HomeMy WebLinkAbout02-3112 STIPULATION AGAINST LIENS THIS AGREEMENT made this ~Tday of June, 2002, by and KOSER CUSTOM HOMES, hereinafter referred to as Contractor, between SHAWN L. FRICK AND STACY L. FRICK, husband and wife, hereinafter referred to as Owner, whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in West Pennsboro Township, C~m~erland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as Lot #8 and 8A, Final Lot Addition Plan for Katherine A. Haas Junkin, C,~mberland County, PA. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor' in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maJ. ntain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. IN WITNESS WHEREOF, I hereunto set my hand and official seal. _(SEAL) Exhibit A ALL that certain tract or parcel of land situate in the Township of West Pennsboro, County of Cumberland, Pennsylvania, being more particularly bounded and described as follows: BEGINNING at a concrete monument on the southern dedicated right of way line of T-445, also known as Barnstable Road, fifty (50) feet wide, at the dividing line of Lot No. 7 and Lot No. 8 of Plan for Katherine A. Haas Junkin recorded in Plan Book 52, Page 9, and being the same Lot No. 8 of Final Lot Addition Plan for Katherine A. Haas Junkin hereinafter mentioned; thence along the southern dedicated right of way line of T-445, also known as Barnstable Road, North 62 degrees 00 minutes 00 seconds East, a distance of 95 feet to a concrete monument; thence following a curve to the left having a radius of 275.00 feet with an arc length of 55.37 feet, and a chord bearing of North 56 degrees 13 minutes 52 seconds East, with a chord length of 55.28 feet to a concrete monument found at the dividing line of aforesaid Lot No. 8 and Lot Addition, Lot No. SA; thence continuing on the curve to the left having a radius of 275.00 feet with an arc length of 52.36 feet, and a chord bearing of North 45 degrees 00 minutes 30 seconds East, with a chord length of 52.28 feet to a set rebar at a point at No. 1 of the remaining lands of Katherine A. Haas Junkin; thence along Lot No. 8A South 28 degrees 00 minutes 00 seconds East a distance of 320.84 feet to a set rebar; thence South 62 degrees 00 minutes 00 seconds West, a distance of 200 feet to a set rebar; thence along Lot No. 8A and the dividing line of Lot No. 7 and Lot No. 8, North 28 degrees 00 minutes 00 seconds West, a distance of 300 feet to a concrete monument, the place of BEGINNING. BEING Lot No. 8 and Lot No. 8A of Final Lot Addition Plan for Katherine A. Haas Junkin prepared by Charles W. Junkins, Registered Surveyor and recorded in the Recorder of Deeds in and for Cumberland County in Plan Book 84, Page 141.
