COMPLAINT
1. The Plaintiff, Hempt Bros., Inc., is a Pennsylvania
corporation with a principal place of business at 205 Creek Road,
Camp Hill (Lower Allen Township), Cumberland County, Pennsylvania
17011.
2. The Defendant, Yentzer Bros. Construction, Inc., is a
Pennsylvania corporation with its principal place of business at
6375 Basehore Road, Mechanicsburg, Cumberland County, Pennsylvania
17055.
3. At all times relevant hereto, Plaintiff has been engaged
in the business, inter alia, of manufacturing and selling concrete
and stone.
4. At all times relevant hereto, Defendant has been engaged
in the construction business.
COUNT I
5. The allegations of paragraphs 1 to and including 4 are
incorporated herein by reference as though herein fully set forth.

6. The Plaintiff, at the special insistence and request of
the agents, servants, and employees of the Defendant, acting within
the scope of their employment, sold and delivered to the Defendant
goods and materials at the times, in the amounts, of the kinds, and
for the prices set forth in a true and correct copy of Plaintiff's
book of original entry, a copy of which is marked Exhibit "A", and
Exhibit "A-l" to and including "A-19", attached hereto and made
part hereof, which goods and materials were received and accepted
by the Defendant.
7. The prices charged for said goods and materials are just
and reasonable and are the prices which the agents; servants, and
employees of the Defendant, acting within the scope of their
employment, orally promised to pay Plaintiff for the same.
a. The Plaintiff has demanded payment from Defendant in the
amount of $4,472.62, with delinquency charges in the amount of one
and one-fourth (1-1/4th%) percent per month after thirty (30) days,
but Defendant has refused and still refuses to pay the same or any
part thereof. Defendant delivered to Plaintiff check No. 2952
dated December 1, 1993, in the amount of $1,277,16, which check was
returned by the bank as "uncollectible funds". Defendant delivered
to Plaintiff check No. 2970 dated December 7, 1993, in the amount
of $2,743.90, which check was returned by the bank as
"uncollectible funds".
WHEREFORE, Plaintiff, Hempt Bros., Inc., demands judgment
against Defendant, Yentzer Bros. Construction, Inc., in the amount

COUNT II:
9. The allegations of paragraphs 1 to and including 8 are
incorporated herein by reference as though herein fully set forth.
10. The Plaintiff, at the special insistence and request of
the agents, servants, and employees of the Defendant, acting within
the scope of their employment, sold and delivered to the Defendant
goods and materials at the times, in the amounts, of the kinds, and
for the prices set forth in the invoices marked Exhibit "A-1" to
and including "A-19", attached hereto and made part hereof, which
goods and materials were received and accepted by the Defendant.
11. The prices charged for said goods and materials are just
and reasonable and are the prices which the agents, servants, and
employees of the Defendant, acting within the scope of their
employment, orally promised to pay Plaintiff for the same.
12. Plaintiff has demanded payment from Defendant in the
amount of $4,472.62, with delinquency charges in the amount of one
and one-fourth (1-1/4th%) percent per month after thirty (30) days,
but the Defendant has refused and still refuses to pay the same or
any part thereof. Defendant delivered to Plaintiff check No. 2952

13. As a result of the aforesaid, Defendant has been unjustly
enriched at Plaintiff's expense in the amount of $4,472.62.
WHEREFORE, Hempt Bros., Inc. demands judgment against
Defendant, Yentzer Bros. Construction, Inc., in the amount of
$4,472.62, together with delinquency charges in the amount of one
and one-fourth (1-1/4th%) percent per month, together with costs of
suit.
COUNT III
14. The allegations of paragraphs 1 to and including 13 are
incorporated herein by reference as though herein fully set forth.
15. The Plaintiff, at the special insistence and request of
the agents, servants, and employees of the Defendant, acting within
the scope of their employment, sold and delivered to the Defendant
goods and materials at the times, in the amounts, of the kinds, and
for the prices set forth in the invoices marked Exhibit "A-1" to
and including Exhibit "A-19", attached hereto and made part hereof,
which goods and materials were received and accepted by the
Defendant.
16. The prices charged for said goods and materials are just
and reasonable and are the prices which the agents, servants, and
employees of the Defendant, acting within the scope of their
employment, orally promised to pay Plaintiff for the same.
