COMPLAINT
1. Plaintiff is Lisa D. Keener, who currently resides at 44 Rolo
Court, Mechanicsburg, Cumberland County, Pennsylvania.
2. Defendant is William P. Keener, Jr., who currently resides at
Apartment 18, 4610 Jonestown Road, HarriSburg, Dauphin County,
Pennsylvania.
3. Plaintiff and Defendant have been bona fide residents of the
Commonwealth of Pennsylvania for at least six (6) months immediately
previous to the filing of this Complaint.
4. Plaintiff and Defendant were married on June 1, 1991, at
Mechanicsburg, Pennsylvania.
5. There have been no prior actions of divorce or annulment
between the parties.
6. Plaintiff has been advised of the availability of marriage
counseling and understands that she may have the right to request that
the court require the parties hereto to participate in counseling.
7. Plaintiff avers as the grounds upon which this action is based
is that:
(A) That the marriage between the parties hereto is
irretrievably broken and that the Plaintiff and Defendant have lived
separate and apart since March 5, 1994 or, in the alternative:

(B) That Plaintiff and Defendant are now living separate and
apart and, at the appropriate time, Plaintiff will submit an Affidavit
alleging that the parties have liv'ld separate and apart for at least
two (2) years and that the marriage is irretrievably broken.
WHEREFORE, Plaintiff requests your Honorable Court to enter a
decree in divorce divorcing Plaintiff and Defendant absolutely.
I verify that the statements made in this Complaint are true and
correct. I understand that false statements herein are made subject to
penalties of 18 Pa.C.S.A. Section 4904, relating to unsworn falsifica-

COMPL~INT FOR CUSTODY
TO THE HONORABLE, THE JUDGES OF THE SAID COURT:
1. Plaintiff/Petitioner is Lisa D. Keener, residing at 44
Rolo Court, Mechanicsburg, Cumberland county, Pennsylvania
17055.
2. Defendant/Respondent is William P. Keener, Jr., residing
at 8065 Bull Road, Lewisberry, York County, Pennsylvania 17339.
3. Plaintiff/Petitioner seeks an Order of Court concerning
the custody of the parties child, Dalton S. Keener, D.O.B.
February 10, 1991.
The child was born out of wedlock.
During the past five (5) years, the child has resided with
the following persons at the following addresses:
(a) Lisa D. Keener, 44 Rolo Court, Mechanicsburg,
Pennsylvania 17055.
The mother of the child is Lisa D. Keener, currently
residing at 44 Rolo Court, Mechanicsburg, Pennsylvania 17055.
She is the natural mother of the child.

The father of the child is William P. Keener, Jr., currently
residinq at 8065 Bull Road, Lewisberry, York County, Pennsylvania
17339. He is the natural father of the child.
6. The relationship of Plaintiff/Petitioner to the child is
that of Mother to Son.
7. The relationship of Defendant/Respondent to the child is
that of Father to son. It is uncertain as to whom Defendant/
Respondent currently resides.
8. Plaintiff/Petitioner has not participated as a party or
witness in any other litigation concerning the custody of the
child in this, or in any other Court. Plaintiff/Petitioner has
no information of a custody proceedinq concerninq the child
pendinq in any Court of this Commonwealth.
9. Plaintiff/Petitioner does not know of a person not a
party to the proceedings who has physical custody of the child or
claims to have custody or visitation rights with respect to the
child.
10. The best interests and permanent welfare of the child,
Dalton S. Keener, will be served by ordering that his primary
care, custody and control be vested in Lisa D. Keener,
Plaintiff/Petitioner, because of the following:
(a) Plaintiff/Petitioner can best provide for the minor
child, Dalton S. Keener, with a more suitable, stable,
helpful and proper environment than can the Defendant/

