Milkes, Esquire, Jacobsen & Milkes, and files the following Petition: 1. Appellant is Eldon Gene Mease, an adult individual who is currently residing at 304 Shed Road, Newville, Cumberland County, Pennsylvania, 17241. , 2. On April 10, 1993, Appellant received a citation for driving under the influence, leaving the scene of an accident where property dAmAge has occurred, and leaving the scene of an accident where personal if\jury has occurred. Appellant has never been convicted of the offense of homicidll. by..5vehicle, II '15 (.) as alleged in the attached notice from the License Bureau. 3. 4. Other than the offenses for which the Appellant was convicted in this single incident, Appellant has no previous convictions which would be considered offenses under the habitual offender statute. 5. Because the offenses for which the Appellant was convicted involved a single incident, they cannot be stacked for purposes of the habitual offender statute. 6. Appellant forfeited his driver's license at the time of sentencing on the above offenses on February 22, 1994. WHEREFORE, for all the above reasons, the Appellant, by and through his attorney, requests this Honorable Court to set a time for hearing on the propriety of Appellant's license suspension on the offense of homicide by vehicle and under the habitual offender statute, and further that this Court stay the imposition of his license suspension for homicide by vehicle and habitual offender, pending the result of such hearing, and after such hearing, reverse the suspension with regard to the homicide by vehicle and habitual offender statutes. The Appellant further requests of this Honorable Court that it award him attorney fees against the Department of Transportation should the Department continue to pursue the homicide by vehicle allegations since there is no basis whatsoever in the Record that such an offense was ever alleged or charged and there is nothing in the Record to indicate that the Appellant was ever convicted of such an offense. OPINION AND ORDER OF COURT Plaintiff asks this court to reverse his driver's license suspension with regard to the offense of homicide by vehicle and the habitual offender statute of the Vehicle Code. A hearing was held on May 23, 1994, to consider the matter. FACTS The material facts to decide this matter are as follows: On February 22, 1994, plaintiff was convicted of driving under the influence of alcohol,' an accident involving damage to attended property,' and an accident involving personal injury.' The Pennsylvania Department of Transportation mistakenly cited 53732 (homicide by vehicle) of the Vehicle Code '75 Pa. C.B.A. 53731. Driving under influence of alcohol or controlled substance. '75 Pa. C.B.A. 53743. Accidents involving damage to attended vehicle or property. '75 Pa. C.B.A. 53742. Accidents involving death or personal injury. 94-2031 CIVIL TBRM to place plaintiff in habitual offender status.c At the hearing, the parties stipulated that the mistaken "homicide by vehicle" conviction would be replaced in the Department of Transportation's records with plaintiff's correct conviction of an accident involving personal injury. (See Notes 3 and 4). No testimony was given at the hearing. DISCUSSION The mistaken "homicide by vehicle" conviction was corrected by agreement of the parties at the hearing held May 23, 1994. Therefore, the court will not address such mistaken conviction. However, the correct conviction of an accident involving personal injury also falls within the offenses enumerated in the Vehicle Code that apply toward habitual offender status. Section 1542 reads in part: . . . (b) Offenses enumerated.- Three convictions arising from separate acts of any one or more of the following offenses committed either singularly or in combination by any person shall result in such person being designated as a habitual offender: (1) Any offense set forth in section 1532 (relating to revocation or suspension of operating privilege). SectioD 1532 reads in part: (a) RevocatioD.- The department shall revoke the operating privilege of any driver . . . based on any of the following offenses: . . . (3) . . . Section 3742 (relating to accidents involving death or personal injury). . . 75 Pa. C.S.A. The plaintiff still has the requisite number and type of convictions, within a five year period, enumerated in 51542. The issue to be resolved is this: Are the plaintiff's convictions actually for "separate and distinct offenses," even though all three violations were committed in one general episode? The court looks for guidance to the case of Ross v. pennsvlvania Deoartment of Transoortation, 125 Pa. Comm. 256, 557 A.2d 62, aooeal denied, 524 Pa. 623, 571 A.2d 385 1989). In Ross, the appellant was riding his all terrain vehicle (ATV) in a wooded area near his home. In order to get home, he drove the ATV on public streets in his neighborhood. This occurred between 8:00 p.m. and 8:30 p.m., and he did not have his lights on. He was seen by a police officer, who stopped him and arrested him for driving without lights and for fleeing or attempting to elude a police officer. He pled guilty to these offenses and paid the fines. ~ at 257, 557 A.2d at 63. Because appellant had a prior DUI on his record 3 94-2031 CIVIL TERM committed within the past five year period, Department of Transportation notified him that his operating privilege would be revoked for five years pursuant to the habitual offender statute. ~ at 257-258, 557 A.2d at 63. ~ held that all three Vehicle Code violations may be committed in combination in the course of one general factual episode, being three complete different improper things in order to be considered a habitual offender. Id. at 258-259, 557 A.2d at 63. The appellant contended he was arrested for eluding a police officer because he was driving without lights and that, therefore, both convictions arose from the same act, ~, not turning on his lights when he should have done so. Id. at 259, 557 A.2d at 64. The Ross court looked to the Vehicle Code statutes for an answer. It found, by definition, that the offense of fleeing or attempting to elude a police officer must involve an act other than driving without lights. The appellant had to be doing something to attempt to aet awav from the officer after beina sianaled bv him, and was not merely attempting to drive through the neighborhood undetected. (Emphasis in original). Therefore, by pleading guilty to the "fleeing" offense, appellant admitted to committing two separate acts, and the requirements of 51542 had been met. ~ at 259-260, 557 A.2d at 64. Section 3742 involves "an accident resulting in injury. . . of any person," while 53743 involves "an accident resulting onlv in damage to . . . property (Emphasis added). Mr. Mease, plaintiff, had to cause damage to the property of a distinctly separate person to be charged with a . . . " 53743 offense, and not merely damage property owned by the person he injured under a 53742 offense. Sections 3742 and 3743 both contain some of the same wording: (a) General rule.- The driver of any vehicle involved in an accident . . . shall immediately stop the vehicle at the scene of the accident . . . and in every event shall remain at the scene of the accident until he has fulfilled the requirements of section 3744 (relating to duty to give information and render aid) . . . 75 Pa. C.S.A. Even under the same language of sections 3742 and 3743, Mr. Mease, plaintiff, would have been required to give information to two separate persons. Plaintiff's conviction of DUI (53731) need not involve personal injury or property damage, thereby making such offense a separate act from sections 3742 and 3743. Therefore, since the plaintiff has been convicted of three separate acts, and in light of the foregoing discussion, the requirements of 51542 (habitual offender) have been met.
