COUNT I . REPLEVIN
AND NOWI Comes tbe Plaintiff, Green Tree Consumer Discount Company, by and
through its attorney, Dennis M. Blackwell, Esquire, and liles the within Complaint in Civil
Action - Replevin, and in support thereof avers as follows:
1. Plaintiff, Green Tree Consumer Discount Company, (hereinafter referred to
as "Grtlen Tree) is a corporation authorized to conduct business in the Commonwealth of
Pennsylvania and which does business and maintains offices at 300 Weyman Plaza,
Pittsburgh, Allegheny County, Pennsylvania 15236.
2. Defendants are Annette L. Roush and Terry A, Roush, (hereinafter referred
to as "Roush"), adult individuals whose last known address was 7073 Carlisle Pike, Lot 313,
Carlisle, Cumberland County, Pennsylvania, 17013.
3. On or about March 23, 1992, Defendant, Roush, purchased from Green Tree
a 1983 Zimmer Mobile Home, VIN 1/ ZZP196S0 punuant to the terms and conditions set
forth In a certain Manufactured Retail Installment Contract and Security Aareement
(hereinafter referred to as "Contract") a copy of which Is attached hereto, made a part
hereof and designated Exhibit "A".
4. The 1983 Mobile Home was purchased and placed at 7073 Carlisle Pike, Lot
313, Carlisle, Pennsylvania 17013, and 15 currently located at the same address.
5. Punuant to said "Contract", Roush assumed the unpaid balance of the
obligation which Included an annual Interest rate of twelve (12%) percent per annum In 180
consecutive monthly Installments of $207,40 commencing on May I, 1992.
6, Punuant to said "Contract", Exhibit "A" Seller, Royal Finance of Pennsylvania,
retained a security Interest In said 1983 Zimmer Mobile Home.
7. The "Contract" was assigned by the seller, Royal Finance of Pennsylvania, to
Green Tree. Said Assignment Is noted on the "Contract" and Green Tree retained a security
Interest In said Mobile Home.
8. Punuant to said Assignment, Green Tree further secured Its lien on the
Mobile Home by noting same on the certificate of title. A copy of said Certificate of Title
Is attached hereto, made a part hereof and designated Exhibit "B".
9. Defendant, Roush is currently In default of the provisions of the Contract,
Exhibit "A", having in1n IillA failed to make the agreed upon monthly payments of $231.30.
10. Despite repeated requests by Green Tree, Engleman has failed and refused
to make any payments except for $231.30 on January 31,1994 (which represents December,
1993 payment) and further, continues to maintain wrongful possession of the 1983 Zimmer
Mobile Home.
11. The total balance required to bring the "Contract", Exhibit "A", current 88 of
April 26, 1994, is the sum of Nine Hundred Twenty-Five and 20/100 ($925,20) Dollars and
the total balance due and owing as of said date pursuant to said "Contract" is currently the
sum of $17,676.03.
12. Pursuant to the tenns and provisions of the "Contract", Exhibit "A", Plaintiff
is entitled to immediate possession of said 1983 Zimmer Mobile Home.
13, On or about January 29, 1994, pursuant to the mandates of the Pennsylvania
Motor Vehicle Sales Finance Act of 1947,69 P.S. Ii 601 et. seq., Green Tree delivered to
Roush a Notice of Intention to Accelerate, Commence Legal Action or Repossess, said
Notice being &ent to Defendants In advance of the thirty (30) days commencing this action.
A copy of said Notice is attached hereto, made a part hereof, and designated Exhibit "C',
14, Green Tree Is entitled to detention damages, special damll8es, consisting of
inW BIiB, detaching and transporting the Mobile Home, shipping fees, and any late charges
per the "Contract", further costs for repossession and sale and attorney's fees and costs of
litigation necessary to obtain possession of the 1983 Zimmer Mobile Home.
WHEREFORE, Plaintiff, Green Tree, requests judgment against Defendant to
recover the 1983 Zimmer Mobile Home, located at 7073 Carlisle Pike, Lot #313, Carlisle,
Pennsylvania 17013, plus detention damages, and special damages consisting of inW BIiB,
detaching and transporting the Mohlle Home, shipping fees, plus any cost for insurance
placed on the Mohile Home by Green Tree, late charges per the "Contract", any further
costs for repossession and sale, attorney's fees and costs of litigation in order to obtain

