At a pretrial conference held Wednesday, December 27,
1995, before the Honorable Harold E, Sheely, President Judge,
present for the Plaintiff was Monica E. Baturin, Esquire;
however, her father, Floyd M. Baturin, Esquire, will probably be
trying this case, and present for the Defendant was Michael J,
Hanft, Esquire.
This is a non-jury trial which should take no more
than one day to complete, probably less than that. Judge Hoffer
will be setting the trial date for this case.
Plaintiff and Defendant entered into a written
agreement whereby the Plaintiff was to do drywall work at a job
site located at 920 North Front Street, Wormleysburg,
Pennsylvania. After the Plaintiff had started the work, the
Defendant discharged him and apparently had a brother-in-law
take over and finish the job.
The total contract price was $6,000.00, and the
Defendant has paid the Plaintiff $2,000,00. The Plaintiff
claims that his profit would have been $1,800.00 if he would
have been permitted to complete the job, and that is the claim

he is making in this case,
Plaintiff received a verdict from District Justice
Klair in the amount of $946,00, The Defendant appealed, the
case went to arbitration, and the arbitrators awarded the
Plaintiff $1,200,00 with interest from August 1, 1993, and
docket costs, Defendant has now appealed the case to this
Court,
Plaintiff will only have one witness, and that is Paul
E, Railing of Railing Drywall, Inc. The Defendant will be a
witness and also, perhaps, his brother-in-law may be a witness
at the trial, If either party wishes to call any witnesses
other than those mentioned, they are required to give the other
side at least two weeks notice prior to the trial date,
The Defendant has not made any offer to settle, so it
looks like the case will be going to trial with the claim of the
Plaintiff being $1,800,00,

TRIAL MEMORANDUM
I, STATEMENT OF FACTS
1. Plaintiff and Defendant contracted orally for Plaintiff to
perform certain drywall installation services at Defendant's
property located at 920 north Front Street, Wormleysburg,
Cumberland county, Pennsylvania.
2. The document attached to Plaintiff's Complaint and
Plaintiff's Trial Memorandum was requested by Plaintiff to
evidence receipt of monies paid by Defendant to Plaintiff.
3, At the time the document attached to Plaintiff's Complaint as
Exhibit "A" was presented to Defendant by Plaintiff, the
Plaintiff had already begun and completed most of the work
requested by Defendant pursuant to the oral contract between the
Parties.
4, Prior to entering into the oral contract, Defendant advised
Plaintiff that Defendant and Defendant's brother-in-law would be
doing some of the work.
5, At no time did Defendant advise Plaintiff that Plaintiff was
to do all of the work in all of the units, Plaintiff was hired
to primarily do the joint work and fire seam work in three
apartments, with the possibility of plaintiff being used for
three additional apartments in a later phase of construction,
6, The work performed by Plaintiff was shoddy and was not
performed in a workmanlike manner according to industry
standards.
7, The work performed by plaintiff was deficient in that
plaintiff did not finish the fire seams in three apartments, nor
did he properly perform the wall joint work, nor did he complete
the drywall installation in said apartments.
8. On at least one occasion, Plaintiff showed up to the job site
to perform work while Plaintiff was either drunk or had been
drinking excessively,
9. Defendant advised Plaintiff that the work performed by
Plaintiff was shoddy and was not acceptable,
10, Defendant requested that Plaintiff correct the shoddy work
described above, as well as complete the unfinished work,
11. Plaintiff refused to correct his defective work and refused
to complete the drywall installation.
12. Defendant incurred damages of Four Thousand ($4,000,00)
Dollars in correcting Plaintiff's defective work and in
completing the work Plaintiff refused to complete.

II. PROCEDURAL HISTORY
1, On April 14, 1994, Defendant appealed a District Justice
Judgment,
2, Plaintiff filed a Complaint on May 4, 1994.
3, Defendant filed an Answer with New Matter and Counterclaim on
December 22, 1994.
4, On January 20, 1995, Plaintiff filed a Reply to Defendant's
New Matter and Counterclaim,
5, On May 4, 1994, an Arbitration Hearing was held,
6, On May 31, 1995, Defendant appealed the Award of Arbitrators.
7. On December 27, 1995, a Pretrial Conference was held with the
Honorable Harold E. Sheely,
III, CONCLUSIONS OF LAW
A conflict of testimony upon the controlling question is the
case is one for the trier of fact to decide, Berwick Hotel Co,
v. Vauqhn, 300 Pa. 389, 395, 150 A, 613, 616 (1930), In the
instant case, there is conflicting testimony as to the central
issue (i.e., was notice given at the time of the negotiation of
the contract that some of the work might be completed by
Defendant?),
The document attached to Plaintiff's Complaint as Exhibit
"A" and to Plaintiff's Trial Memorandum was requested by
Plaintiff to evidence receipt of monies paid by Defendant to
Plaintiff. Said document did not alter the terms of the initial
agreement, The document was drafted after the work had started
and did not accurately reflect the entire contract,