(b) P1aintitt/Petitioner is a tit parent who can best take
care ot her child on a regular and continual basis.
11. Defendant/Respondent's conduct and behavior in not in
the best interest of the child in that:
(a) Respondent has refused to have temporary custody of the
child on a consistent and periodic basis;
(b) Defendant/Respondent has disparaged P1aintiff/
Petitioner's reputation in the presence of the child con-
cerning the quality and level of Plaintiff/Petitionerls
lifestyle.
(c) Defendant/Respondent has failed to regularly and
routinely contact Plaintiff/Petitioner in reference to the
child.
12. Each parent whose parental rights to the child have not
been terminated and the person who has physical custody of the
child have been named as parties to this action.
WHEREFORE, Lisa D. Keener, Plaintiff/Petitioner herein,
requests that your Honorable Court grant primary legal and
physical custody of the minor child, Dalton S. Keener, to Lisa D.
Keener, Plaintiff/Petitioner and to Defendant/ Respondent on the
following basis:
(a) On an alternating weekend basis, beginning after
school on Friday with Defendant/Father picking up the child

at his day care school known as the Discovery School located
at 718 Hogestown Road, Mechanicsburg, Pennsylvania and
continuing until the following Sunday at 7:00 p.m. when
Father shall return the child to Mother's residence.
(b) On Christmas Eve (December 24), from 12:00 p.m.
through at 8:00 p.m. at which time Defendant/Father shall
return the child to Plaintiff/Mother's residence.
(c) On New Years Day (January 1), from 12:00 p.m.
through 8:00 p.m. at which time Defendant/Father shall
return the child to Plaintiff/Mother's residence.
(d) On the Independence Day (July 4), from 12:00 p.m.
through 8:00 p.m. at which time Defendant/Father shall
return the child to PlaintifflMother's residence.
(e) On Labor Day and Memorial Day, when such Holidays
fall on Defendant/Father's weekend.
(f) On the childls birthday, times agreed upon by the
parties.
(g) Any other times the parties may agree.

ordered and directed as follows:

1. The Mother, Lisa D. Keener, and the Father, William P. Keener,
shall have shared legal custody of Dalton S. Keener, bom February 10,
1991.
2. The Mother shall have primary physical custody of the Child.
3. The Father shall enjoy partial physical custody every week from
5:00 p.m. on Tuesday until 6:00 p.m. on the following Wednesday.
4. The Father shall be responsible to arrange transportation of the
Child from the Child's daycare provider at the beginning of periods of
partial custody on Tuesdays at 5:00 and to the Mother's residence at the
end of periods of physical custody on Wednesdays at 6:00 p.m. The Father
shall not transport the Child by motorcycle. The Father shall be present
during all periods of transportation of the Child during the Fatherls
periods of partial physical custody.
5. The Father shall notify the Mother on or before the preceeding
Monday evening if the Father is unable to pick up the Child fran the
childcare provider on the following Tuesday.
6. The parties shall share physical custody of the Child on holidays
as follows:
(a) The Father shall have physical custody of the Child every
year on Decerri:ler 24 from 12:00 p.m. until 8:00 p.m.
(b) The Father shall have physical custody of the Child every
year on January 1 from 12:00 p.m. until 8:00 p.m.
(c) The Father shall have physical custody of the Child every
year on Independence Day (4th of July) from 12:00 p.m. until
8:00 p.m.
(d) In 1995, the Father shall have physical custody of the Child
on Memorial Day from 12:00 noon until 8:00 p.m. and the
Mother shall have physical custody of the Child on Labor Day.
In 1996, the Mother shall have physical custody of the Child
on Memorial Day and the Father shall have physical custody of

the Child on Labor Day from 12:00 noon until 8:00 p.m.
custody on these holidays shall continue on an alternating
basis between the parties in subsequent years.
7. The parties shall share physical custody of the Child on the
Childls birthday in each year, at times to be arranged by mutus1 agreement
of the parties.
8. The parties shall refrain from making disparaging comments
concerning the other party during the exchange of custody of the Child or
at anytime in the presence or hearing of the Child.
9. Each party shall have reaeonab1e telephone contact with the Child
(prior to his regular bedtime) when the Child is in the physical custody of
the other party. The custodial parent shall a1eo ensure that the Child has
reasonable opportunity to contact the noncustodial parent by telephone.
10. The parties may modify the custody arrangements eet forth in this
order by mutus1 agreement. In the absence of mutus1 agreement, the custody
schedule outlined above shall control.
