STIPULATION AGAINST LIENS
THIS AGREEMENT made this .)IS~- day of March, 1994, by and
between Robert Lee Whitmer, hereinafter referred to as contractor,
and Robert Lee whitmer and Robert E, Whitmer and Wanda L, Whitmer,
husband and wife, hereinafter referred to as owners, whereby the
former undertook and agreed to erected and construct a commercial
building on that certain lot of ground situate in Southampton
Township, Cumberland County, Pennsylvania,
NOW THEREFORE, THIS AGREEMENT WITNESSETH I That the said
contractor, for and in consideration of the sum of One ($1.00)
Dollar to Robert Lee Whitmer, in hand paid by Owner, the rece.\pt
whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid for themselves and their
subcontractors, and all parties acting through or under them,
covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said contractor, for themselves, their
subcontractors and others under them hereby expressly waive and
relinquis~ the right to have, file, and maintain any mechanic's
lien or claims against the said buildings or any of them, and agree
that this instrument, waiving the right of lien, shall be
independent covenant,

TRACT ONEI ALL that certain tract of land situate in southampton
Township, cumberland County, Pennsylvania, bounded and described
as tollowsl
BEGINNING at a point in the center of a public road leading
from Big Pond to Cleversburg, said point being 338 1/2 feet,
South 65 degrees West, from a common corner of land now or
formerly of Mrs. George Burns; thence along the center of the
aforesaid public road, South 65 degrees West, 200 feet to an iron
pin in the center of said road; thence by other land now or
formerly of the Grantors, South 25 degrees East, 210 feet to an
iron pin; thence by the same, North 65 degrees East, 200 feet to
an iron pin; thence by same, North 25 degrees West, 210 feet to
the place of BEGINNING.
BEING that same real estate that Eber Whitmer and Bessie
Jane Whitmer, a/k/a Bessie J. Whitmer, by their deed dated June
6, 1967 and recorded in the Office of the Recorder of Deeds in
and for Cumberland County, Pennsylvania, in Deed Book liLli, Volume
22 at Page 256, conveyed to Robert Eber whitmer and Wanda Lee
whitmer, husband and wife, Grantors herein,
TRACT NO, 21 ALL that certain small tract of land situate in the
Township of southampton, county of Cumberland, Commonwealth of
Pennsylvania, bounded and described as follows, to wit:
BEGINNING at a point at corner of lands of the Grantees
herein at a point in the center of a public road leading from Big
Pond to Cleversburg; thence along the center of the aforesaid
publi~~road, South 65 degrees West, 15 feet to a point in the
center of said road at other land now or formerly of the Grantors
herein; thence by other land now or formerly of the Grantors
herein, South 25 degrees East, 210 feet to a point; thence by
same, North 65 degrees East, 15 feet to a point at corner of
other land now of the Grantees herein; thence by other land of
the Grantees herein, North 25 degrees West, 210 feet to the place
of BEGINNING.
BEING that same real estate that Bessie J. Whitmer, widow
and single woman, and Bruce E. Whitmer and Vera J. Whitmer,
husband and wife, by their deed dated May 10, 1973 and recorded
in the Office of the Recorder of Deeds in and for Cumberland
county, Pennsylvania, in Deed Book "F", Volume 25 at Page 1002,
conveyed to Robert Eber Whitmer and Wanda Lee Whitmer, husband
and wife, Grantors herein.
