WHEREAS, Carlisle Hospital and Health Services of Carlisle, Cumberland County,
Pennsylvania has entered into a contract, dated March 9, 1994, with R. S. Mowery & Sons,
Inc. of Carlisle, Pennsylvania, for the construction of Renovations For New Outpatient
Intermediate Care Unit and Alterations to Outpatient Procedures Area upon a lot of land
situate at 246 Parker Street, Carlisle, Cumberland County, Pennsylvania.
NOW, . April 12, 1994
, at the time of and immediately before the execution of
the principal contract, and before any authority has been given by the said Carlisle Hospital
and Health Services to the said R. S. Mowery & Sons, Inc. to commence work on the said
building, or purchase materials for the same in consideration of the making of the said
contract with R. S. Mowery & Sons, Inc. and the further consideration of One Dollar to R. S.
Mowery & Sons, Inc. paid by Carlisle Hospital and Health Services, it is agreed that no lien
shall be flied against the building or property by the contractor, or any subcontractor, nor by
any of the material men or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the construction of said building, the
right to file such liens being expressly waived.
