COMPLAINT
COUNT I . REPLEVIN
AND NOW comes Green Tree Censumer Discount Company. by and through its ettorney Erin P. Dyer end
avers the following in support ef its Complaint in Replevin:
1. Green Tree Consumer Discount Company, hereinafter referred to es "Plaintiff; is a cerporetion
duly authorized te conduct business in the Commonwealth of Pennsylvania and has its principal place ef business
loceted et 300 Weyman Plaza, Suite 480, Pittsburgh, PA 15236.0306.
2. Anastasia Leigh Shive, hereinafter referred to as "oafendant," is an individual whosa last known
address is at 130 Castle oriva, Mechanicsburg, PA 17055.
3. On or about August 25, 1989, Defendant purchased a 1979 Suprema Homas Model 20480
Manufactured Heme Serial No. S7oF3502o48o, (the "Mobile Home"), from Reyal Financial. Inc., (the "Seller").
and entered into a written Manufactured Home Retail Installment Contract and Security Agreement, (the "Security

Agreement") for the payment ef a portion of the purchase price thereof. A true and Cerrect copy ef the Security
Agreement is ettached hereto as Exhibit "A."
4. Seller assigned its interest in the Security Agreement to Green Tree Acceptence. Green Tree
Acceptence perfected its security interest in said mobile home by having an encumbrance on the title therete.
A true and correct copy of the Certificate of Title is attached hereto es Exhibit "8." Green Tree Acceptence
assigned its interest in said Security Agreement to Plaintiff, Green Tree Consumer Discount Company.
5. Plaintiff avers that the epproximate retail value ef said Mobile Home is $7,900.00 and that the
said Mobile Home is in Defendant's possession but its exact whereabouts are uncertain.
6. Defendant defaulted under the terms of the Security Agreement by failing to make payments
when due. As of February 14, 1994, the Defendant's payments of interest and principal were in arrears in the
amount ef $882.68. Pursuant te the Acceleration Clause in the Security Agreement the amount outstanding as
of February 14, 1994, is $9,989.23.
7. Plaintiff provided Defendant with thirty 130) days notice of intent to repossess the Mobile Home.
A true and correct copy of the notice of intent to repossess the Mobile Home is attached herete as Exhibit "C."
8. Defendant has failed to either cure the default or return the Mobile Home upon Plaintiff's
demand.
9. Plaintiff avers that under the terms of the Security Agreement and Pennsylvania law it is now
entitled to immediate possession of said Mobile Home.
1 O. The Security Agreement provides that in the event of default:
a. Defendant will pey seller's reasonable attorney's fees, provided that prior to
commencement of legal action such fee shall not exceed $50.00;

b. Court costs and disbursements; and
c. Costs incurrad by seller to foreclose on the Mobile Home including tha costs of storing,
reconditioning and reselling the Mobile Home.
11. In order to bring this action Green Tree Consumer Discount Company was required to retain en
ettorney and did so retain Attorney Erin P. Dyer.
12. Attorney Dyer accepted the engagement at the hourly rate of $100.00, which is fair and
reesonable.
WHEREFORE, Plaintiff, Green Tree Consumer Discount Company, requests judgment against Defendent
to recover the Mobile Home. plus detention damages, special damages consisting of inter a/i8, detaching and
transporting tha Mobile Home, shipping fees, any cost fer insurance placed on the Mobile Home by Plaintiff. late
charges par the Security Agreement, eny further costs for repossession and sale, end attorney's fees and costs
ef litigation in order te obtain possession of the Mobile Home.
COUNT II . DAMAGES
By way of separate end elternative pleading, Plaintiff, Green Tree Consumer Discount Cempany, alleges
the following:
13. Peregraphs 1 through 12 ef this Compleint are incerporated herein by reference as though fully
set forth.
14. This Count is brought in the alternative to the relief sought in Count I.
WHEREFORE, Plaintiff. Green Tree Consumer Disceunt Company, requests judgment against Defendant
in the emount of $9,989.23 with interest and late charges. and speciel damages consisting ef inter 8/i8,

dataching and transporting tha Mobila Homa, shipping feas, any cost for insuranca placad on tha Mobila Homa
by Plaintiff. lata chargas par tha Sacurity Agreemant. any furthar costs for rapossassion and sala, and allornay's
feas and costs of litigation in ordar to ebtain possession of tha Mebila Homa.

