CIVIL ACTION-MORTGAGE FORECLOSURE
COMPLAINT
1. Plaintiff, FIDELITY BOND AND MORTGAGE COMPANY, is a
corporation organized and existing under the laws of the Commonwealth
of Pennsylvania with offices at 1777 Sentry Parkway West, Dublin Hall,
Suite 100, Blue Bell, Pennsylvania.
2. Defendants, JOHN E. MESSIMER and CLAIRE E. MESSIMER, his
wife, are the mortgagors and real owners of premises 700 Walton Road,

Lemoyne Borough, Cumberland County, Pennsylvania, hereinafter
described, whose last known address is as stated above.
3. Defendant, UNITED STATES OF AMERICA, is the holder of federal
tax lien #6014-FTL-91 (United States Department of Treasury v. John ~.
Messimer) filed 8/21/91 in the amount of $21,873.99. The aforesaid
lien is subordinate to the mortgage lien held by plaintiff hereinafter
referred to in paragraph 4 below.
4. On the 14th day of November, 1980, the above named mortgagors
made, executed and delivered a mortgage upon premises hereinafter
described to State Capital Savings and Loan Association, which
mortgage is recorded in the Office of the Recorder of Deeds for
Cumberland County in Mortgage Book 687 page 538.
5. On the 30th day of September, 1989, the said mortgage was
assigned to FIDELITY BOND AND MORTGAGE COMPANY, the plaintiff herein,
by written assignment which is recorded in the Office of the Recorder
of Deeds for Cumberland County in Record Book 370 page 370.
6. The premises subject to the said mortgage is described in
Exhibit "A" attached hereto and made a part hereof.
7. The mortgage is in default because the defendants have failed
to make the payment of the monthly installment of principal and
interest in accordance with the terms of the mortgage for the month of
October 1993, and each month thereafter, up to and including the
present time.
7. The following amounts are due on the mortgage:

Interest from 8/1/93 to 3/31/94 ($12.74 per diem)
Late charges accrued thru 3/31/94 ($17.74/month)
Escrow deficit thru 3/31/94 ($150.24/month)

8. The attorney's fee set forth is in conformity with the
mortgage and Pennsylvania law and will be collected in the event the
premises are purchased by a third party at Sheriff's Sale. If the
mortgage is reinstated prior to Sale, reasonable attorney's fees will
be charged based on the work actually performed.
9. On December 30, 1993, plaintiff sent to defendants by
certified mail Notice of Intention to Foreclose Mortgage in accordance
with the provisions of section 403 of Pennsylvania Act No. 6 of 1974,
a true and correct copy of which is attached hereto, made a part
hereof and marked Exhibit "B".
10. On December 30, 1993, plaintiff sent to defendants by first
class mail Notice of Homeowners' Emergency Mortgage Assistance Act of
1983 in accordance with Pennsylvania Act No. 91 of 1983, a true and
correct copy of which is attached hereto, made a part hereof and
marked Exhibit "C". Defendants have not had the required face-to-face
meeting with the mortgagee within the required time and plaintiff has
received no notice that defendants have had a face-to-face meeting
with a consumer credit agency, nor has plaintiff received notice that
defendants have filed an application with the Homeowners' Emergency
Mortgage Assistance Program.
WHEREFORE, plaintiff demands judgment in the sum of $43,036.82
plus interest, late charges, escrow amounts and costs to the date of
judgment and foreclosure of the said mortgage, and that the lien of
the united States be discharged.

DESCRIPTION:
ALL THAT CERTAIN tract or parcel of land and prew.ises, situate, lying and
being in the Borough of Lernoyne in the County of Cumberland and
Commonwealth of Pennsylvania, more particularly bounded and described
according to a Survey of D. P. RaffenGperger, dated May 11, 1953, as
follows:
BEGINNING at a point at the Southwest corner of the intersection of
Walton Street and 7th Street; thence Southwardly along the Western line
of 7th Street; One Hundred Seventy and Sixty-five One-Hundredths (170.65)
feet to a point on the Northern line of the Borough of New Cumberland;
thence South Fifty-two (52) degrees No (00) minutes West along same,
Seventy and Two One-hundredths (70.02) feet to a point at the dividing
line between Lots Nos. 63 and 64 on hereinafter mentioned Plan of Lots;
thence North Thirty-six (36) degrees Thirty (30) minutes West along same,
One Hundred Seventy-two and Forty-seven One-hundredths (172.47) feet to a
point on the Southern line of Walton Street; thence Eastwardly along
same, Seventy (70) feet to a point, the place of beginning.
BEING LOT NO. 64 on Plan of Lots, known as Chatham Village, said Plan
being recorded in Plan Book 4, Page 77, Cumberland County records.
