COMPLAINT
COMES NOW the plaintiff, Terrie L. Cupp, and respectfully
states as follows:
1. The plaintiff, Terrie L, cupp, is an adult individual
residing at 845 Meadow Lane, Camp Hill, Cumberland County,
Pennsylvania 17011.
2, The defendants, Thomas H, McCullough and Deborah
McCullough, are adult individuals residing at 506 Lewisberry
Road, New Cumberland, Cumberland County, Pennsylvania 17070.
3, On or about January 31, 1994, Plaintiff and Defendants
entered into a lease agreement, providing that Defendants would
lease to Plaintiff a residential dwelling located at 312 South
River street, Apartment No, 1, Wormleysburg, Cumberland County,
Pennsylvania 17043, A copy of the parties' lease is attached
hereto, incorporated by reference, and marked as Plaintiff's
Exhibit "A",
4, Although the written lease agreement provided that the
lease term would begin on February 1, 1994, the parties verbally
agreed that commencement of the term would be delayed until
February 15, 1994, due to snow conditions which interfered with
Plaintiff's ability to move into the apartment.

5. Prior to taking possession of the apartment, Plaintiff
paid to Defendant a security deposit in the amount of $325.00 and
the first month's rent in the same amount, for a total of
$650.00,
6, On February 15, 1994, when Plaintiff was about to move
into the apartment, she discovered several hazardous conditions
in and around the dwelling, including, but not limited to the
following:
a, A natural gas line hanging in a dangerous position
under the outside spouting.
b, A gas stove located dangerously close to the wall.
c. No smoke detectors.
d, Trash and debris piled up around the building,
which posed physical hazards and created a potential
source of attraction for vermin,
7. The hazardous conditions in and around the apartment
rendered it dangerous and unfit for human habitation, in
violation of the implied warranty of habitability and
Wormleysburg housing ordinances, thus relieving Plaintiff of any
obligation under the parties' lease agreement.
8. Upon discovering the hazardous conditions, Plaintiff
refused to move into the apartment, and demanded that Defendants
return her security deposit and rent payment,
9, Following Plaintiff's demand, Defendants returned
Plaintiff's rent payment of $325,00, but failed to return her
security deposit.

10. Despite being aware of Plaintiff's address, which she
had previously advised them of in writing, and Plaintiff's
surrender and Defendants' acceptance of the rental premises,
Defendants failed to return Plaintiff's security deposit or
provide her with a written list of any damages to the leasehold
premises wi~hin thirty (30) days thereafter.
11. Pursuant to 68 P.S. 5250,512, Defendants are required
to return Plaintiff's security deposit ($325.00) to her, as well
as pay her a statutory penalty of $325.00.
12. On April 5, 1994, following a hearing before District
Justice Robert V. Manlove, Plaintiff was awarded a judgment in
the amount of her security deposit ($325.00) and court costs
($42.50), from which this appeal was taken by Defendants.
WHEREFORE, Plaintiff requests judgment in her favor and
against Defendants in the amount of $650.00, plus court costs in
the amount of $42,50,

Defendants, Thomas and Deborah (sic) McCullough, by and
through their attorney, Charles R. Gerow, Esquire, herein
answer Plaintiff's Complaint as follows:
1, DENIED. After reasonable investigation Answering
Defendants are without knowledge or information sufficient
to form a belief as to the truth of the averments
contained in this paragraph and therefore, Defendants
deny the allegation.
2. ADMITTED IN PART, DENIED AS STATED. Excepting that
Defendant, "Deborah" is not her legal and proper name as
reflected in all documents bearing her signature, the
allegations contained in this paragraph are admitted.
3, ADMITTED IN PART, DENIED IN PART. The document marked
"Plaintiff's Exhibit 'A'" speaks for itself, but it is
denied that the document so marked is a complete copy of
the lease executed by the parties,

without knowledge or information sufficient to form a
belief as to the truth of the averments contained in this
paragraph and therefore, Defendants deny the allegation.
Strict proof is demanded at the time of trial.

no further response is required under the Pennsylvania
Rules of civil Procedure. Moreover, by way of specific
response to any allegation of breached duty, it is denied
that Defendants breached any duty to Plaintiff.
8. DENIED. It is specifically denied that Plaintiff made any
demand of Defendants,
9. ADMITTED IN PART, DENIED IN PART. It is admitted that
Defendants, by Agreement with Plaintiff, returned some
monies to her. It is denied that said return of monies
was as a result of any demand by Plaintiff or that said
return of monies represented any admission on the part of
Defendants whatsoever,
10. DENIED. The various averments of this paragraph, some of
which are conclusions of law to which no further response is
required under the Pennsylvania Rules of civil Procedure, are
specifically denied. strict proof is demanded at the time of
trial,
11. DENIED. This averment is a conclusion of law to which no
response is required under the pennsylvania Rules of
Civil Procedure.
12. DENIED. This averment should be Preliminarily Objected
to, but in the interests of the economy of this Honorable
Court, it should be stricken by simple request of
Plaintiff as wholly inadmissible and prejudicial.
WHEREFORE, Defendants, Thomas H. McCullough and Deborah (sic)
Mccullough, demand that plaintiffs suit be dismissed with
prejudice, plus costs and expenses of this suit or that
judgment be entered in their favor and against Plaintiff,
plus costs and expenses of this suit.
NEW MATTER
COUNTERCLAIM
13. Plaintiff's paragraphs 1-4, inclusive are incorporated by
reference.
14. Plaintiff, Terrie L. Cupp has failed to make the rental
payments 'as required under the terms of said lease,
failed to maintain aqequate and proper insurances, and in
all other manners violated the terms of and breached the
lease,
15. To date the amount of arrearage on said rental payments
is Two Thousand and Ten Dollars ($2,010) plus late
charges of One Thousand six Hundred and forty five
dollars ($1,645), and interest.
16. Despite demands by Defendants, Plaintiff has refused to
make payments as required by her lease.
WHEREFORE, Defendants, Thomas H. Mccullough and Deborah (sic)
McCullough respectfully request that judgment be entered in
their favor and against Plaintiff, Terrie L. cupp in the
amount of $3,655.00 plus interest, costs and expenses of this
suit.
