Jones, by and through her attorneys, Reager & Adler, PC, to state as follows: 1. Plaintiff, Trudy L. Jones, formerly known as Trudy L. Mills (hereinafter "Jones"), is an adult individual residing at 228 Prowell Drive, Camp Hill, Cumberland County, Pennsylvania. 2. Defendant, William D. Mills (hereinafter "Mills"), is an adult individual residing at Box 323, Chambersburg, Franklin County, Pennsylvania. 3. Jones and Mills were married on January 31, 1970, in Hagerstown, Maryland. 4. The natural son of Jones and Mills' marriage, Blaine D. Mills, was born on August 5, 1978. 5. Due to irreconcilable differences, the parties separated in October of 1988 and an eventual Decree in Divorce was issued by Judge John R. Walker of the Court of Common Pleas of Franklin County on August 30, 1989, a copy of which is attached hereto as Exhibit "A". 6. Pursuant to a Property and Separation Agreement among the parties dated August 24, 1989 (hereinafter the "Agreement"), a copy of which is attached hereto as Exhibit "B", the parties sought to resolve all economic issues in conjunction with their divorce. comrr I 7. The averments set forth in Paragraphs 1 through 6 above are incorporated herein by reference. 8. In Paragraph 6 of the Agreement, Mills agreed to pay Jones the sum of $15,000.00 on ~ October 31, 1989, and October 31, 1990, and October 31, 1991. 9. The first installment of $15,000.00 was received in or about 1989 but due to alleged financial difficulties, Mills was unable to make timely payment of his october 31, 1990, installment. 10. As evidenced by the letters of Mills' counsel, Lynn Y. MacBride, Esquire, dated September 6, 1990, and that of Jones' attorney, Bradley R. Bolinger, Esquire, dated September 14, 1990, copies of which are respectively attached hereto as Exhibit "C", the parties modified the payment schedule so that Mills was to make payment of the remaining $30,000.00 in three equal installments of $10,000.00 due on each June 1, 1991, June 1, 1992, and June 1, 1993. 2 11. Mills made his last Dartial payment under this Agreement in or about August 1993 and as yet has not paid Jones $5,000.00 under the tsrms of this Agreement. Pursuant to Paragraph 10 of the Agreement, Mills agreed to pay Jones the sum of $50.00 per week for support of their child, Blaine, beginning January 1, 1990, until Blaine obtained majority. 14. Mills has not made a weekly child support installment to Jones since August of 1991.