Daniel Peiper, Deputy Sheriff who being duly sworn according to law,
says on Hay 5, 1994 at 8144 o'clock A.M.E.D.S.T., he served a true copy
of Reinstated Complaint in Civil Action Replevin, in the above entitled
action upon one of the within named defendants to witl Annette L. Roush,
by making known unto Annette I.. Roush at 7073 Carlisle Pike, Lot 313
Carlisle, Cumberland County, Pennsylvania, its contents and at the same
time handing to her personally the said true and attested copy of
the same.
R. Thomas Kline, Sheriff who being duly sworn according to law,
says he made diligent search and inquiry for one of the within named
defendant to witl Terry A. Roush, but was uanb1e to locate him in his
bailiwick. He therefore deputized the Sheriff of Dauphin County,
to serve the within Reinsated Complaint in Civil Action Replevin.

a 1983 ZImmer Mobile Home, VIN * ZZP196S0 pursuant to the termslDd condltloDl set
forth ill a certain MlDufactured Retail InstaUment Contract and Security Aareement
(hereiD.fler referred to u "Contract") a copy of whicb is attacbed bereto, made a part
bereof IDd deslgoated Exhibit "A".
4. Tbe 1983 Mobile Home wu purcbased and placed at 7073 Car1lsle PIke, Lot
313, Carlisle, Pennsylvaola 17013, and Is currently located at the same address.
S. PursUlDt to said "Contract", Rousb assumed the unpaid balance of the
obligation whlcb iDcluded an annual interest rate of twelve (12%) percent per annum ill 180
consecutive monthly InstaUments of $207,40 commencing on May I, 1992.
6. Pursuant to said "Contract", Exhibit "A" Seller, Royal FiDance ofPennsylvanla,
retained a security iDterest In said 1983 Zimmer Mobile Home.
7. Tbe "Contract" wu assigned by the seUer, Royal FiDlDce of Pennsylvaoia, to
Green Tree, Said Assignment is noted on the "Contract" and Green Tree retained a security
iDterest ill said Mobile Home,
8. Pursuant to said Assigoment, Green Tree further secured Its lien OD the

Il. Defendant, Roush Is currently in default of the provisions of tbe Contract,
Exhibit "A", having iDtn AliA failed to make the agreed upon monthly payments 0($231.30,
10. Despite repeated requests by Green Tree, Engleman has failed IDd refused
to make any payments except for $231.30 on January 31, 1994 (wblch represents December,
1993 payment) IDd further, continues to maintain wronlful posaession of the 1983 Zimmer
Mobile Home.
11, The total balance required to brinl the "Contract", Exhibit "A", current as of
April 26, 1994, is the sum of Nine Hundred Twenty-Five and 20/100 ($925.20) Dollars IDd
the total balance due and owinl as of said date pursuant to said "Contract" Is currently the
sum of $17,676.03.
12. Pursuant to the terms and provisions of the "Contract", Exhibit "A", Plaintiff
is entitled to immediate possession of said 1983 Zimmer Mobile Home.
13. On or about January 29, 1994, pursuant to the mandates of the Pennsylvania
Motor Vehicle Sales Finance Act of 1947, 69 P.S, ~ 601 et. seq., Green Tree delivered to
Roush a Notice of Intention to Accelerate, Commence Legal Action or Repossess, said
Notice being sent to Defendants In advance of the thirty (30) days commencing this actiou,
A copy of said Notice Is attached hereto, made a part hereof, and designated Exhibit "C'.
14. Green Tree is entitled to detention damages, special damqes, conalstiol of
lI1Iu IIiI, detaching and transporting the Mobile Home, shipping fees, and any late charges
per the "Contract", further costs for repossession and saIe and attorney's fees and costs of
litigation necessary to obtain possession of the 1983 Zimmer Mobile Home.
WHEREFORE, Plaintiff, Green Tree, requests judgment against Defendant to
recover the 1983 Zimmer Mobile Home, located at 7073 Carlisle Pike, Lot #313, Carlisle,
Pennsylvania 17013, plus detention damages, and special damages consisting of U I.UJ,
detaching and transporting the Mobile Home, shipping fees, plus any cost for Insunnce
placed on the Mobile Home by Green Tree, late charges per the "Contract", any further
costs for repossession and sale, attorney's fees and costs of litigation in order to obtain
