6. Dwayne Reynolds is currently incarcereted in the State Correctional
Facility havina pled guilty on November 26, 1993, to Third Oelree Hurder,
Aaaravated Aesault and Criminal Conspiracy. A copy of the Sentancina Order
issued by The Honorable Robert J. Eby, Lebanon County Court of Common Pleae
Judae, is attached hereto as Exhibit 3.
7. The Superintendent of the State Correctional Facility in Camp Hill
doea not object to relea.inl custody of Hr. Reynolds for the purposes of
te.tifyina on behalf of the Commonwealth on Hay 11, 1994.

COUNT '111- PRESENTS that on or about JUNE 06, 1993 the above
defendant did commit the crime of AGGRAVATED ASSAULTt in that he
feloniously and unlawfully did attempt to cause, or ntentionally,
knowingly or recklessly did cause serious bodily injury to another
under circumstances manifesting extreme indifference to the value
of human life, namely, the defendant did inflict serious bodily
injury upon OSVALDO LOPEZ, when he repeatedly exposed him to
severe physical contact, by kicking and punching him numerous
times about the head and body, and dragging him around an alley,
which rendered the victim incapable of defending himself from the
said assault, in the area ~f Willow & Partridge streets, city of
Lebanon, Lebanon County, Pennsylvania, this being in violation of
Section 2702 (al(ll of the Crimes Code of Pennsylvania.

COUNT 'IV- PRESENTS that on or about JUNE 06, 1993 the above
defendant did commit the crime of CRIMINAL CONSPIRACY in that he
with the intent of promoting or facilitating the commfssion of a
crime of aggravated assault, feloniously and unlawfully did agree,
conspire and/or act as an accomplice of Allen Edward Feaser, in
the planning or commission of such a crime or of an attempt or
solicitation to commit such a crime, and did an overt act in the
pursuance thereof I namely, in that they did inflict serious bodily
injury upon Osvaldo Lope., by kicking and punching him numerous
times about the head and body, and dragging him around an alley,
which caused the victim to suffer injuries to the extent that he
was incapable of defending himself from the said assault, in the
area of Willow & Partridge streets, City of Lebanon, Lebanon
County, Pennsylvania, this being in violation of Section 903 (a)
of the Crimes Code of Pennsylvania.
all of which is against the Act of Assembly and the
dignity of the Commonwealth of Pennsylvania.
