Galla, and her counsel, after proper service of notice to the Complainant, Walter D. Galla, who does not appear, but is represented by counsel, upon Petitioner's Motion to Reopen and Petition to Show Cause, upon Complainant's Motion to Void Separation Agreement, upon Petitioner's notice of presentation, and was argued by counsel. UPON CONSIDERATION whereof, the Court finds from the evidence that the parties were lawfully divorced on December 11, 1981, by Final Decree of Divorce that incorporated, confirmed, ratified, approved, and adopted a Separation Agreement signed by the parties on August 29, 1980; that this Separation Agreement signed by the parties on August 29, 1980; that this Separation Agreement provided for spousal support to be paid by the husband to the wife in the amount of $520.00 every two weeks; that the Husband owed a total of $81,120.00 for the period from June of 1987 through May of 1993; that the Husband has paid a total of $17,982.00 during this same period; and that he is in arrearage of $63,138.00. Pursuant to S20-63.3 of the Code of Virginia (1950), as amended, it is ORDERED that: 1. Support payments may be withheld as they become due pursuant 3'llid \O-~1-q~ ~ 1 ... , 1- ..- to 520-79.1 or 520-79.2, of the Code of Virginia (1950), as amended, from earnings as defined in 563.1-250, without further amendments of this Order of having to file an application for services with the Department of social Services; however, absence of such notice in an order entered prior to July 1, 1988, shall not bar withholding of support payments pursuant to 520-79.1; 2. Support payments may be withheld pursuant to 563.1-249 ~ ~. of the Code of Virginia (1950), as amended without further amendments to this order, upon application for service with the Department of Social Services; however, absence of such notice in an order entered prior to July 1, 1988, shall not bar withholding of support payments pursuant to Chapter 13 of Title 63.1; 3. Walter D. Galla, date of birth August 5, 1939, social security number 345-30-3562, currently resides at 226 North Bedford, P.O. Box 1155, carlisle, PA 17013, and is employed by Reeves-Hoffman, 400 West North Street, Carlisle, PA 17013; 4. Walter D. Galla owes Antoinette J.M. Galla $520.00 every two weeks, beginning September 5, 1980, and continuing every two weeks thereafter; 5. Support arrearage exists in the amount of $63,138.00 through May, 1993, calculated as follows: From June 1987 through May, 1983, the amount of support owed was $81,120.00. During this period Mr. Galla paid Ms. Galla a total of $17,982.00. All payments are to be credited to current support obligations first, with any payment in excess of the current obligation applied to arrearage; 6. In determination of a support obligation, the support 2 - ~ .- .- obligation as it becomes due and unpaid creates a judgment by operation of the law; 7. Walter D. Galla, by counsel, excepts and objects to the Court's rUling for the following reasons: 1. The Separation Agreement entered into by the parties on september 5, 1980, is void as it was procured by fraud arising from the improper representation of both parties by a single counsel, as proffered by Complainant'u co~nsel to this Court. Respondent's counsel did not object to the statement that one attorney was involved in the divorce proceedings; and 2. The Court improperly determined the arrearage by considering payments made between the dates of June 1987 and May 1993, rather than considering and crediting Complainant's actual payments made from the September 5, 1980, the date the parties entered into the agreement and May of 1993.
