AND NOW, this 30th day of June, 1994, based on
that testimony I am satisfied that the Defendant has violated
the protection from abuse order which I issued on April 14th,
1994. I find him guilty of indirect criminal contempt.
Sentence of the Court is the Defendant be placed in
the Cumberland County Prison for not less than forty-five days
nor more than three months, sentence to date from yesterday when
he was placed in the prison.
The Defendant may be paroled from the Cumberland
County Prison without further order of this Court, unless I
change it, upon serving the forty-five days in jail.

I. On June 30, 1994 Defendant was found guilty to criminal contempt and
was sentenced to 45 days to no rr.ore than three months In Cumberland County Prison.
2. It was ruled that Defendant had violated the protection from abuse order
Issued on AprIl 14th, 1994.
3. For the reasons stated below, Defendant respectfully requests this Court
to modify his sentence to the amount of time actually served to date:
A. Defendant's violation of the protection order did not Involve any violence
or threat of violence to any Individual.
B. Defendant has and will continue seeking help for his alcohol problem.
C. Defendant will seek help from a qualified counclllng organIzation to
reso 1 ve Ii s separat Ion prob lems.
D. Defendant Is being harmed greatly by his Incarceration. preventing him
trom maintaining gainful employment.
E. Defendant Is unable to comply with is obligations for chIld support
without gainful employment.
F. Defendant will suffer great financial problems from continued Incarceration
which will hinder his recovery.
CONCLUSION: Defendant asks for modifIcation and reduction of sentence.

1. This Court's Order of May 23, 1994, shall remain in effect
subject to the modifications below.
2. The Father shall continue to have supervised visitation with
the minor children at the Carlisle YWCA or at some other
facility as agreed upon by the parties. In the event the
supervised visitation requires the payment of any fees,
Father will be responsible for the payment of those fees.
It is anticipated that upon Father's completion of three
months of the supervised visitation schedule he will be
afforded some period of unsupervised time with the children.
3. In the event either party becomes dissatisfied with the
custody situation, that party may petition the Court to
have the case again scheduled before the Custody Conciliator.

MEMORANDUM OPINION AND ORDER OF COURT
A contempt hearing on a protection from abuse order
which I issued on April 14th, 1994, was held today. On April
14th the order that I issued among other things stated that the
Defendant was excluded from the residence of the parties at 25
Firehouse Road, Walnut Bottom, Cumberland County, Pennsylvania,
a jointly-owned residence.
At the hearing today Mrs. Barnhart testified that
around 2:30 in the morning Mr. Barnhart drove up in the driveway
and tried to open up a garage door and other doors. She then
called the police. The police initially were not able to locate
the Defendant but while they were looking for him they received
another call indicating that he was at the residence.
They returned to the residence and when they arrived
there the Defendant was backing his car out of the driveway of
the premises at 25 Firehouse Road, Walnut Bottom, Cumberland
county, Pennsylvania.

Harold E. Sheeley, regarding Defendant's Petition for a
Protective Order and custody, which matter is still pending with
the Court.
Plaintiff does not know of any person not a party to the
proceedings who has physical custody of the children or claims to
have custody or visitation riqhts with respect to the children.
7. The best interest and permanent welfare of the children
will be served by qranting the relief requested because:
A) Plaintiff is the natural father of Matthew A.
Barnhart and has been John Barnhart's step-father for a period of
14 years.
B) The children should have reqular periods of partial
custody with the Plaintiff.
8. Each parent whose parental rights to the children have
not been terminated and the person who has physical custody of
the children have been named as parties to this action.
WHEREFORE, Plaintiff requests the Court to qrant him partial
custody of the children.

MEMORANDUM OPINION AND ORDER OF COURT
A hearing was held today on an alleged violation of a
protection from abuse order issued by me on April 14, 1994.
Specifically the order provided that the Defendant is ordered to
refrain from having any contact with the Plaintiff.
Plaintiff testified at this hearing today that on May
3rd, 1994, the Defendant called her on the telephone ten times
and on May 14th, 1994, again called her. The Defendant did not
testify at the proceeding today.
The Court accepts the testimony of the Plaintiff as
being credible and honest. The Defendant was arrested today at
his place of employment and has been in custody from that time
until the time of this hearing.
ORDER OF COURT
AND NOW, this 16th day of May, 1994, the Court
finds that the Defendant has violated the protective order
previously issued, and the Court finds the Defendant guilty of
indirect criminal contempt of court.
He is sentenced to Cumberland County Prison for not