In the instant case, the work produced by the defendant was
shoddy and not acceptable by Defendant, Plaintiff refused to
correct his work. Defendant, relying on Plaintiff's breach of
contract, proceeded to correct the shoddy work done by Plaintiff,
In considering a breach of contract case, the aim is to put the
injured party in the position he would have been in had the
contract not been breached, Maxwell v, Schaefer, 112 A,2d 69,
381 Pa, 13 (1955),
The issues in this case are based upon conflicting testimony
and as such are up to the trier of fact to decide,

PRETRIAL MEMORANDUM
I , STATEM!KT OP PACTS
1. The Plaintiff is RAILING DRYWALL, INC., a Pennsylvania corporation
with its principal place of business at P.O. Box 1268, Mechanicsburg,
cumberland County, Pennsyl vania 17055, hereinafter referred to as "PI aintiff" .
2. The Defendant is ROLLACE HEUSTESS, an adult individual, sui juris,
whose address is 5240 Terrace Road, Mechanicsburg, Cumberland County,
Pennsylvania, 17055, hereinafter referred to as "Defendant".
3. On or about July I, 1993, Plaintiff and Defendant entered into a
written agreement (Proposal and Acceptance) which is attached hereto, marked
Exhibit "A", and made a part hereof by reference thereto,
4. In accordance with the aforementioned agreement, Plaintiff proceeded
to perform certain drywall inslallation services, and furnish material used in
connection therewith, at the job site located at 920 North Front Street,
Wormleysburg, cumberland County, Pennsylvania, and known as the River View
Apartments.
8. The total cost to Plaintiff for labor and material would have been
Four Thousand Two Hundred ($4,200.00) Dollars had Defendant allowed the job to
be completed by Plaintiff. The difference of One Thousand Eight Hundred
($1,800.00) Dollars would have represented Plaintiff's profit.
5. After Plaintiff completed the more difficult work requiring
scaffolding due to the elevated areas where work was first performed, the
Defendant, without any cause whatsoever breached the accepted Proposal and
discharged Plaintiff and advised Plaintiff that he was going to have his
"unemployed brother-in-law take over and complete the job."
II. DAMAGE8
6. The agreement aforementioned set forth a total sum of Six Thousand
($6,000.)0 Dollars to be payable in three (3) equal installments. Plaintiff
acknowledges receipt of the first installment of Two Thousand ($2,000.00)
Dollars.
7. Had Plaintiff been permitted to complete the job in accordance with
the terms of the agreement, it would have received a total of Six Thousand
($6,000.00) Dollars. As a result of Plaintiff being compelled to leave the
job, without cause, he suffered a financial loss of One Thousand Eight Hundred
($1,800.00) Dollars.

9. Plaintiff made demand upon Defendant for payment, but Defendant
refused to pay Plaintiff.
III. PROCEDURAL HISTORY
10. Plaintiff brought suit against Defendant before District Justice
Ronald E. Klair on February 2, 1994.
11. After hearing held on March 16, 1994, before District Justice Klair,
judgment was entered against Defendant in the amount of Nine Hundred Forty Six
($946.00) Dollars.
12. Defendant appealed the District Justice judgment in the Court of
Common Pleas, Cumberland County, on April 14, 1994.
13. Plaintiff filed a Complaint in the Court of Common Pleas, Cumberland
County, to No. 94-1909 Civil Term, on Hay 4, 1994.
14. December 22, 1994, Defendant filed Answer With New Hatter and
Counterclaim.
15. On January 20, 1995, Plaintiff filed Reply to Defendant's New Hatter
and Answer to Counterclaim.
16. On February IS, 1995. Plaintiff filed a Petition For Appointment of
Arbitrators under Rule 1312.1,

17. A hearing before a Board of Arbitrators was held on Hay 4, 1995, and
the Board of Arbitrators found in favor of the Plaintiff in the amount of One
Thousand Two Hundred ($1,200.00) Dollars plus interest from August 1, 1993,
plus docket costs. On the Counterclaim the Board of Arbitrators also found in
favor of the Plaintiff.
18. Defendant filed a Notice of Appeal from Award of Board of Arbitrators
on Hay 31, 1995.

