P.J. MEMORANDUM OPINION AND ORDER OF COURT A contempt hearing on a protection from abuse order which I issued on April 14th, 1994, was held today. On April 14th the order that I issued among other things stated that the Defendant was excluded from the residence of the parties at 25 Firehouse Road, Walnut Bottom, Cumberland County, Pennsylvania, a jointly-owned residence. At the hearing today Mrs. Barnhart testified that around 2:30 in the morning Mr. Barnhart drove up in the driveway and tried to open up a garage door and other doors. She then called the police. The police initially were not able to locate the Defendant but while they were looking for him they received another call indicating that he was at the residence. They returned to the residence and when they arrived there the Defendant was backing his car out of the driveway of the premises at 25 Firehouse Road, Walnut Bottom, Cumberland county, Pennsylvania. Specifically the order provided that the Defendant is ordered to refrain from having any contact with the Plaintiff. Plaintiff testified at this hearing today that on May 3rd, 1994, the Defendant called her on the telephone ten times and on May 14th, 1994, again called her. The Defendant did not testify at the proceeding today. The Court accepts the testimony of the Plaintiff as being credible and honest. The Defendant was arrested today at his place of employment and has been in custody from that time until the time of this hearing. ORDER OF COURT AND NOW, this 16th day of May, 1994, the Court finds that the Defendant has violated the protective order previously issued, and the Court finds the Defendant guilty of indirect criminal contempt of court. The defendant is the plaintiff's husband and father of the minor children. 5. Since approximately April 1989 the defendant has attempted to cause and has intentionally, knowingly, or recklessly caused bodily injury, to the plaintiff and her children and by physical menace has placed the plaintiff and her children in fear of imminent serious bodily injury. This has included but is not limited to the following specific instances of abuse: a. On or around April 10, 1994, when the plaintiff and her children arrived at the parties' home, the defendant phoned the plaintiff, harassed her, and threatened her saying, "You'll get yours." Fearing that the defendant was coming to the home to harm her and the children, the plaintiff left her residence and stayed at an undisclosed location. b. In or around April 8, 1994, while screaming obsecenities at the plaintiff, the defendant used his body to forcefully move the plaintiff out of his way. Fearing for her safety, the plaintiff left the residence. c. On or around April 7, 1994, the defendant threw the dining room table across the room, grabbed the parties seventeen year old son and forcefully shoved him backwards into the freezer door. When the boy tried to leave the room, the defendant grabbed the boy with both hands and restrained him. The defendant then grabbed the boy by his hair and yanked his head backwards. d. In or around November 1993, through the present, the defendant picked up the parties' twelve year old son, and threw him across the room on at least two separate occasions. e. In or around February 1993 through the present, on several occasions and at times on a daily basis the defendant has pushed, shoved, slapped, grabbed, and choked the plaintiff or thrown things at her and the minor children. f. The plaintiff believes and therefore avers that she and her children are in immediate and present danger of abuse from the defendant should she return to the home with her children and that she and her children are in need of protection from such abuse. 8. The plaintiff desires that the defendant be restrained from entering her place of employment, and that he further be restrained from entering the school of the minor children or having any contact with her, harassing or stalking the plaintiff or plaintiff's relatives, or the minor children. B. TEMPORARY CUSTODY 9. The plaintiff seeks temporary custody of the following children: John D. Barnhart Undisclosed Location Matthew A. Barnhart Undisclosed Location The children were not born out of wedlock. The children are presently in the custody of Kay V. Barnhart who is currently residing at an undisclosed location. The plaintiff does not know of any person not a party to this action who has physical custody of the children or claims to have custody or visitation rights with respect to the children. 13. The best interests and permanent welfare of the children will be met if custody is temporarily granted to the plaintiff pending a hearing in this matter for reasons including: a. The plaintiff is a fit parent who can best take care of her children. b. The defendant has shown by his abuse of the petitioner that he is not an appropriate role model for the children. c. The children have been adversely affected by the defendants abusive behavior. C. EXCLUSIVE POSSESSION 14. The home from which the plaintiff is asking the Court to exclude the defendant is owned in the names of Michael D. Barnhart and Kay V. Barnhart. 15. The plaintiff currently has no place to stay with her children except the marital home, and the defendant has family and friends in the area with whom he can stay. 16. The plaintiff desires possession of the home, so as to give the greatest degree of continuity to the lives of the children and to allow them to continue their education at their schools and to continue their school and social activities. D. SUPPORT. SECTION 17. The defendant has a duty to support the plaintiff and their minor children. 18. The defendant is employed at Reynolds and Reynolds, Hood and Commerce Roads, Chambersburg, Pennsylvania and has annual salary in excess of $27,000. 