge of tax claim or
removal from tax sale.
c.
The property was exposed to public sale pursuant to 72 P.S.
~5860.601 on: September 30,1993.
Before exposing the property to public sale the Bureau fixed the
upset sale price, pursuant to 72 P.S. ~5860.605, which upset price
was $950.98.

searcher retained by the Bureau together with a reduced copy of the most recent deed
for the subject premises, as of the date of the search.

Petition for Rule for Judicial Sale, of which the following Is a statement:
1. Your Petitioner Is the Cumberland County Tax Claim Bureau, a Bureau
created by the Real Estate Tax Sale Law. 72 P.S. ~5860.1 01, at sic.

Pursuant to 72 P.S. ~5860.610, your Petitioner respectfully represents as

Tax claim upon which the property was exposed for sale: 1987
through and Including 1992 Cumberland County, Cumberland
County Ubrary, and Mount Holly Springs Borough real estate taxes.
1987-88 through and Including 1992-93 Carlisle Area school real
estate taxes. Total amount of claim, Including penalty and Interest
as of date of tax sale: $1,995.09.

Neither the owner, his, her, their, or Its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or Its heirs, successors or legal representatives, or any other
person Interested, has caused stay of sale, discharge of tax claim or
removal from tax sale.
c.
The property was exposed to public sale pursuant to 72 P.S.
~5860.601 on: September 30,1993.
Before exposing the property to public sale the Bureau fixed the
upset sale price, pursuant to 72 P.S. ~5860.605, which upset price
was $1,995.09.

PETITION FOR RULE FOR JUDICIAL SALE
AND NOW, comes the Cumberland County Tax Claim Bureau, by Its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and flies this
Petition for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner Is the Cumberland County Tax Claim Bureau, a Bureau
created by the Real Estate Tax Sale Law. 72 P.S. ~5860.1 01, st sic.

follows:
Pursuant to 72 P.S. ~5860.610, your Petitioner respectfully represents as
a.
Tax claim upon which the property was exposed for sale: 1986
through and Including 1992 Cumberland County, Cumberland
County Library, and Monroe Township real estate taxes. 1986-87
through and including 1992-93 Cumberland Valley school real
estate taxes. Total amount of claim, including penally and Interest
as of date of tax sale: $45,822.22.
b.
Neither the owner, his, her, their, or Its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or its heirs, successors or legal representatives, or any other
person Interested, has caused stay of sale, discharge of tax claim or
removal from tax sale.
c.
The property was exposed to public sale pursuant to 72 P.S.
~5860.601 on: September 30,1993.
d.
Before exposing the property to public sale the Bureau fixed the
upset sale price, pursuant to 72 P.S. ~5860.605, which upset price
was $45,822.22.
Your Petitioner, the Bureau, was unable to obtain a bid at the

public sale sufficient to pay the said upset price.

as If fully set forth herein Is a reduced copy of a title report received from a title
searcher retained by the Bureau together with a reduced copy of the most recent deed

true copy of the within Rule to Show Cause and Ptition for Rule for Judicial
Sale, in the above entitled action, upon the within named defendants, to
wit: Richard Cope and Mary houseman, by making known unto Mary Houseman,
defendant and adult in charge, accepted for both, at 42 Victor Drive,
Mechanicsburg, Cumberland County, Pennsylvania, its contents and at the same
time handing to her personally the said true and attested copy of the same.
Michael Barrick, Deputy Sheriff. who being duly sworn according
to law, says that on May 11, 1994 at 10:15 o'clock A.M., E.D.S.T., he served

Judicial Sale, in the above entitled action, upon the within named
defendant, to wit: Cumberland County Tax Claim Bureau. by making known unto
Kurt Long, Auditor and adult in charge, at The Cumberland County Courthouse,
One Courthouse Square, Carlisle, Cumberland County, Pennsylvania, its
contents and at the same time handing to him personally the said true and
attested copy or the same. This service was made for the property owned by
Richard Cope and Mary Houseman.

