I IlQUITY COIIPLAIII'l' 1. plaintiff, Robert P. springer (hereinafter "springer"), is an adult individual who resides at 204 State Street, west Fairview, Cumberland County, Pennsylvania 17025. 2. Defendants, Stephen E. Moyer and Christopher M. Moyer (hereinafter collectively referred to as "Moyers") are adult individuals who are situate at 204 State Street, West Fairview, Cumberland County, Pennsylvania 17025. 3. Springer is the legal and title owner, as tenant at common, of a one-half divisible interest in the real property situate at 204 State Street. 4. The remaining one-half interest in said property is owned, as tenant at common, by the former spouse of Springer, Anna Mae B. springer. 5. Springer is in possession of the living quarters of the subject property along with his current spouse, Margaret Springer. 6. Moyers are the emancipated children of Margaret Springer from a prior marriage. . , . 7. Moyers have occupied and continue to occupy the subject property using it as a place of residence and habitation. 8. Moyers have no lease or tenancy with springer and do not pay springer any consideration whatsoever for such use. 9. Springer has repeatedly instructed the Moyers to cease using the subject property as a place of residence and habitation and to remove themselves and their property from it immediately. 10. Moyers have refused and continue to refuse to leave the subject property and have refused and continue to refuse to remove their property. 11. The said refusals by Moyers and continued use of the subject property without the permission of springer constitutes a continuing trespass against the subject property. WHEREFORE, Plaintiff prays this Court enter an Order enjoining Defendants from occupying the subject property, 204 State Street, West Fairview, Pennsylvania, for use as their place of residence and habitation to include: (a) a surrender of keys, if any, to the subject property in their possession; (~ no overnight stays at the subject property; (c) no consumption of food, without invitation, upon the property; (d) no showering or bathing upon the property; (e) no washing of clothes or laundry, including washing by third persons on their behalf, upon the property; - ,~.'~"".;.';>',i"~ .-- ~ . , . (f) the removal of all personal property located on the property; (g) stopping the delivery of all mail addressed to them at the subject property; (h) restricting their visitation with their mother to those periods when she is physically present at the subject property and between the hours of 9 a.m. to 10 p.m. each day.
