COMPLAINT
1. Plaintiffs, Roger Dixon and patricia Pope, are adult
individuals who currently reside at 1513 South 12th Street,
Harrisburg, Dauphin County, Pennsylvania 17104.
2. Defendant, Cuc Thu Ngo, is an adult individual currently
residing at 2142 North 6th Street, Harrisburg, Dauphin County,
Pennsylvania 17110,
3. On October 7, 1993, at approximately 5:55 p,m" a three-
vehicle accident occurred in the westbound lane of the Camp Hill
Bypass in Cumberland County, Pennsylvania.
4. At this time and place, Plaintiff Patricia Pope was
operating a 1984 Cutlass Ciera jointly owned by herself and
Plaintiff Roger Dixon.
5. At this time and place, Defendant Cuc Thu Ngo
negligently, carelessly, and recklessly collided with the vehicle
driven by Patricia Pope which was stopped in traffic at the time of
impact.
The collision caused by Cuc Thu Ngo in turn pushed
Patricia Pope into a third vehicle driven by William J. Strouse,
III.

7. Just prior to impact, patricia Pope was at a full stop
behind the vehicle driven by William J. Strouse, III, both vehicle
being stopped in traffic.
8. Thereafter, Defendant Cuc Thu Ngo hit the vehicle driven
by patricia Pope from behind.
9. As a direct and proximate result of the negligence,
carelessness, and recklessness of cuc Thu Ngo the Plaintiff
sustained property damage to their 1984 Cutlass Ciera.
10. The accident which occurred on October 7, 1993 and the
property damages sustained by the Plaintiffs was caused by the
negligence, carelessness, and recklessness of Defendant CUc Thu Ngo
which consisted of the following:
(a) failing to keep a proper lookout and to notice within a
reasonable time that Patricia Pope was stopped in front
of her and to avoid the accident with Plaintiffs'
vehicle;
(b) driving at an excessive rate of speed for the traffic and
other conditions there and then existing;
(c) failing to operate her vehicle in such a manner that it
could be controlled and brought to a stop within the
sight distance of the Defendant driver Cuc Thu Ngo in
violation of the Assured Clear Distance Ahead Rule 75
Pa.C.S.A. ~3361; and

(d) failing to avoid a rear-end accident with a vehicle
stopped ahead of her, which vehicle was driven by
patricia Pope.
11. The exact amount of loss to the Plaintiffs' property as
a direct and proximate resul t of the subj ect accident and the
negligence, carelessness, and recklessness of Defendant CUc Thu Ngo
totals $1,230.61.
WHEREFORE, Plaintiffs Roger Dixon and patricia Pope demand
judgment from the Defendant CUc Thu Ngo in the sum of $1,230.61,
together with interest and costs of this lawsuit,

MOTION TO CONSOLIDATE ACTIONS
AND NOW, come the Plaintiffs, Roger Dixon and patricia Pope,
by and through their attorneys, Caldwell & Kearns, and aver the
following, to wit:
1. On or about February 18, 1994, William J. Strouse, III,
filed a Pro Se Complaint against patricia Pope in Cumberland County
at docket No. 434 Civil 1994.
2. On or about March 21, 1994, defense counsel for Patricia
Pope, Deborah A, Cavacini, Esquire, joined Additional Defendant,
Cuc Thu Ngo, in the lawsuit docketed to No. 434 Civil 1994.
3. Thereafter, on or about March 24, 1994, Patricia Pope,
through Karl Januzzi, Esquire, commenced an action against Cuc Thu
Ngo for personal injuries, which lawsuit was filed in Cumberland
County and docketed to No, 1440 Civil 1994.
4, Finally, on April 13, 1994, a lawsuit for property damage
was asserted against Cue Thu Ngo by Patricia Pope and Roger Dixon,
as co-owners of the automobile driven by patricia Pope on the date

of the accident. The docket No. 1886 Civil 1994 was assigned by
the Court of Common Pleas of Cumberland County.
5. Defendant Cuc Thu Ngo has been represented by Scott D.
Moore, Esquire, in each lawsuit.
6. On or about May 17, 1994, Karl Januzzi, Esquire, filed a
Motion to Consolidate the lawsuits docketed to Nos, 434 Civil 1994
and 1440 Civil 1994, which Motion is attached hereto and
incorporated herein in its entirety. (The exhibits have been
omitted) .
7. William J. Strouse, III, submitted an Answer in
opposition to this Motion to Consolidate.
8. Actions 434 Civil 1994, 1440 Civil 1994 and 1886 Civil
1994 involve common questions of law and fact and arise from the
same transaction or occurrence, i. e., a motor vehicle accident
which occurred on October 7, 1993, in Camp Hill Borough, Cumberland
County, Pennsylvania.
9. It is believed and therefore averred that a consolidation
of all three actions will promote judicial economy and avoid
unnecessary costs and delay. Plaintiffs herein, Patricia Pope and
Roger Dixon, are prepared to proceed to an arbitration in this
matter, In addition, Patricia Pope, in her capacity as a
Defendant, is also prepared to proceed to the hearing in this
matter.

10. It is believed and therefore averred that if
consolidation is not ordered, an adjudication of anyone of the
three civil actions would act as res judicata or collateral
estoppel as to the remaining actions.
WHEREFORE, Plaintiffs respectfully requested that This
Honorable Court issue an Order pursuant to Rule 213 (a) of the
Pennsylvania Rules of Civil Procedure consolidating civil actions
434 Civil 1994, 1440 Civil 1994 and 1886 Civil 1994 in mandatory
arbitration.

3. The Plaintiff believes and therefore avers that
the above-referenced action, 434 Civil 1994, is in mandatory
arbitration due to the amount in controversy being less than
Twenty Five Thousand ($25,000) Dollars.
4. On or about March 21, 1994, the attorney defending
PATRICIA A, POPE in the Strouse action filed an Answer with
New Matter and an Additional Defendant Complaint, naming CUC
THU NGO as an additional defendant. A true and correct copy
of this Answer with New Matter and Additional Defendant
Complaint is attached hereto, incorporated by reference
herein and marked as Exhibit "C",
5. The above actions 1440 Civil 1994 and 434 Civil
1994 involve a common question of law and fact and arise
from the same transaction and occurrence, i, e, a motor
vehicle accident which occurred on October 7, 1993 in the
Borough of Camp Hill, Cumberland County, Pennsylvania.
6, The Plaintiff believes and therefore avers that a
consolidation of these actions will promote judicial economy
and avoid unnecessary costs and delay.