about July 1, 1993.
VI. LEGAL AUTHORITY
21. According to ~ lJl, Contracts, expectancy damages may be awarded in
actions where nonperformance of a contract has occurred. The objective is to
place the aggrieved party's monetary position as though the breaching party had
performed. Such damages can be calculat.ed by subtracting the injured party's

actual dollar position as a result of the breach fronl that party's projected
dollar position had performance occurred (Black's Law Dictionary, sixth Edition
1991) .
22. Had Plaintiff been permitted to complete the job in accordance with
the terms of the agreement, it would have received a total of Six Thousand
($6,000.00) Dollars. As a result of Plaintiff being compelled to leave the
job, without cause, he suffered a financial loss of One Thousand Eight Hundred
($1,800.00) Dollars,
23. The total cost to Plaintiff for labor and material would have been
Four Thousand Two Hundred ($4,200.00) Dollars had Defendant allowed the job to
be completed by Plaintiff. The difference of One Thousand Eight Hundred
($1,800.00) Dollars would have represented Plaintiff's profit.
WHEREFORE, Plaintiff requests judgment in its favor and against the
Defendant in the amount of One Thousand Eight Hundred ($1,800.00) Dollars, plus
interest and cost of suit.

ANSWER WITH NEW MATTER AND COUNTERCLAIM
AND NOW, this 22nd day of December, 1994, comes Defendant
Rollace Heustess and files the following Answer with New Matter
and counterclaim, and in support thereof avers as follows:
1, Denied, After reasonable investigation, Defendant is
without the information sufficient to for a belief as to the
truth of this averment. Therefore it is denied.
2, Admitted,
3, Denied as stated. The document attached to plaintiff's
Complaint speaks for itself. By way of further answer,
Defendant's signature was requested by Plaintiff merely to
evidence receipt of services rendered at that time, Defendant
paid Plaintiff the sum of Two Thousand ($2,000,00) Dollars for
the work Plaintiff performed, even though not performed
professionally or to industry standards.
4, Admitted in part, denied in part, It is admitted that
Plaintiff did some drywall installation services at the property
located at 920 North Front Street, wormleysburg, Cumberland
County, Pennsylvania. It is specifically denied that the Exhibit
attached to Plaintiff's Complaint as Exhibit "A' is a contract
between the parties as stated in paragraph 3 above. It is
specifically denied that said services were either professionally
or satisfactorily performed. To the contrary, it is specifically
averred that the work performed by Plaintiff was defective,
resulting in damages to Defendant as more specifically averred in
Defendant's New Matter and Counterclaim.
5, Denied as stated, It is specifically denied that
Plaintiff completed the "more difficult work". Plaintiff
performed certain services, which were neither professionally nor
satisfactorily performed as outlined in Defendant's New Matter
and Counterclaim, Defendant had advised Plaintiff, before
Plaintiff was hired to do any work, that only certain services
were needed from Plaintiff because Defendant's brother was going
to complete the work.
6, Admitted in part, denied in part. It is admitted that
Defendant paid Plaintiff Two Thousand ($2,000.00) Dollars,
However, it is specifically denied that the agreement between the
parties was as Plaintiff has described, Defendant hereby
incorporates his answers to paragraphs 3 through 5 above,
7, Paragraph 7 is a conclusion of law to which no
responsive pleading is necessary, If a responsive pleading is
deemed necessary, the averments of paragraph 7 are specifically
denied,

8, Paragraph 8 is a conclusion of law to whioh no
responsive pleading is necessary, If a responsive pleading is
deemed necessary, the averments of paragraph 8 are specifically
denied,
9. Admitted. By way of further answer, Defendant
specifically denies that Plaintiff is due any monies from
Defendant for any services which Plaintiff may have provided to
Defendant,
10, No responsive pleading is required to the averments of
paragraph 10. If a more specific answer is deemed necessary,
Defendant avers that Pennsylvania's District Justice Rule of
Procedure 1007 provides that "The procseding on appeal shall be
conducted de novo in accordance with the Rules of civil Procedure
that would be applicable if the aotion was initially commenced in
the Court of Common Pleas," Emphasis added.
WHEREFORE, Defendant respectfully requests that this
Honorable Court find in favor of the Defendant and against the
Plaintiff.