Wesley Cook, Deputy Sheriff. who being duly sworn according to
law, says that on May 04, 1994 at 2:00 o'clock P.M., E.D.S.T., he served a
true copy of the within Rule to Show Cause and Petition for Rule for
Judicial Sale, in the above entitled action, upon the within named
defendant, to wit: Cumberland County Tax Claim Bureau, by making known unto
Kurt Long, Auditor and adult in charge, at The Cumberland County Courthouse,
One Courthouse Square, Carlisle, Cumberland County, Pennsylvania, its
contents and at the same time handing to him personally the said true and
attested copy of the same. This service was made for the property owned by
Barbara Rodgers.
Robert L. Fink. Deputy Sheriff. who being duly sworn according
to law, says that on May 04, 1994 at 3:10 o'clock P.M., E.D.S.T., he served
a true copy of the within Rule to Show Cause and Petition for Rule for
Judicial Sale. in the above entitled action, upon the within named
defendant, to wit: Mary K. Barrick, Tax Collector, by making known unto
Mary Barrick, at 303 Airport Drive, Carlisle, Cumberland County,
Pennsylvania, its contents and at the same time handing to her personally
the said true and attested copy of the same. This service was made for the
property owned by Barbara Rodgers.
Robert L. Fink, Deputy Sheriff, who being duly sworn according
to law, says that on May 04, 1994 at 2:50 o'clock P.M.. E.D.S.T., he served
a true copy of the within Rule to Show Cause and Petition for Rule for
Judicial Sale, in the above entitled action, upon the within named
defendant, to wit: Robin Sollenberger, Tax Collector. by making known unto
Robin Sollenberger, at 5 Hill Drive. Carlisle. Cumberland County,
Pennsylvania, its contents and at the same time handing to her personally
the said true and attested copy of the same. This service was made for
property owned by Barbara Rodgers.
R. Thomas Kline. Sheriff, who being duly sworn according to law,
says that he made diligent search and inquiry for the within named defendant,
to wit: Ronald L. Sadler, Jr., but was unable to locate him in his bailiwick.
He therefore returns the within Rule to Show Cause and Petition for Rule
for Judicial Sale, as "NOT FOUND" as to the within named defendant, Ronald
L. Sadler, Jr.. Defendant moved about two years ago and left no forwarding
address with the Post Office.
Wesley Cook, Deputy Sheriff, who being duly sworn according
to law, says that on May 04, 1994 at 2:00 o'clock P.M., E.D.S.T., he served
a true copy of the within Rule to Show Cause and Petition for Rule for Judicial
Sale. in the above entitled action. upon the within named defendant, to wit:

1. Your Petitioner Is the Cumberland County Tax Claim Bureau, a Bureau
created by the Real Estate Tax Sale Law. 72 P.S. ~5860.1 01, 81 sic.

Pursuant to 72 P.S. ~5860.610, your Petitioner respectfully represents as
a.
Tax claim upon which the property was exposed for sale: 1986
through and Including 1992 Cumberland County, Cumberland
County Library, and Monroe Township real estate taxes. 1986-87
through and including 1992-93 Cumberland Valley school real
estate taxes. Total amount of claim, including penalty and Interest
as of date of tax sale: $45,822.22.

Neither the owner, his, her, their, or Its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or Its heirs, successors or legal representatives, or any other
person Interested, has caused stay of sale, discharge of tax claim or
removal from tax sale.

The property was exposed to public sale pursuant to 72 P.S.
~5860.601 on: September 30, 1993.
Before exposing the property to public sale the Bureau fixed the
upset sale price, pursuant to 72 P.S. ~5860.605, which upset price

AND NOW, comes the Cumberland County Tax Claim Bureau, by Its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this
Petition for Rule for Judicial Sale, of which the following Is a statement:
1, Your Petitioner Is the Cumberland County Tax Claim Bureau, a Bureau
created by the Real Estate Tax Sale Law, 72 P,S. ~5860,1 01, at sic.

Pursuant to 72 P.S, ~5860,610. your Petitioner respectfully represents as

Tax claim upon which the property was expo&ed for sale: 1987
through and including 1992 Cumberland County, Cumberland
County Library, and Mount Holly Springs Borough real estate taxes,
1987-88 through and Including 1992-93 Carlisle Area school real
estate taxes. Total amount of claim, including penalty and Interest
as of date of tax sale: $1,995.09,

Neither the owner, his, her, their, or its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or Its heirs, successors or legal representatives, or any other
person interested, has caused stay of sale, discharge of tax claim or
removal from tax sale.

The property was exposed to public sale pursuant to 72 P.S.
~5860,601 on: September 30, 1993.

Before exposing the property to public sale the Bureau fixed the
upset sale price, pursuant to 72 P.S. ~5860.605, which upset price
was $1,995.09.
