IN RE: PRETRIAL CONFERENCE
At a pretrial conference held Wednesday, October 26th,
1994, before the Honorable Harold E. sheely, President Judge,
present for the Plaintiff was Robert L. o'Brien, Esquire, and he
indicates that he will be available during the week of November
14th, 1994, for trial.
Ford Motor company is represented by James S. Dobis,
Esquire. He did not attend the pretrial conference, and the
Court was given no reason for his nonappearance. His pretrial
memorandum was faxed to counsel for the Plaintiff. Counsel for
the plaintiff gave it to the Court today.
This is a jury trial which should take one and one
half days to complete. plaintiffs filed this civil action under
the Automobile Lemon Law, 73 P.S. 1951 et. sea. Plaintiffs
bought a Ford Taurus station wagon on June 4th, 1993, from L. B.
smith, Inc., a Ford dealer located in Cumberland County,
Pennsylvania.
Plaintiffs allege that the vehicle had a malfunction
of the fuel gauge since it was purchased and that this is a
non-conformity which impairs the use, value, or safety of the

motor vehicle. The parties went through the informal dispute
settlement procedure, and this complaint was filed on April
26th, 1994.
The damages sought by the Plaintiffs are that the
vehicle be returned to the manufacturer and that the
manufacturer refund to the Plaintiffs the full purchase price
including all collateral charges less a reasonable allowance for
the purchaser's use of the vehicle not exceeding ten cents per
mile driven or ten percent of the purchase price of the vehicle,
whichever is less. The remedy section under the above statute
is section 1955.
Section 1958 of the Act provides that in addition to
other relief, the Plaintiffs shall be entitled to recover
reasonable attorney's fees and all court costs. On the issue of
attorney's fees, the Court would direct that counsel for the
Plaintiffs submit a brief on the issue as to whether or not this
is a jury question or whether or not the Court should determine
what are reasonable attorney's fees.
There does not seem to be any other outstanding legal
matters, and the pretrial memorandum of the Defendant indicates
that there have been no settlement negotiations, and, therefore,
the Court would anticipate the case will be tried.

COMPLAINT
1. This Complaint is brought under the Automobile Lemon Law, 73
P.S. Section 1951, by the Plaintiffs, Joe P. Lacy and Patricia D. Lacy
residing at 99 Margaret Drive, Mechanicsburg, Pennsylvania, 17055.
2. Defendant is Ford Motor Company, with corporate headquarters
at The American Road, Dearborn, Michigan, 48121.
3. Plaintiffs are purchasers pursuant to the aforesaid law,
having purchased the vehicle on June 4, 1993 for family and personal
use. The vehicle is a Ford Taurus LX Station Wagon, purchased as a
new vehicle, VIN # IFALP5848PA242929. On or about June 28, 1993, the
vehicle had an odometer reading of 1193 miles and was returned to the
dealer, L.B. smith, Inc. for a number of adjustments including an
inaccurate gas gauge.
4. The gas gauge reserve light is to read when approximately
two (2) gallons of gas remain in the gas tank. The gas light in this
particular vehicle comes on with approximately five (5) gallons of
gasoline remaining in the gas tank. Likewise, the fuel gauge reading
shows that the tank is empty, when there are several gallons of gas
remaining in the vehicle.

5. The aforesaid problem with the gas tank is a non-conformity
which substantially impairs the use, value or safety of the motor
vehicle.
6. The Plaintiffs have returned the vehicle to correct this
problem at least six (6) times on or about the following dates:
June 28, 1993; Mid-July, 1993; August 13, 1993; October 12, 1993;
November 4, 1993; and, November 22, 1993.
7. The Plaintiffs aver that the manufacturer has failed to
repair or correct the non-conformity after a reasonable number of
attempts.
8. The Plaintiffs in this action will incur attorney's fees in
pursuing the civil cause of action and allege that the manufacturer/
Defendant should pay reasonable attorney's fees as part of the amounts
recoverable, as well as all court costs provided for in 73 P.S.
Section 1958.
9. The Plaintiffs elect that they return the motor vehicle to
the manufacturer in exchange of the refund of the full purchase price,
including all collateral charges, less a reasonable allowance for the
Plaintiffs' use of the vehicle prior to the first report of the
nonconformity not to exceed $.10 per mile driven or 10 percent of the
purchase price of the motor vehicle, whichever is less as provided for
in 73 P.S. Section 1955.
10. The Plaintiffs have utilized the informal dispute settlement
procedure by submitting the matter to the Dispute Settlement Board,
P.O. Box 5120, South Field, Michigan, 48086-5120.

WHEREFORE, Plaintiff respectfully requests that they be permitted
to return the vehicle in exchange for the purchase price, including
all collateral charges, less a reasonable allowance for the
Plaintiffs' use of the vehicle, attorney's fees and costs, all of
which exceed $20,000.00.

1) BASIC FACTS AS TO LIABILITY:
This action is brought under the Automobile Lemon Law. The
Plaintiff's have had a malfunction of the fuel gauge since purchase of
the automobile. Despite repeated returns to the dealer, the problem
remained uncorrected. Plaintiffs contend that the defect is a non-
conformity which impairs the use, value or safety of the motor
vehicle.
2) BASIC FACTS AS TO DAMAGES:
Plaintiffs elect to return the auto to the manufacturer for
purchase price, attorney fees, and collateral charges less mileage, at
ten cents per mile, from when the problem was first reported.

If a jury determines that the defect falls under the Lemon
Law, the Plaintiffs are entitled to the remedy that they have elected.

PROTECTIVE ORDER
1) Movant is Robert L. O'Brien, Esquire, attorney for Joe P.
Lacy and Patricia D. Lacy, Plaintiffs in the above-captioned matter.
2) Respondent is Ford Motor Company, Defendant in the above-
captioned matter. Respondent has filed 90 plus interrogatories in
violation of local rules of court.
3) The interrogatories are a typical word processed form
without any consideration given to relevance or logic. The
interrogatories as drafted are overly broad and burdensome. As an
example, questions 1-6 and 8 are specific or necessarily implicitly
answered by the Complaint.
WHEREFORE, Movant respectfully requests that the Court issue a
Rule upon Respondent Ford Motor Company to show cause why a protective
order should not be issued.

PLAINTIFFS' REPLY
TO DEFENDANT'S NEW MATTER
AND NOW, COMES the Plaintiffs, by and through their attorney,
Robert L. O'Brien, Esquire, and reply as follows:
4) To the extent that the Defendant's response states a
conclusion of law, no reply is required. The Plaintiffs aver that the
condition of the automobile substantially impairs the use, value or
safety of the vehicle.
5) The Plaintiffs have stated in their Complaint that the
Defendant was given the opportunity on at least five (5) different
occassions to correct the defect. Depsite the Defendant's
opportunities to correct same, it has neglected or refused.
WHEREFORE, the Plaintiffs request the Court enter judgment in
their favor and against the Defendant, Ford Motor Company.
