AND NOW, comes Plaintiff York Federal Savings and Loan
Association, by and through its attorney, Rebecca S. McClure, and
complains of Defendants Robert E. Karns and Cindy Karns, as
follows I
Parties
1. The Plaintiff is the YORK FEDERAL SAVINGS AND LOAN
ASSOCIATION, a corporation organized and existing under the laws of
the United States of America, and it is registered to do business
in Pennsylvania, with offices for the purpose of doing business at
101 South George Street, York, Pennsylvania.
2. The Defendants are ROBERT E. KARNS AND CINDY KARNS who
are husband and wife and are adult individuals residing in the
Mortgaged Premises at 344 Old Stonehouse Road, Boiling Springs,
Cumberland County, Pennsylvania 17007 and they are the mortgagors
and real owners of said Mortgaged Premises herein described, having
acquired title by Deed dated July 11, 1984, and recorded on July
23, 1984, in the Cumberland County, Pennsylvania, Recorder's Office
in Record Book U30, Page 638.

3. On or about July 19, 1984, Defendants made, executed, and
delivered to Plaintiff a mortgage upon premises therein described,
which Mortgage contains a description of the premises subject to
said Mortgage and was recorded on July 23, 1984 in the Cumberland
County, Pennsylvania, Recorder's Office in Mortgage Book 756, Page
942. A true and correct copy of said Mortgage is attached hereto,
made a part hereof, incorporated herein by reference, and marked
"EXHIBIT A".

There have been no assignments of said Mortgage.

Default
5. Said Mortgage is in default because Defendants have
failed to make the monthly payments of principal and interest due
and owing on their loan from June 1, 1992 through the date of
filing this Complaint as required by the terms of the Mortgage.
Any payments that may have been made during this period were
applied to the delinquency balance due and owing prior to June 1,
1992.
6. Plaintiff hereby exercises its option to declare the
entire amount owing upon said Mortgage immediately due and payable
in accordance with its terms and provisions.

Comoliance With Homeowners' Emeraencv Assistance Act
8. Notice of Defendants' rights under Pennsylvania'S
Homeowner's Emergency Assistance Act, Act of December 23, 1983,
P.L. 385, No. 91 (35 P.S. S 1680.401c et sea.), as amended, were
sent in accordance with said Act to Defendants Robert E. Karns and
Cindy Karns on March 2, 19947 and Defendants failed to exercise
their rights under said Act. A true and correct copy of each said
Notice is attached hereto, made a part hereof, incorporated
herein by reference, and marked "EXHIBIT B".
Inaoolicabilitv of Loan Interest and Protection Law
9. This Action is not subject to the provisions of
Pennsylvania'S Loan Interest and Protection Law, Act of January 30,
1974, P.L. 13, No.6 (41 P.S. S 101 et sea.), as amended, nor are
notices required to be sent to Defendants pursuant to said Act,
because said Mortgage is not a "residential mortgage" within the
meaning of said Act.
WHEREFORE, Plaintiff York Federal Savings and Loan Association
prays for judgment in its favor and against Defendants Robert E.
Karns and Cindy Karns in the amount of Seventy Thousand Two Hundred
Six and 62/100 Dollars ($70,206.62), with interest thereon until
paid at such rate or rates as established by Plaintiff pursuant to
the terms of the Adjustable Rate Note, currently $11.16 per diem,
from April 12, 1994, late charges at 5% of the monthly payment
amount, currently $25.09 per month from April 12, 1994, escrow
charges, currently $136.99 per month from April 12, 1994,
attorney's fees, costs of suit, and other charges collectible under
the Mortgage, for the foreclosure and sale of the mortgaged
premises, and for any and all other relief as the Court deems
appropriate.

to a steel pin set on the eastern side of a 10 foot wide public
alley~ thence extending along the eastern side of said alley, North
30 degrees 28 minutes West 111.90 feet to a steel pin set at the
eastern corner of the intersection of aforesaid alley with a 16
foot wide alley~ thence extending along the southern side of said

L.R. 21028, at its point of joinder with lands now or late of
Simmons; thence departing from the walk way and extending along
last mentioned lands, South 57 degrees 27 minutes West 147.01 feet
to a steel pin set on the eastern side of a 10 foot wide public
alley; thence extending along the eastern side of said alley, North
30 degrees 28 minutes West 111.90 feet to a steel pin set at the
eastern corner of the intersection of aforesaid alley with a 16
foot wide alley; thence extending along the southern side of said
16 foot wide public alley North 60 degrees 11 minutes East 150 feet
to a railroad spike set in the western side of aforesaid L.R.
21028; thence extending in and through the western edge of L.R.
21028 South 30 degrees 58 minutes East 104.72 feet to a point at
the concrete sidewalk; thence extending in and through said walk
South 57 degrees 27 minutes West 04 feet to a steel pin set in said
concrete walk; said pin marking the place of BEGINNING.

by Rodney Lee Decker and Associates dated October 19, 1976.

Proof of Publication of Notice in Cumberland Law
Journal
(Under Act No. 587, Approved May 16, 1929), P.L. 1784
Roger M. Morgenthal, Esquire, Editor of the Cumberland Law
Journal, of the County and State aforesaid, being duly sworn, according to law,
deposes and says that the Cumberland Law Journal, a legal periodical
published in the Borough of Carlisle in the County and State aforesaid, was
established January 2, 1952, and designated by the local courts as the official
legal periodical for the publication of all legal notices, and has since January 2,
1952, been regularly issued weekly in said County, and that the printed notice
or publication attached hereto is exactly the same as was printed In the regular
editions and issues of the said Cumberland Law Journal on the following dates,
viz:
JULY 15.22.29. 1994
Affiant further deposes that he Is authorized to verify this statement by the
Cumberland Law Journal, a legal periodical of general circulation, and that he
