COMPLAINT FOR POSSESSION OF REAL PROPERTY
AND NOW, comes the PlalntllTRussel Brenneman, by and through his attomey, Robert J. Mulderlg,
Esquire, and states 88 foUows:
1. PlalntIIT Russel Brenneman is an adult individual current~ residing at 1805 Wlllow Road,
Carllale, Cumberland County, Pennsylvania 17013.
2. Defendant Wendy J. BrowneweU is an adult individual residing at Apartment 2, 210 Hill
Street, Mt. Ho\ly Springs, Cumberland County. Pennsylvania 17065.
3. Plaintiff is the owner of an apartment buDding located at 210 Hill Street, Mt. Ho\ly Sprlnga,
Cumberland County, Pennsylvania 17065.
4. On February 15, 1992, Plaintiff, by written lease with the Defendant, leased to the
Defendant, the residential premises at Apartment 2, 210 Hill Street, Mt. Ho\ly Springs, Cumberland County,
Pennsylvania for a stated term of one year beginning February 15, 1992 at $350.00 per month, with two
subsequent rent incrases to a present rent of $410.00 per month, payable in advance, on the fU'llt day of
each month. A copy of the Lease is attached 88 Exhibit 'A'.
5. Paragraph 7 of said Lease states that if the landlord does not give the tenant written notice
sixty (60) day9 in advance of the initial term, said Lease shall continue upon the lI8IIIe terms and conditions
in force Immediate~ prior to the expiration of the initial term for another period of one year.
6. Paragraph 7 of said Lease states that either the Landlord or Tenant may terminate the
Lease at the end of a term by giving the other party written notice of at least. two months prior to the end
of the term.
7. In IICCOrdance with paragraph 7, on December 115, 1993, Plaintiff hand delivered t
Defendant a sixty (60) day written notice terminating the Lease lIS of Febl'Wll')' 15. 1994. A copy of the
notice is attllched lIS Exhibit "D'.
8. The Defendant did not vacate said premiae8 on the termination of the Lease on Febl'Wll')'
15, 11194.
9. The holdover of the Defendant in the premiae8 baa been without the penn1aslon of the
Landlord.
10. PlIJ'IIIlI'IIph 12 of said Lease allows the Landlord to obtain reasonable attorney's fees in
enforcing the rights in the Lease.
WHEREFORE. the Plalntifl' respectfully requests that the Court grant him possession of the
property located at Apartment 2, 210 Hill Street, Mt. Holly Springs, Cumberland County. Pennsylvania
17065, with payment of any uncollected rent from Febl'Wll')' 15, 1994, plus reasonable attorney's fees and
costs.
