Whereas, William C. Porter entered into a contract date4 ~
Od"bPr '3/ ,199J, ("Contract"), with lIerburt G. Weaver, t/d/b/a Ridge
View Custom lIomes to provide materials and perform labor necessary for the
erection, construction, alteration or repair of a dwelling house, situate
upon that certain lot or piece of ground located in Southampton Township,
Cumberland County. Pennsylvania, and more particularly described aa
follows:
WAIVER OF LIFJlS
ALL TIIAT CERTAIN tract of land situate in Southampton Township,
Cumberland County, Pennsylvania, refurred to aa Lot No. 10 on
"Final (.and Subdivision of Crestwood Acres East" as recorded
in Cumberland County Plan Book 66, Page 83, said lot having
been conveyed to Wiliiam C, Porter by deed recorded in Cumberland
County Deed Book "P", Volumu 36, Page 110, on October 19, 1993.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the
said parties. 6S part of thu contract and for the consideration therein set
forth, that nelther the underslgned contractor, any subcontractor or
material man, nor any other person furnishing labor or materials to the
said contractor under the Contract shall file a lien, commonly called a
mechanics' lien, for work done or materials furnished to the said building
or any part thereof.
This stipulation is made and intended to be filed with the County
Prothonotary for the County of Cumberland, Commonwealth of
Pennsylvania in accordance with the requirements of Section 402 of the
Mechanics' Lien Law of 1963, Pa. Stat. Ann. tit. 49, Section 1402 (Purdon
1965) of the Commonwealth of Pennsylvania in such case provided.