The plaintiff moves this Court for an Order continuing the
hearing of this case until further Order of Court, on the grounds
that:
1. A Temporary Protective Order was issued by this Court on
the 14th day of April, 1994, scheduling a hearing for the 18th
day of April, 1994, at 9:15 a.m.
2. A copy of the Order was given to the Cumberland county
Sheriff to serve upon the defendant. The sheriff's department
attempted to make service at the defendant's home, but were not
able to make service.
3. The sheriff's department will need to deputize Franklin
County to make service upon the defendant at his place of
employment.
4. A copy of the Order for continuance will be delivered to
the appropriate police departments with jurisdiction to cover the
plaintiff's home and place of employment, by attorneys for the

finding that the plaintiff, Kay V. Barnhart, and her minor
children, now residing at an undisclosed location, are in
immediate and present danger of abuse from the defendant, Michael
D. Barnhart, the following Temporary Order is entered.
The defendant, Michael D. Barnhart, now residing at 25
Firehouse Road, Walnut Bottom, Cumberland county, Pennsylvania,
is hereby enjoined from physically abusing the plaintiff, Kay V.
Barnhart, or her children, or placing them in fear of abuse and
is excluded from the residence located at 25 Firehouse Road,
Walnut Bottom, Cumberland county, Pennsylvania, a residence which
is jointly owned by the parties. The defendant is hereby
notified that if he resides in the plaintiff's domicile contrary
to this order, he may be in indirect criminal contempt which is
punishable by a fine not to exceed $l,OOO.OO and/or by a sentence
of up to six months in jail and any other appropriate punishment.
Resumption of co-residence on the part of the plaintiff and
defendant shall not nullify the provisions of the court order

without unnecessary delay before the court that issued the Order.

23 P.S. SECTION 6101
A. ABUSE
1. The plaintiff is an adult individual whose permanent
address is 25 Firehouse Road, Walnut Bottom, Cumberland county,
Pennsylvania. The plaintiff brings this action for herself and
on behalf of her minor children.
2. The plaintiff is temporarily staying at an undisclosed
location for her own protection and to avoid further abuse as is
more fully set forth herein. This address will be furnished to
the court upon request.
3. The defendant is an adult individual residing at 25
Firehouse Road, Walnut Bottom, Cumberland county, Pennsylvania.
4. The defendant is the plaintiff's husband and father of
the minor children.
5. Since approximately April 1989 the defendant has
attempted to cause and has intentionally, knowingly, or
recklessly caused bodily injury, to the plaintiff and her
children and by physical menace has placed the plaintiff and her
children in fear of imminent serious bodily injury. This has
included but is not limited to the following specific instances
of abuse:
a. On or around April 10, 1994, when the plaintiff and her
children arrived at the parties' home, the defendant phoned the
plaintiff, harassed her, and threatened her saying, "You'll get
yours." Fearing that the defendant was coming to the home to
harm her and the children, the plaintiff left her residence and
stayed at an undisclosed location.
b. In or around April 8, 1994, while screaming
obsecenities at the plaintiff, the defendant used his body to
forcefully move the plaintiff out of his way. Fearing for her
safety, the plaintiff left the residence.
c. On or around April 7, 1994, the defendant threw the
dining room table across the room, grabbed the parties seventeen
year old son and forcefully shoved him backwards into the freezer
door. When the boy tried to leave the room, the defendant
grabbed the boy with both hands and restrained him. The
defendant then grabbed the boy by his hair and yanked his head
backwards.
d. In or around November 1993, through the present, the
defendant picked up the parties' twelve year old son, and threw
him across the room on at least two separate occasions.
e. In or around February 1993 through the present, on
several occasions and at times on a daily basis the defendant has
pushed, shoved, slapped, grabbed, and choked the plaintiff or
thrown things at her and the minor children.
f. In or around April 1989 through February 1993, the

defendant has on several occasions, slapped, shoved, and
threatened to harm the plaintiff.
6. On or about April 10, 1994 the plaintiff and her two
children left their residence at 25 Firehouse Road, Walnut
Bottom, Cumberland County, Pennsylvania in order to avoid further
abuse.
7. The plaintiff believes and therefore avers that she and
her children are in immediate and present danger of abuse from
the defendant should she return to the home with her children and
that she and her children are in need of protection from such
abuse.
8. The plaintiff desires that the defendant be restrained
from entering her place of employment, and that he further be
restrained from entering the school of the minor children or
having any contact with her, harassing or stalking the plaintiff
or plaintiff's relatives, or the minor children.
B. TEMPORARY CUSTODY
9. The plaintiff seeks temporary custody of the following
children:

The children were not born out of wedlock.
The children are presently in the custody of Kay V. Barnhart
who is currently residing at an undisclosed location.
During the past five years, the children have resided with
the following persons and at the following addresses:

plaintiff currently resides with the following persons:

10. The plaintiff has not previously participated in any
litigation concerning custody of the above mentioned children in
this or any other Court.
11. The plaintiff has no knowledge of any custody
proceedings concerning these children pending before a court in
this or any other jurisdiction.
12. The plaintiff does not know of any person not a party
to this action who has physical custody of the children or claims
to have custody or visitation rights with respect to the
children.
13. The best interests and permanent welfare of the
children will be met if custody is temporarily granted to the
plaintiff pending a hearing in this matter for reasons including:
a. The plaintiff is a fit parent who can best take
care of her children.
b. The defendant has shown by his abuse of the
petitioner that he is not an appropriate role model for
the children.
c. The children have been adversely affected
by the defendants abusive behavior.
C. EXCLUSIVE POSSESSION
14. The home from which the plaintiff is asking the Court
to exclude the defendant is owned in the names of Michael D.
Barnhart and Kay V. Barnhart.
15. The plaintiff currently has no place to stay with her
children except the marital home, and the defendant has family
and friends in the area with whom he can stay.
16. The plaintiff desires possession of the home, so as to
give the greatest degree of continuity to the lives of the
children and to allow them to continue their education at their
schools and to continue their school and social activities.
D. SUPPORT. SECTION
17. The defendant has a duty to support the plaintiff and
their minor children.
18. The defendant is employed at Reynolds and Reynolds,
Hood and Commerce Roads, Chambersburg, Pennsylvania and has
annual salary in excess of $27,000.
19. The plaintiff's income is insufficient to provide for
her minimal needs and those of her children until such time as a
support order can be obtained by filing at the Domestic Relations
Office.
20. The plaintiff intends to petition for support within
two weeks of the issuance of a protective order.
E. LOSSES
21. The plaintiff asks for attorney fees to be paid to
Legal Services, Inc., pursuant to the Protection from Abuse Act.
F. STATUS TO PROCEED IN FORMA PAUPERIS
22. The defendant is employed at Reynolds and Reynolds,
Hood and Commerce roads, Chambersburg, Pennsylvania, and has a
yearly salary in excess of $27,000.00.
23. The plaintiff currently is employed at Lee McBeth and
sons, and is a substitute bus driver. since the plaintiff is a
substitute her income is sporadic.
24. The plaintiff does not have funds available to pay the
fees for filing and service.
WHEREFORE, pursuant to the provisions of the IIprotection
from Abuse Act" of October 7, 1976, 23 P.S. Section 6101 n JI.I.g.,
as amended, the plaintiff prays this Honorable Court to grant the
following relief:
A. Grant a Temporary Order pursuant to the "Protection from
Abuse Act:1I
1. Requiring the defendant to refrain from abusing the
plaintiff and her minor children or placing them in fear of
abuse.
2. Requiring the defendant to refrain from having any
contact with the plaintiff, including, but not limited to,
entering the place of employment, and that he further
refrain from entering the school's of the minor children,
and from harassing or stalking the plaintiff.
3. Requiring the defendant to refrain from harassing
or stalking the plaintiff's relatives or minor children.
4. Granting temporary custody of the minor children
to the plaintiff;
5. Granting possession of the home located at 25
Firehouse Road, Walnut Bottome, Pennsylvania, to the
plaintiff to the exclusion of the defendant pending a final
order in this matter;
6. Ordering the defendant to stay away from the
residence located at 25 Firehouse Road, Walnut Bottom
Pennsylvania.
7. Ordering the defendant to stay away from any
residence the plaintiff may in the future establish for
herself; and
B. Schedule a hearing in accordance with the provisions of
the "Protection from Abuse Act," and, after such hearing, enter
an order to be in effect for a period of one year:
1. Requiring the defendant to refrain from abusing the
plaintiff or her minor children or placing them in fear of
abuse.
2. Requiring the defendant to refrain from having any
contact with the plaintiff, including, but not limited to,
restraining the defendant from entering the place of
employment of the plaintiff and to further refrain from
entering the schools of the minor children harassing or
stalking the plaintiff.
3. Requiring the defendant to refrain from harassing
or stalking the plaintiff's relatives or the minor
children.
4. Granting possession of the home located at 25
Firehouse Road, Walnut Bottome, Pennsylvania to the
plaintiff to the exclusion of the defendant.
5. ordering the defendant to stay away from the
residence located at 25 Firehouse Road, Walnut Bottom,
pennsyvlania.
6. Ordering the defendant to stay away from any
residence the plaintiff may in the future establish for
herself.
7. Granting support to the plaintiff in the amount of
$258.25 per week payable by mail.
8. Ordering the defendant to pay the plaintiff's
attorney's fees, to Legal Services, Inc., pursuant to the
Protection From Abuse Act.
The plaintiff further asks that this Petition be filed and
served without payment of costs, pending a further order at the
hearing, and that a copy of this Petition and Order be delivered
to the appropriate Police Departments as the Police Departments
with jurisdiction to enforce this Order.
The plaintiff prays for such other relief as may be just and
proper.