11, Defendant incorporates paragraphs 1 through 10 above as
though the same were fully set forth herein,
12, At the time the document attached to Plaintiff's
Complaint as Exhibit "A" was presented to Defendant by Plaintiff,
the Plaintiff had already begun and completed most of the work
requested by Defendant pursuant to the oral understanding of the
parties,
13, During the oral conversations that the parties had
prior to Plaintiff starting any work for Defendant, Defendant
advised Plaintiff that Defendant and Defendant's brother-in-law
would be doing some of the work,
14. At no time did Defendant advise Plaintiff that
Plaintiff was to do all of the work in all of the units.
Plaintiff was hired to primarily do the joint work and fire seam
work in three apartments, with the possibility of Plaintiff being
used for three additional apartments in a later phase of
construction,
15, At no time was Plaintiff hired to perform work on all
of the planned units in the apartment building.
16, The work performed by Plaintiff was shoddy and was not
performed in a workmanlike manner according to industry
standards,
17. The work performed by Plaintiff was deficient in that
Plaintiff did not finish the fire seams in three apartments, nor
did he properly perform the wall joint work, nor did he complete
the drywall installation in said apartments.
COUNTERCLAIM
18. The averments of Paragraphs 1 through 17 are
incorporated herein by reference as though the same were fully
set forth herein,
19, The work performed by Plaintiff pursuant to the oral
contract he had with Defendant was performed in a shoddy manner,
20, On at least one occasion, Plaintiff showed up to the
job site to perform work while plaintiff was either drunk or had
been drinking excessively.
21, Defendant advised Plaintiff that the work performed by
Plaintiff was shoddy and was not acceptable.
22, Defendant requested that plaintiff correct the shoddy
work described above, as well as complete the unfinished work.
23, Plaintiff refused to correct his defective work and
refused to complete the drywall installation.
24, Defendant incurred damages of Four Thousand ($4,000.00)
Dollars in correcting Plaintiff's defective work and in
completing the work Plaintiff refused to complete.
WHEREFORE, Defendant requests judgment against Plaintiff in
the amount of Four Thousand ($4,000.00) Dollars, plus interest
and costs of suit,

Plaintiff. Railing Drywall. Inc.. submits the following Reply to
Defendant's New Matter and Counterclaim. as follows:
PLAINTIFF'S REPLY TO DEFENDANT'S NEW MATTER
11. Admitted.
12. Denied. It is denied that the Plaintiff had already done and
completed most of the work requested by Defendant in accordance with an oral
agreement between the parties. In fact, the only understanding between the
parties was set forth in the written contract attached to Plaintiff's Complaint
and marked Exhibit "A".
13. Denied. It is denied that Plaintiff was informed by Defendant that
prior to Plaintiff starting any work for the Defendant, Defendant's brother-in-
law "would be doing some of the work."
14. Denied. It is dlmied Plaintiff was ever advised by Defendant "that
he was hired to primarily do the joint work and fire seam work in three

apartments." On the contrary. Plainli ff entered into an agreement with
Defendant to furnish labor and material ready for paint in six apartment units.
15. Denied. Plaintiff agreed with Defendant to work on six apartment
units as set forth in the contract attached to Plaintiff's Complaint and marked
Exhibit "A".
16. Denied. It is denied Plaintiff performed any work whatsoever in a
"shoddy" manner and not according to industry standards. On the contrary. all
of the work performed by the Plaintiff was performed in a professional, workman-
like manner and consistent with industry standards.
17. Admitted in part and denied in part. It is denied that Plaintiff's
work was performed in a "deficient" manner as set forth by Defendant. However,
it is admitted that Plaintiff did not complete all of the drywall installation
in said apartments due to the fact that Defendant. in effect, prevented
Plaintiff from doing so.
WHEREPORE. Plaintiff requests judgment in its favor and against Defendant
in the amount of One Thousand Eight Hundred ($1,800.00) Dollars, plus interest
and cost of suit.