COMPLAINT
COUNT I . REPLEVIN
AND NOW comes Green Tree Consumer Discount Company, by and through its allorney Erin P. Oyer and
avers tha following in support of its Complaint in Replevin:
1. Green Tree Consumer Discount Company, hereinafter referred te as "Plaintiff," is a corporation
duly authorized te conduct business in the Commonwealth of Pennsylvania and has its principal piece of business
loceted at 300 Weyman Plaza. Suite 480. Pillsburgh, PA 15236.0306.
2. Anastasia Leigh Shive, hereinafter referred to as "Defendant." is an individual whose last known
address is at 130 Castle Drive. Mechanicsburg. PA 17055.
3. On or about August 25. 1989, Defendant purchased a 1979 Supreme Homes Model 204BO
Manufactured Home Serial Ne. S70F35D20480, (the "Mobile Home"l. from Royal Finencial, Inc.. (the "Seller").
end entered inte a wrillen Menufactured Home Reteillnstallment Contract and Security Agreement. (the "Security
Agreement"' for the peyment of e portion ef the purchase price thereof. A true and correct copy of the Security
Agreement is attached hareto es Exhibit "A."
4. Seller essigned its interest in the Security Agreement to Green Tree Acceptence. Green Tree
Acceptence perfected its security interest in said mobile home by heving en encumbrance on the title thereto.
A true end correct copy ef the Certificate ef Title is attached hereto as Exhibit "B." Green Tree Acceptence
essigned its interest in said Security Agreement te Plaintiff. Green Tree Consumer Discount Company.
5. Plaintiff avers that the approximate retail value of said Mobile Home is $7,900.00 end that the
said Mobile Home is in Defendant's possession but its exact whereabouts are uncertain.
6. Defendant defaulted under the terms of the Security Agreement by failing to make payments
when due. As of February 14. 1994, the Defendant's payments of interest and principal were in arrears in the
amount of $882.68. Pursuant to the Acceleretion Clause in the Security Agreement the amount outstanding as
of February 14. 1994. is $9,989.23.
7. Plaintiff provided Defendant with thirty (30) days notice of intent to repossess the Mobile Home.
A true end correct copy of the notice of intent to repossess the Mobile Home is ettached hereto as Exhibit "C."
8. Defendant has failed to either cura the default or return the Mobila Home upon Plaintiff's
demand.
9. Plaintiff avers that under the terms of the Security Agreement and Pennsylvania law it is now
entitled to immediate possession of said Mobile Home.
10. The Security Agreement provides that in the event of default:
a. Defendant will pay seller's reasonable attorney's fees, provided that prior to
commencement of legel ection such fee shall not exceed $50.00;

b. Court costs and disbursements; and
c. Costs incurred by seller to foreclose on the Mobile Homa including tha costs of storing.
reconditioning and reselling the Mobile Home.
11. In order te bring this action Green Tree Consumer Discount Company was required to retain an
allorney and did so retain Allorney Erin P. Dyer.
12. Allorney Dyer accepted the engagement at the hourly rate of $100.00. which is fair end
reasonable.
WHEREFORE, Plaintiff. Green Tree Consumer Discount Company, requests judgment against Defendent
to recover the Mobile Home, plus detention demages, special damages consisting of inter 81i8. detaching and
transporting the Mobile Home. shipping fees, any cost for insurance placed on the Mobile Home by Plaintiff, late
cherges per the Security Agreement, any further costs for repossession and sale. end allorney's fees and costs
of litigation in order to obtain possmion of the Mobile Home.
COUNT II . DAMAGES
By way of separate and alternative pleading, Plaintiff, Green Tree Consumer Discount Cempany, alleges
the following:
13. Paragraphs 1 through 12 of this Complaint are incorporated herein by reference as theugh fully
set forth.
14. This Count is brought in the alternative to the relief sought in Count I.
WHEREFORE. Plaintiff, Green Tree Consumer Discount Company. requests judgment egainst Defendant
