COMPLAINT
AND HOW COMBS the Plaintiff, Trudy L. Jones, by and through
her attorneys, Reager & Adler, PC, to state as follows:
1. Plaintiff, Trudy L. Jones, formerly known as Trudy L.
Mills (hereinafter "Jones"), is an adult individual residing at 228
Prowell Drive, Camp Hill, Cumberland County, Pennsylvania.
2. Defendant, William D. Mills (hereinafter "Mills"), is an
adult individual residing at Box 323, Chambersburg, Franklin
County, Pennsylvania.
3. Jones and Mills were married on January 31, 1970, in
Hagerstown, Maryland.
4. The natural son of Jones and Mills' marriage, Blaine D.
Mills, was born on August 5, 1978.
5. Due to irreconcilable differences, the parties separated
in October of 1988 and an eventual Decree in Divorce was issued by
Judge John R. Walker of the Court of Common Pleas of Franklin
County on August 30, 1989, a copy of which is attached hereto as
Exhibit "A".
6. Pursuant to a Property and Separation Agreement among the
parties dated August 24, 1989 (hereinafter the "Agreement"), a copy
of which is attached hereto as Exhibit "B", the parties sought to
resolve all economic issues in conjunction with their divorce.

7. The averments set forth in Paragraphs 1 through 6 above
are incorporated herein by reference.
8. In Paragraph 6 of the Agreement, Mills agreed to pay
Jones the sum of $15,000.00 on ~ October 31, 1989, and October
31, 1990, and October 31, 1991.
9. The first installment of $15,000.00 was received in or
about 1989 but due to alleged financial difficulties, Mills was
unable to make timely payment of his october 31, 1990, installment.
10. As evidenced by the letters of Mills' counsel, Lynn Y.
MacBride, Esquire, dated September 6, 1990, and that of Jones'
attorney, Bradley R. Bolinger, Esquire, dated September 14, 1990,
copies of which are respectively attached hereto as Exhibit "C",
the parties modified the payment schedule so that Mills was to make
payment of the remaining $30,000.00 in three equal installments of
$10,000.00 due on each June 1, 1991, June 1, 1992, and June 1,
1993.

11. Mills made his last Dartial payment under this Agreement
in or about August 1993 and as yet has not paid Jones $5,000.00
under the tsrms of this Agreement.
WBIRB~ORB, the Plaintiff respectfully requests this Honorable
Court to award the sum of $5,000.00 together with interest and
costs of this proceeding.

12. The averments set forth in Paragraphs 1 through 11 above
are incorporated herein by reference.
13. Pursuant to Paragraph 10 of the Agreement, Mills agreed
to pay Jones the sum of $50.00 per week for support of their child,
Blaine, beginning January 1, 1990, until Blaine obtained majority.
14. Mills has not made a weekly child support installment to
Jones since August of 1991.
WBBRBI'ORB, the Plaintiff respectfully requests that this
Honorable Court award her the sum of $6,900.00 representing child
support due under the terms of the Agreement together with interest
and costs of this proceeding.

MY. Mills has recently been in my office to discuss his payments as
per the parties' property and separatien agreement. MY. Mills Informs me
that at the present time he is experiencing financial difficulties. He is,
and has been, attlMpt Ing to sell several parcels of his real estate.
Ltlfortl.nately, he has been unable to sell any of these properties to date.
We appreciate I1I-s. Mills patience In this matter and to that regard
make the following proposal. MY. Mills would pay imnecUately to MYs. Mills
$720.00 interest en the overdue $12,000.00 payment. MY. Mills would pay to
I1I-s. Mills the 5UI1l of $12,000.00 en or before Decerrber 31, 1990. This
leaves a balance of $30,000.00 to be paid to MYs. Mills by MY'. Mills.
Because of MY. Mills financial difficulties we would propose that this
$30,000.00 be paid $10,000.00 per year over the next three (3) years, each
payment being due en or before June 1. That would mean a payment of
$10,000.00 en June 1, 1991, en June 1, 1992, and JLU'1e 1, 1993.

Dear Lynn:
I have reviewed your letter of September 6, 1990 with Mrs. Mills. She will
accept your proposal contained therein. Please have Mr. Mills pay the $720.00 to Mrs.
Mills within the next seven days. She will expect $12,000.00 on or before December
31, 1990. The remaining $30,000.00 can be paid $10,000.00 per year for three years
with each payment being due on or before June 1 of that year. She would expect her
first $10,000.00 payment on or before June 1, 1991.
Mrs. Mills Is trying to remain pallent And fair about this process. However, there
Is some concern on her part regarding her receipt of these payments. I urge your
client to aggressively markel the properties so Ihat they can be sold and this mailer
concluded. As long as these payments are oUlstanding there Is still an existing tie
between the parties. Mrs. Mills Is anxious to move on with her life, which Is difficult to
do until this matter Is concluded.

PRELIMINARY OBJECTIONS
NOW comes the Defendant. William D, Mills. by his attorney,
David C, Cleaver, of David C. Cleaver and Associales, P,C" and files
these Preliminary Objections 10 the Plaintiff's Complaint and says:
MOTION TO STRIKE
1.
Defendant moves to strike the Plaintiff's Complaint for failure to
conform to Rule of Court. Plaintiff has flied a legal action, which Ihe
Plaintiff has called an action in assumpsit, and has attempted service of
process upon the Defendant by the Plaintiff's attorney handing the
Defendant a Complaint at a Domestic Relations conference, This service
or process violates Pa, R,C.P, 400, which provides that original process
shall be served within the Commonwealth only by the Sheriff, Wherefore,
Defendant moves to strike Ihe Plaintiff's Complaint for failure to have
original process served by Ihe Sheriff has required by Rule of Court,
In addition, what Plaintiff's attorney served upon the Defendant
was a copy of a Complaint Plaintiff's attorney had prepared but had not
even flied, The copy of the Complaint served upon the Defendant had
not been flied, had no time stamp, and had no term or number.

This Court lacks proper venue of the subject matter of the
Plaintiff's Complaint. Plaintiff has filed a Complaint seeking damages for
breach of a contract which is attached to the Complaint as an exhibit.
The contract shows that at the time of the signing of the contract, the
parties were residents of Franklin Counly, Pennsylvania, The contract
was acknowledged in Franklin County, Pennsylvania, The Defendant, as
shown by Ihe Complaint, is a resident of Franklin County, Pennsylvania,
Pennsylvania Rule of Civil Procedure provides that an action
against an Individual may be brought in and only In a county in which he
may be served or In which the cause of action arose, or where a
transaction or occurrence took place out of which the cause of action
arose. The Defendant was nol properly served In Cumberland County for
reasons set forth in Preliminary Objection No, 1 above, The Defendant
resides in Franklin County, Pennsylvania, and may only be served in
Franklin County, Pennsylvania, Plaintiff's Complaint fails to plead any
transactions or occurrences that took place in Cumberland County,
Pennsylvania, and Plaintiff's Complaint Is devoid of any allegations which
indicate that proper venue lies in Cumberland County, Pennsylvania. On
the contrary, Plaintiffs Complaint shows that proper venue lies in Franklin
County, Pennsylvania,
WHEREFORE, Defendant prays Plaintiff's Complaint be stricken
for failure to comply with the Rules of Court as set forth above,