19. Denied. It is denied that there was ever an oral agreement.
Plaintiff performed the work pursuant to a written contract as referred to in
Plaintiff's Complaint and marked Exhibit "A". The work performed by the
Plaintiff was done in a workmanlike and professional manner and not in a
"shoddy manner" as c1 aimed by Defendant, At no time did Defendant complain to
Plaintiff about the quality of the work performed.
20. Denied. This scurrilous allegation that "Plaintiff showed up to the
job site to perform work while Plaintiff was either drunk or had been drinking
excessively" is vehemently denied. strict proof thereof is demanded at time of
trial.
21. Denied. At no time did Defendant complain, or bring to Plaintiff's
attention, directly or indirectly, that any of the work performed by Plaintiff
"was shoddy and was not acceptable."
22, Denied. It is denied that Defendant requested Plaintiff to "correct
his defective work." It is further denied that Defendant requested Plaintiff
to complete the work.
23. Denied. It is denied that Plaintiff performed any work whatsoever
that was defective; Plaintiff did not refuse to complete the drywall installa-
tion, but was effectively prevented from doing so by Defendant who had his
brother-in-law and others brought in to complete the work,
24. Denied. It is denied that Defendant incurred damages in the amount of
Four Thousand ($4,000.00) Dollars. or in any amount whatsoever. ann it is

further denied that Plaintiff's work was defective. Moreover, it is denied
that Plaintiff refused to complete the work, but was, in fact, prevented from
doing so for the reasons set forth in 23 Supra.
WHEREFORE, Plaintiff requests judgment in its favor and against the
Defendant in the amount of One Thousand Eight Hundred ($1,800.00) Dollars, plus
interest and cost of suit.

COMPLAINT
AND NOW, this 3rd day of May, 1994, comes the Plaintiff, RAILING DRYWALL,
INC., by its attorneys, BATURIN & BATURIN, and brings this Complaint against
Rollace Heustess, Defendant.
In support of said Complaint, the following is averred:
1. The Plaintiff is RAILING DRYWALL, INC., a Pennsylvania
corporation with its principal place of business at P,O. Box 1268,
Mechanicsburg, Cumberland County, Pennsylvania, 17055, hereinafter referred to
as "Plaintiff".
2. The Defendant is ROLLACE HEUSTESS, an adult individual, sui
juris, whose address is 5240 Terrace Road, Mechanicsburg, Cumberland County,
Pennsylvania, 17055, hereinafter referred to as "Defendant",
3. On or about July 1, 1993, Plaintiff and Defendant entered into a
written agreement (Proposal and Acceptance) which is attached hereto, marked
Exhibit "A", and made a part hereof by reference thereto.
4. In accordance with the aforementioned agreement, Plaintiff
proceeded to perform certain drywall installation services, and furnish
material used in connection therewith, at the job site located at 920 North

Front street, Wormleysburg, Cumberland County, Pennsylvania, and known as the
River View Apartments.
S. After Plaintiff completed the more difficult work requiring
scaffolding due to the elevated areas where work was first performed, the
Defendant, without any cause whatsoever, discharged Plaintiff and advised it
that he was going to have his "unemployed brother-in-law take over and complete
the job."
6. The agreement aforementioned set forth a total sum of Six
Thousand ($6,000.00) Dollars to be payable in three (3) equal installments.
Plaintiff acknowledges receipt of the first installment of Two Thousand
($2,000.00) Dollars.
7. Had Plaintiff been permitted to complete the job in accordance
with the terms of the agreement it would have received a total of Six Thousan~
($6,000.00) Dollars. As a result of Plaintiff being compelled to leave the
job. without cause, he suffered a financial loss of One Thousand Eight Hundred
($1,800.00) Dollars.
8. The total cost to Plaintiff for labor and material would have
been Four Thousand Two Hundred ($4,200.00) Dollars had Defendant allowed the
job to be completed by Plaintiff. The difference of One Thousand Eight Hundred
($1,800.00) Dollars would have represented Plaintiff's profit.
9. Plaintiff made demand upon Defendant for payment, but Defendant
has refused, and continues to refuse, to pay Plaintiff.

10. Plaintff brought suit against Defendant before District Justice
Ronald E. Klair and, after hearing, obtained Judgment therein, which Judgment
has been appealed by Defendant.
WHEREFORE, Plaintiff demands judgment in its favor and against Defendant
in the amount of One Thousand Eight Hundred ($1,800.00) Dollars, plus interest
and cost of suit.

and consideration of the testimony presented, we make the
following findings:
On the defendant's counterclaim. no evidence of any
nature was presented; therefore. on the counterclaim. we find in
favor of the plaintiff.
Plaintiff's claim is for loss of profit on a contract
entered into between the parties, Plaintiff claims that he was
not allowed to complete the work by the defendant. On this
claim we find in favor of the plaintiff in the amount of
$1.000.00 and direct that interest be attached since August
1993. the approximate date of plaintiff's not being allowed to
complete the Job.
