COMPLAINT IN MORTGAGE FORECLOSURE
Commerce Bank ("Commerce") by its attorneys, Mette, Evans &
Woodside, files the following Complaint in Mortgage Foreclosurel
1. Plaintiff is Commerce Bank, a Pennsylvania banking
corporation maintaining offices at 100 Senate Avenue, Camp Hill,
Cumberland County, PA 17011.
2. Defendant Jeffrey T. Fleming, is an adult individual
now or formerly residing at 300 South Front Street, Lemoyne, PA
17043.
3. Ruby L. Fleming is an adult individual now or formerly
residing at 20 North Second Street, Wormleysburg, PA 17043.
4. On January 31, 1992, Defendants executed Guaranty
Agreements (the "Guaranty Agreements") in favor of Commerce

promising to pay all indebtedness of Fleming Drywall, Inc.
evidenced by a January 31, 1992 Collateral Note in the original
principal amount of $30,000.00. True and correct copies of said
Guaranty Agreements are attached hereto as Exhibit A and made a
part hereof.
5. The Guaranty Agreements were secured by a Mortgage
executed by Defendants, as Mortgagors in favor of Commerce as
Mortgagee (the "1/31/92 Mortgage"). Said 1/31/92 Mortgage was
recorded in the Office of the Recorder of Deeds for Cumberland
County on February 3, 1992 in Mortgage Book I045 at page 596-597.
A true and correct copy of said 1/31/92 Mortgage is attached
hereto as Exhibit B and made a part hereof.
6. On October 22, 1992, Defendants executed a Note and
Security Agreement ("10/22/92 Note") in favor of Commerce in the
original principal amount of $19,994.45. A true and correct copy
of said 10/22/92 Note is attached hereto as Exhibit C and made a
part hereof.
7. On October 22, 1992, Defendants executed as Mortgagors
a Mortgage in favor of Commerce as Mortgagee securing the
indebtedness represented by the 10/22/92 Note (the "10/22/92

Mortgage"). Said 10/22/92 Mortgage was recorded in the Office of
the Recorder of Deeds for Cumberland County in Mortgage Book
1099, page 488-489. A true and correct copy of said 10/22/92
Mortgage is attached hereto as Exhibit D and made a part hereof.
8. The property subject to the 1/31/92 Mortgage and the
10/22/92 Mortgage, described with particularity therein, has a
street address of 20 North Second Street, Wormleysburg,
Cumberland County, PA 17043 (the "Property").
9. Defendant Jeffrey T. Fleming is the real owner of the
property. It is believed and therefore averred that Defendant
Ruby L. Fleming, former wife of Jeffrey T. Fleming, has no legal
or equitable interest in the Property.
10. Commerce has not assigned the Guaranty Agreements, the
1/31/92 Mortgage, the 10/22/92 Note, or the 10/22/92 Mortgage,
either in whole or in part.
11. No judgment has been entered on the Guaranty
Agreements, the 1/31/92 Mortgage, the 10/22/92 Note, or the
10/22/92 Mortgage. The Guaranty Agreements, the 1/31/92
Mortgage, the 10/22/92 Note, and the 10/22/92 Mortgage are less
than 20 years old.

12. Defendants defaulted on the Guaranty Agreements by
failing to make payments on the 1/31/92 Note when due for the
months August-December, 1993 and January, February, March and
April, 1994. Such defaults are continuing.
13. Defendants defaulted on the 10/22/92 Note by failing to
make payments when due for the months December, 1993 and January,
February, March and April, 1994. Such defaults are continuing.
14. The entire indebtedness of Defendants to Commerce is
now due and payable in full under the terms of the Guaranty
Agreements, the 1/31/92 Note, and the 10/22/92 Note. Such
indebtedness includes principal, interest at the rates provided
in the 1/31/92 Note and the 10/22/92 Note, late fees, attorney's
fees and other costs of suit.
15. The total indebtedness of the Defendants to Commerce on
the 1/31/92 Note and the 10/22/92 Note is $48,673.75 through
April 17, 1994, computed as follows:

Interest continues to on the 1/31/92 Collateral Note, secured by
the Guaranty Agreements, at the ~ ~ rate of $5.06161 from
4/18/94. Interest continues to accrue on the 10/22/92 Note at
the ~ ~ rate of $5.2455.
16. Defendant Jeffrey T. Fleming filed his Petition under
Chapter 13 of the Bankruptcy Code on December 15, 1993 to
Bankruptcy No. 93-02182 in the United States Bankruptcy Court for
the Middle District of Pennsylvania, Harrisburg Division.
17. By Order dated April 15, 1994, the Honorable Robert J.
Woodside, Chief Bankruptcy Judge, granted Commerce Bank's Motion
for Relief from the Automatic Stay with respect to the property
located at 20 North Second Street, Wormleysburg, PA. A true and
correct copy of said Order is attached hereto as Exhibit E and
made a part hereof.
WHEREFORE, Plaintiff Commerce Bank requests that your
Honorable Court enter Judgment in Mortgage Foreclosure in favor
of Commerce Bank and against Defendants Jeffrey T. Fleming and
Ruby L. Fleming in the amount of $48,673.75 through April 17,
1994 plus interest at the rates provided in the Notes, attorneys
fees and all other costs and expenses incurred after April 17,

1994, as provided in the 1/31/92 Mortgage and the 10/22/92
MortgageJ directing foreclosure and sale of the mortgaged
PropertYJ and awarding Commerce Bank such other relief as is just
under the circumstances.

certified mailing.
2. On June 28, 1994, she deposited in the United States mail,
the Notice pursuant to Pennsylvania Rule of Civil Procedure
3129.2(c) (1) (Hi) to Ruby L. Fleming addressed to 20 N. Second
Street, Wormleysburg, PA 17043, by certified mail, return receipt
requested, restricted delivery, to No. P 125 077 956, postage
prepaid. Attached hereto and made a part hereof as Exhibit "C" is
the certified mail receipt evidencing delivery of said Notice.
3. On August 1, 1994, she deposited in the United States
mail, first-class, postage prepaid, the Notice pursuant to
Pennsylvania Rule of Civil Procedure 3129.2(c)(1)(iii) to the other
persons listed on the Notice and at the addresses shown on the
certificates of mailing.
Such persons were named and their
addresses were set forth in the affidavit which Plaintiff filed on
June 15, 1994. Exhibit "D" attached hereto and made a part hereof
contains the certificates of mailing evidencing such service.