CUSTODY UNDER PENNSYLVANIA CUSTODY LAW
1. The allegations of Count I above are incorporated herein
as if fully set forth.
2. The best interests and permanent welfare of the children
will be served by confirming custody in the plaintiff as set

INSTRUCTIONS TO THE DEFENDANT
As you know. the plaintiff has filed a legal action against you under the
Protection From Abuse Act and has obtained a Temporary Protective Order. The
plaint iff is prepared to have a hearing held in order to obtain a Final
Protective Order effective for one (I) year.
As an alternative, you IIIIlY consent to the entry of the Final Protective
Order to be in effect for one year. If you are willing to consent you should
call Legal Services, Inc., 243-9400 or 766-8475, and ask to speak to the staff
person handling the case about a Consent Agreement.
The Consent Agreement should be prepared before the time scheduled for the
hearing so the Court will know ahead of time that the case will not be contested.
In most cases. regardless of whether a settlement by Consent Agreement has been
reached, the parties must appear in court at the time scheduled for hearing. If
the case is uncontested, the court appearance will be brier. The judge will make
sure the parties understand the Consent Agreement and Final Protective Order.
If you do not agree to the entry of the Final Protective Order, a contested
hearing will take place at the scheduled time. When a Final Protective Order is

directing the defendant to refrain from abusing the plaintiff or

A. ABUSE
1. The plaintiff is an adult individual whose permanent
address is 25 Firehouse Road, Walnut Bottom, Cumberland county,
Pennsylvania. The plaintiff brings this action for herself and
on behalf of her minor children.
2. The plaintiff is temporarily staying at an undisclosed
location for her own protection and to avoid further abuse as is
more fully set forth herein. This address will be furnished to
the court upon request.
3. The defendant is an adult individual residing at 25
Firehouse Road, Walnut Bottom, Cumberland county, Pennsylvania.
4. The defendant is the plaintiff's husband and father of
the minor children.
5. Since approximately April 1989 the defendant has
attempted to cause and has intentionally, knowingly, or
recklessly caused bodily injury, to the plaintiff and her
children and by physical menace has placed the plaintiff and her
children in fear of imminent serious bodily injury. This has
included but is not limited to the following specific instances
of abuse:
a. On or around April 10, 1994, when the plaintiff and her
children arrived at the parties' home, the defendant phoned the
plaintiff, harassed her, and threatened her saying, "You'll get
yours." Fearing that the defendant was coming to the home to
harm her and the children, the plaintiff left her residence and
stayed at an undisclosed location.
b. In or around April 8, 1994, while screaming
obsecenities at the plaintiff, the defendant used his body to
forcefully move the plaintiff out of his way. Fearing for her
safety, the plaintiff left the residence.
c. On or around April 7, 1994, the defendant threw the
dining room table across the room, grabbed the parties seventeen
year old son and forcefully shoved him backwards into the freezer
door. When the boy tried to leave the room, the defendant
grabbed the boy with both hands and restrained him. The
defendant then grabbed the boy by his hair and yanked his head
backwards.
d. In or around November 1993, through the present, the
defendant picked up the parties' twelve year old son, and threw
him across the room on at least two separate occasions.
e. In or around February 1993 through the present, on
several occasions and at times on a daily basis the defendant has
pushed, shoved, slapped, grabbed, and choked the plaintiff or
thrown things at her and the minor children.
f. In or around April 1989 through February 1993, the

defendant has on several occasions, slapped, shoved, and
threatened to harm the plaintiff.
6. On or about April 10, 1994 the plaintiff and her two
children left their residence at 25 Firehouse Road, Walnut
Bottom, Cumberland county, Pennsylvania in order to avoid further
abuse.
7. The plaintiff believes and therefore avers that she and
her children are in immediate and present danger of abuse from
the defendant should she return to the home with her children and
that she and her children are in need of protection from such
abuse.
8. The plaintiff desires that the defendant be restrained
from entering her place of employment, and that he further be
restrained from entering the school of the minor children or
having any contact with her, harassing or stalking the plaintiff
or plaintiff's relatives, or the minor children.
B. TEMPORARY CUSTODY
9. The plaintiff seeks temporary custody of the fOllowing

