CARDER, his wife Defendants No, CIVIL 1994 v, CIVIL ACTION - LAW COMPLAINT 1, The Plaintiff Dauphin Deposit Bank and Trust Company, is a Pennsylvania Corporation licensed under the banking laws of the Commonwealth of Pennsylvania with an office located at 3607 Derry Street, Harrisburg, Dauphin County, Pennsylvania 2, The Defendants, Howard E, and Gladys L. Carder, are individuals residing at 1116 Newville Road, Carlisle, 17013, Cumberland County, Pennsylvania, 3. On or about July 5, 1991 the Defendants made an application for a loan to Plaintiff Dauphin Deposit for the purpose of financing the purchase of a 1991 Ford Aerostar Station Wagon, The loan was approved by Dauphin Deposit Bank and Trust Company, (Exhibit "A"), 8, The Defendants were given notice that the car was sold at a public sale by Dauphin Deposit on March 14, 1992, (Exhibit "D"), 4, Dauphin Deposit Bank accepted the application and requested that the Defendants execute a "Pennsylvania Motor Vehicle Installment Sales Contract" (Exhibit "B"), 5, Pursuant to Exhibits "A" and "B" the Defendants agreed to make payments in monthly Installments of $364,51 to Dauphin Deposit for a term of sixty (60) months payable on the nineteenth (19th) day of each month. 6, The Defendants have defaulted under the terms and conditions of said agreement, Exhibit "A" and "B" herein, in that they have failed to make sufficient and consistent payments in accordance with the terms and that no payments have been received since September 23, 1991. 7, The Defendants voluntarily surrendered the car which was the collateral for the loan to Dauphin Deposit and was notified by Dauphin Deposit of the intended sale of the car to be held at Public Sale (Exhibit "C"), 9, Total proceeds generated by the public sale were $13,150,00, Costs of sale were $302,00, The net amount applied to the principal owed on the Defendant's account was $12,848,00, ~., ~.....,~._^ . .....-..
