THIS AGREEMENT made the \'S~ day of April, 1994, by and between D & S CUSTOM
HOMES, hereinafter referred to as Contractor, and Thomas M. Lebo and Denise A. Lebo,
husband and wife, hereinafter referred to as Owner, whereby the former undertakes and agrees to
erect and construct a single family dwelling on:
ALL that certain piece or parcel of land situate In Dickinson Township, In the County of
Cumberland, Commonwealth of Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point on the northern right-of-way line of Nelson Drive at the
southeastern corner of Lot No. 1 on the aforesaid Final Subdivision Plan; thence along said Lot No.
1, North 48 degrees 51 minutes 14 seconds West, 257.22 feet to a point at the northeastern corner
of said Lot No. 1 at lands now or formerly of Lois J. Downes; thence along said lands now or
formerly of Lois J. Downes, North 41 degrees 08 minutes 46 seconds East, 180.00 feet to a point
at the northwestern corner of Lot No.6 on the aforesaid Final Subdivision Plan; thence along said
Lot No.6, South 48 degrees 51 minutes 14 seconds East, 254.97 feet to a point in said northern
right-of-way line of Nelson Drive at the southwestern corner of said Lot No.6; thence along said
northern right-of-way line of Nelson Drive by a curve to the left having a radius of 1,275.62 feet, an
arc length of 180.14 feet to a point In said northern right-of-way line of Nelson Drive at the
southeastern corner of said Lot No.1, the Place of BEGINNING.
CONTAINING 45,715.16 square feet and being all of Lot NO.5 on the aforesaid Final
Subdivision Plan.
SUBJECT to the building and use restrictions recorded with the aforesaid Final
Subdivision Plan and as modified and supplemented in Miscellaneous Record Book 349, Page 889.
BEING the same property which Thomas C. Shenk and Unda K. Shenk, husband and
wife, by their Deed dated and recorded March 30, 1994 in the Office of the Recorder of Deeds in
and for Cumberland County, in Deed Book 103, Page 240, granted and conveyed unto Thomas M.
Lebo and Denise A. Lebo, husband and wife.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in
consideration of the sum of One ($1.00) Dollar to him In hand paid by Owner, the receipt whereof
Is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and all parties acting through or under them, covenant and
agree that no mechanic's liens or claims thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,

for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this Instrument, waiving the right of lien, shall be an independent covenant.