10. The plaintiff has not previously participated in any
litigation concerning custody of the above mentioned children in
this or any other Court.
11. The plaintiff has no knowledge of any custody
proceedings concerning these children pending before a court in
this or any other jurisdiction.
12. The plaintiff does not know of any person not a party
to this action who has physical custody of the children or claims
to have custody or visitation rights with respect to the
children.
13. The best interests and permanent welfare of the
children will be met if custody is temporarily granted to the
plaintiff pending a hearing in this matter for reasons including:
a. The plaintiff is a fit parent who can best take
care of her children.
b. The defendant has shown by his abuse of the
petitioner that he is not an appropriate role model for
the children.
c. The children have been adversely affected
by the defendants abusive behavior.
C. EXCLUSIVE POSSESSION
14. The home from which the plaintiff is asking the Court
to exclude the defendant is owned in the names of Michael D.
Barnhart and Kay V. Barnhart.
15. The plaintiff currently has no place to stay with her
children except the marital home, and the defendant has family
and friends in the area with whom he can stay.
16. The plaintiff desires possession of the home, so as to
give the greatest degree of continuity to the lives of the
children and to allow them to continue their education at their
schools and to continue their school and social activities.
D. SUPPORT. SECTION
17. The defendant has a duty to support the plaintiff and
their minor children.
18. The defendant is employed at Reynolds and Reynolds,
Hood and Commerce Roads, Chambers burg , Pennsylvania and has
annual salary in excess of $27,000.
19. The plaintiff's income is insufficient to provide for
her minimal needs and those of her children until such time as a

Office.
20. The plaintiff intends to petition for support within
two weeks of the issuance of a protective order.
E. LOSSES
21. The plaintiff asks for attorney fees to be paid to
Legal Services, Inc., pursuant to the Protection from Abuse Act.
F. STATUS TO PROCEED IN FORMA PAUPERIS
22. The defendant is employed at Reynolds and Reynolds,
Hood and Commerce roads, chambersburg, Pennsylvania, and has a
yearly salary in excess of $27,000.00.
23. The plaintiff currently is employed at Lee McBeth and
Sons, and is a substitute bus driver. since the plaintiff is a
substitute her income is sporadic.
24. The plaintiff does not have funds available to pay the
fees for filing and service.
WHEREFORE, pursuant to the provisions of the "Protection
from Abuse Act" of October 7, 1976, 23 P.S. section 6101 n ~.,
as amended, the plaintiff prays this Honorable Court to grant the
following relief:
A. Grant a Temporary Order pursuant to the "Protection from
Abuse Act:"
1. Requiring the defendant to refrain from abusing the
plaintiff and her minor children or placing them in fear of
abuse.
2. Requiring the defendant to refrain from having any
contact with the plaintiff, including, but not limited to,

the "Protection from Abuse Act," and, after such hearing, enter
an order to be in effect for a period of one year:

plaintiff or her minor children or placing them in fear of
abuse.

contact with the plaintiff, including, but not limited to,

5. Ordering the defendant to stay away from the
residence located at 25 Firehouse Road, Walnut Bottom,
pennsyvlania.
6. Ordering the defendant to stay away from any
residence the plaintiff may in the future establish for
herself.
7. Granting support to the plaintiff in the amount of
$258.25 per week payable by mail.
8. ordering the defendant to pay the plaintiff's
attorney's fees, to Legal Services, Inc., pursuant to the
Protection From Abuse Act.
The plaintiff further asks that this Petition be filed and
served without payment of costs, pending a further order at the
hearing, and that a copy of this Petition and Order be delivered
to the appropriate Police Departments as the Police Departments
with jurisdiction to enforce this Order.
The plaintiff prays for such other relief as may be just and
proper.

1. The allegations of Count I above are incorporated herein
as if fully set forth.
2. The best interests and permanent welfare of the children
will be served by confirming custody in the plaintiff as set

WHEREFORE, pursuant to 23 P.S. Section 5301 ~ ~., and
other applicable rules and law, the plaintiff prays this
Honorable Court to award custody of the minor child(ren) to her.

The Defendant violated an order issued under the Protection From Abuse Act,Nurnber 94-1901,
civil 1994,April 14,1994, issued by the Court of Common Pleas of Cumberland County.
This order prohibits the defendant from having any contact whatsoever with the Plaintiff,
and from harassing the Plaintiff.
PROBABLE CAUSE AFFIDAVIT: The defendant did repeatedly call the victim for a period of
approx. one hour and harass and yell at the victim in doing so. This officer also
listened to the defendant on a seperate phone line as he spoke to the victim.
