WHEREAS, RICKIE M. ALTHOUSE and KAREN S. ALTHOUSE of 2000 Haddam Necle
Court, Harrisburg, Pennsylvania, is about to execute contemporaneously herewith, a contract, with
CARLSON CONSTRUCTION INC. of Camp Hill, Pennsylvania, for the erection of a building upon
premises commonly mown as LOT A-44 CHARISMA DRIVE, EAST PENNSBORO 'IWP. CAMP
HILL, CUMBERLAND County, Pennsylvania, as set forth in the deed dated {i.p(l. ZO.I 'i'i~
recorded at Deed Boole , Page , in the Recorder's Office for CUMBERLAND County,
Pennsylvania, as more specifically described In Exhibit. A. which Is Incorporaled herein and attached
hereto.
NOW, APRIL 22, 1994, at the time of and Immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to commence
worle on the said building, or purchase materials for the same in consideration of the malting of the said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by
Owner, It is agreed that no lien shall be filed against the building by the Contractor, or any
subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or
materials purchased, or extra labor or materials purchased for the erection of said building, the right
to file such liens being expressly waived.
WITNESS, our hands and seals the day and year aforesaid.

ALL THAT CERTAIN piece or parcel of land situalc in East Pennsboro
. Township, Cumberland County, Pennsylvania, more particularly bounded and described in
accordance with the Final Subdivision Plan for Floribunda Heights, Phase II, Stage IV, prepared
by Martin &. Martin, Inc., and recorded in the Office of the Rccorder of Deeds of Cumberland
County in Plan Book 64, Page 69, as follows, to wit:
BEGINNING at a point on the southeaslcrly right of way line of Charisma
Drive (50 feet wide), said point being on the dividing line between Lot A-43 and A-44; thence
along the said dividing line South 50 degrees 06 minutes 23 secoads East a distance of 237.71
feet to a point on the dividing line between Lot A-44 and lands of Floribunda II Limited
Partnership; thence along the dividing line South 54 degrees 28 minutes 2S seconds West a
distance of 100.00 feet to a point being on the dividing line of Lot A-44 and Lot A-45; thence
along said dividing line North 50 degrees 49 minutes 13 seconds West a distance of 195.27 feet
to a point on the southeasterly right of way line of Charisma Drive aforesaid; thence continuing
along same right of way line by a curve to the len having a radius of 315.00 feet an arc length
of 101.15 feet and chord bearing of North 29 degrccs 58 minutes 49.S seconds East a distance
of 100.72 feet to a point, said point being the point and place of BEGINNING.
BEING Lot A-44 and containing .481 acre.
UNDER AND SUBJECT to conditions and restrictions set forth in
Cumberland County Miscellaneous Book 370, Page 296, and as shown on the above refereneed
plan recorded in Plan Book 64, Page 69.
ALSO UNDER AND SUBJECT, nevertheless, to all easements, rights of way,
and other matters of record or that a physical inspection or survey of the premises would revcal.
