Groff, by and through her attorneys, MANCKE, WAGNER, HERSHEY & TULLY, who makes the following averments in support of this License Suspension Appeal: 1. The Petitioner, Michelle L. Groff, an adult individual, is a licensed driver within the Commonwealth of Pennsylvania with a residence address at 1177 Shoreham Road, Camp Hill, Cumberland County, Pennsylvania 17011. 2. Respondent, Pennsylvania Department of Transportation, Bureau of Driver Licensing, has a mailing address at Transportation and Safety Building, Harrisburg, Dauphin County, Pennsylvania 17120. 3. Petitioner received a citation from Officer Henderson of the Hummelstown Borough Police Department on November 11, 1993 for violating Section 3362(a) (3) of the Motor Vehicle Code. 4. The Petitioner was found guilty at a hearing in front of District Justice William Rathfon on January 19, 1994. 5. The Petitioner filed a timely appeal of her conviction in the Court of Common Pleas of Dauphin County on February 1, 1994. A copy of this appeal is attached hereto as Petitioner's Exhibit "A". 6. Petitioner received a notice from the Office of District Attorney of Dauphin County setting a hearing date on April 27, 1994 at 9:00 a.m. A copy of this correspondence is attached hereto as Petitioner's Exhibit "B". 7 . On March 16, 1994, Peti tioner received a notice of license suspension from the Department of Transportation advising her that her license was to be suspended for a period of sixty (60) days pursuant to Section 1539 of the Vehicle Code. A copy of this correspondence is attached hereto as Petitioner's Exhibit "C". WHEREFORE, Petitioner respectfully requests that a hearing be , scheduled in order that final determination can be made relative to the above captioned matters and that the Court issue a supersedeas in accordance with Section 1550 staying the Department's proposed action as outlined in Exhibit "C" until a final determination can be made.