19. The plaintiff's income is insufficient to provide for her minimal needs and those of her children until such time as a support order can be obtained by filing at the Domestic Relations Office. 20. The plaintiff intends to petition for support within two weeks of the issuance of a protective order. E. LOSSES 21. The plaintiff asks for attorney fees to be paid to Legal Services, Inc., pursuant to the Protection from Abuse Act. F. STATUS TO PROCEED IN FORMA PAUPERIS 22. The defendant is employed at Reynolds and Reynolds, Hood and Commerce roads, Chambersburg, Pennsylvania, and has a yearly salary in excess of $27,000.00. 23. The plaintiff currently is employed at Lee McBeth and sons, and is a substitute bus driver. since the plaintiff is a substitute her income is sporadic. 24. ABUSE 1. The plaintiff is an adult individual whose permanent address is 25 Firehouse Road, Walnut Bottom, Cumberland county, Pennsylvania. The plaintiff brings this action for herself and on behalf of her minor children. 2. The plaintiff is temporarily staying at an undisclosed location for her own protection and to avoid further abuse as is more fully set forth herein. This address will be furnished to the court upon request. 3. The defendant is an adult individual residing at 25 Firehouse Road, Walnut Bottom, Cumberland county, Pennsylvania. 4. The defendant is the plaintiff's husband and father of the minor children. 5. Since approximately April 1989 the defendant has attempted to cause and has intentionally, knowingly, or recklessly caused bodily injury, to the plaintiff and her children and by physical menace has placed the plaintiff and her children in fear of imminent serious bodily injury. This has included but is not limited to the following specific instances of abuse: a. On or around April 10, 1994, when the plaintiff and her children arrived at the parties' home, the defendant phoned the plaintiff, harassed her, and threatened her saying, "You'll get yours." Fearing that the defendant was coming to the home to harm her and the children, the plaintiff left her residence and stayed at an undisclosed location. b. In or around April 8, 1994, while screaming obsecenities at the plaintiff, the defendant used his body to forcefully move the plaintiff out of his way. Fearing for her safety, the plaintiff left the residence. c. On or around April 7, 1994, the defendant threw the dining room table across the room, grabbed the parties seventeen year old son and forcefully shoved him backwards into the freezer door. When the boy tried to leave the room, the defendant grabbed the boy with both hands and restrained him. The defendant then grabbed the boy by his hair and yanked his head backwards. d. In or around November 1993, through the present, the defendant picked up the parties' twelve year old son, and threw him across the room on at least two separate occasions. e. In or around February 1993 through the present, on several occasions and at times on a daily basis the defendant has pushed, shoved, slapped, grabbed, and choked the plaintiff or thrown things at her and the minor children. f. In or around April 1989 through February 1993, the .. ~ defendant has on several occasions, slapped, shoved, and threatened to harm the plaintiff. 6. On or about April 10, 1994 the plaintiff and her two children left their residence at 25 Firehouse Road, Walnut Bottom, Cumberland county, Pennsylvania in order to avoid further abuse. 7. The plaintiff believes and therefore avers that she and her children are in immediate and present danger of abuse from the defendant should she return to the home with her children and that she and her children are in need of protection from such abuse. 8. The plaintiff desires that the defendant be restrained from entering her place of employment, and that he further be restrained from entering the school of the minor children or having any contact with her, harassing or stalking the plaintiff or plaintiff's relatives, or the minor children. The plaintiff has not previously participated in any litigation concerning custody of the above mentioned children in this or any other Court. 11. The plaintiff has no knowledge of any custody proceedings concerning these children pending before a court in this or any other jurisdiction. 12. The plaintiff does not know of any person not a party to this action who has physical custody of the children or claims to have custody or visitation rights with respect to the children. 13. The best interests and permanent welfare of the children will be met if custody is temporarily granted to the plaintiff pending a hearing in this matter for reasons including: a. The plaintiff is a fit parent who can best take care of her children. b. The defendant has shown by his abuse of the petitioner that he is not an appropriate role model for the children. c. The children have been adversely affected by the defendants abusive behavior. C. EXCLUSIVE POSSESSION 14. The home from which the plaintiff is asking the Court to exclude the defendant is owned in the names of Michael D. Barnhart and Kay V. Barnhart. 15. The plaintiff currently has no place to stay with her children except the marital home, and the defendant has family and friends in the area with whom he can stay. 16. The plaintiff desires possession of the home, so as to give the greatest degree of continuity to the lives of the children and to allow them to continue their education at their schools and to continue their school and social activities. D. SUPPORT. SECTION 17. The defendant has a duty to support the plaintiff and their minor children. 18. The defendant is employed at Reynolds and Reynolds, Hood and Commerce Roads, Chambers burg , Pennsylvania and has annual salary in excess of $27,000. 19.
