At a pretrial conference held March 1. 1995, before
Edgar B, Bayley, Judge, present for the plaintiff was William P.
Douglas, Esquire, and for defendants. Tracy Thomas Cadzow,
Esquire.
This occident occurred at approximatelY 5:00a.m, on
November 4, 1993. Defendant truck driver operating a rig for
Reinsfe1der, Inc" pUlled out of a hotel parking lot in

Middiesex Township, crossed the two eastbound lanes, and made 0
left turn to proceed westbound toward Carlisle. Plaintiff, who
was proceeding westbound. collided with the truck, Plaintiff
claims the truck negligentlY crossed directly into his path.
Defendant denies liability.
Plaintiff seeks general damages, There is no claim
involving medicals, wage loss, or loss of earning capacity.

This action arises as the result of a motor vehicle acccident which
occurred on November 4, 1993, at between 5 and 6 A.M., on U.S Route 11 South
In Middlesex Township. The defendant had just completed a left turn from the
parking lot across the roadway into the right southbound lane of Route 11 when _
the plaintiff, attempting to pass him on the right, drove onto the shoulder of the

COMPLAINT
1. The plaintiff, Ivan Jones, is an individual stationed at Headquarters
Company of Carlisle Barracks, Carlisle, Cumberland County, Pennsylvania.
2. The defendant, Reinsfelder, Inc., has a place of business at 1023
North Avenue, Pittsburgh, Allegheny County, Pennsylvania.
3. The defendant, Frank W. Fritz, Jr., is an individual residing at 112
Wayne Street, Pittsburgh, Allegheny County, Pennsylvania.
4. On November 4, 1993, at or about 5 A.M., the plaintiff was
operating a rented 1993 Oldsmobile in a western direction on U.S. Route 11 in
Middiesex Township, Cumberland County, Pennsylvania.
5. At the same time and place, the defendant, Frank W. Fritz, Jr., was
operating a tractor-trailer in the course and scope of his employment with the
defendant, Reinsfelder, Inc., in an eastern direction on U.S. Route 11, which is a
four lane highway.
6. As the two vehicles approached each other, the defendant, Frank
W. Fritz, Jr., crossed the center line of the highway, and came into the westbound
lanes.
7. The plaintiff did all that he could to avoid a collision, by going on
the berm of the westbound lanes.
8. At that point, the defendant's tractor-trailer collided with the left
front of the rented vehicle being operated by the plaintiff.
9. The collision was caused by the negligence of the defendant, Frank
W. Fritz, Jr., operating in the course and scope of his employment with the
defendant, Reinsfelder, Inc., in the following respects:
(a) in failing to yield one-half of the highway, and
(b) in coming into the westbound lanes in the face of oncoming
traffic.
10. As a result of the negligence of the defendants, the plaintiff
sustained a low back injury, and an injury to his left thigh.
11. As a result of the aforesaid injuries, the plaintiff has undergone
great pain and suffering, as well as inconvenience and loss of life's pleasures.

12. The plaintiff has thus far been treated by doctors at the Dunham
Army Hospital.
13. As the plaintiff is still experiencing pain and suffering from these
injuries, it may well be that the plaintiff has sustained a permanent partial
disability to his low back as a result of these injuries.
WHEREFORE, the plaintiff claims of the defendants a sum in excess of
$10,000.00, and in excess of the amount requiring compulsory referral to
arbitration under the local rules of Court.

COMPLAINT
1. The plaintiff, Ivan Jones, is an individual stationed at Headquarters
Company of Carlisle Barracks, Carlisle, Cumberland County, Pennsylvania.
2. The defendant, Reinsfelder, Inc., has a place of business at 1023
North Avenue, Pittsburgh, Allegheny County, Pennsylvania.
3. The defendant, Frank W. Fritz, Jr., is an individual residing at 112
Wayne Street, Pittsburgh, Allegheny County, Pennsylvania.
4. On November 4, 1993, at or about 5 A.M., the plaintiff was
operating a rented 1993 Oldsmobile in a western direction on U.S. Route 11 in
Middlesex Township, Cumberland County, Pennsylvania.
5. At the same time and place, the defendant, Frank W. Fritz, Jr., was
operating a tractor-trailer in the course and scope of his employment with the
defendant, Reinsfelder, Inc., in an eastern direction on U.S. Route 11, which is a
four lane highway.
6. As the two vehicles approached each other, the defendant, Frank
W. Fritz, Jr., crossed the center line of the highway, and came into the westbound
lanes.
7. The plaintiff did all that he could to avoid a collision, by going on
the berm of the westbound lanes.
8. At that point, the defendant's tractor.trailer collided with the left
front of the rented vehicle being operated by the plaintiff.
9. The collision was caused by the negligence of the defendallt, Frank
W. Fritz, Jr., operating in the course and scope of his employment with the
defendant, Reinsfelder, Inc" in the following respects:
traffic.
(a) in failing to yield one-half of the highway, and
(b) in coming into the westbound lanes in the face of oncoming
10. As a result of the negligence of the defendants, the plaintiff
sustained a low back injury, and an injury to his left thigh.
11. As a result of the aforesaid injuries, the plaintiff has undergone
great pain and suffering, as well as inconvenience and loss of life's pleasures.

12. The plaintiff has thus far been treated by doctors at the Dunham
Army Hospital.
13. As the plaintiff is still experiencing pain and suffering from these
injuries, it may well be that the plaintiff has sustained a permanent partial
disability to his low back as a result of these injuries.
WHEREFORE, the plaintiff claims of the defendants a sum in excess of
$10,000.00, and in excess of the amount requiring compulsory referral to
arbitration under the local rules of Court.
